Wh~nrAS, iii accordance with Chapter 18.68 of the Town of Vail Municipal Code, the Zoning of eight recently annexed parcels of United States Forest Service property has been presented to tYie Town of Vail Planning and Environmental Commission; and WI~tEAS, the Planning and Environmental Commission has recommended Zoning Parcels B,C,D, G, and H as Green Belt and Natural Open Space (GNOS) and Parcels A, E and F - Public Use District (PUD); and WHr~~AS, the Town Council considers that it is in the pub11C interest to so zone said property; NOW, Tf~r;rc.r;rORE, BE IT ORDAINID BY THE TOWN COUNCIL OF THE TOWN OF VAIL, THAT: (1) The Council specif ically finds tkzat the procedures for the amencu,~~~t of the Official Zoning Map and zoning of recently annexed to the Town of Vail as prescribed in Chapter 18.68 of the Vail Municipal Code have been fulfilled, and the Council hereby receives the report and rec~~~x~,~ndation of the Planning and Environmental Commission recommending the approval of the zoning of the subject property. (2) Pursuant to Chapter 18.68 of the Vail Municipal Code, the properties mire fully described on the attached Exhibit A are Zoned as follows: (a) Parcels B, C, D, G, and H- Green Belt and Natural Open Space (C~TOS} {b) ~axcels A, E, and F - Public Use I3i:strict (PUD), (3) As provided in Section 18.08.030 of the Vail Municipal Code, the Zoning Administrator is hereby directed to promptly modify and amend the Official Zoning Map to indicate specified in paragraph (2) above. ' Y ~~ • '~ Ordinance No. 13, Series No. 1980 ~ Page Two (4) If any part, section subsection, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of this ordinance; and the Tawn Co~u~cil hereby declares that it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase hereof regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. (5) The Town Council hereby finds that this ordinance is necessary for the protection of the public health, safety and welfare.
