A„ _~ y: ~., ORDINANCE Nn. ~~~ Series of 1980 AN ORDINANCE A~.~ENDING ORDINANCE N0. ~0, SERIES of 1979, EXTENDING A P40RATORIUI~'I ON TFIE APPROVAL OF ALL BUILDTNCT PERD4~TS FOR f~ZODIFZCATTON, CI-IANGE, ALTERATION OR, ADDITION TO THE EXTERIOR OF ALL STRUCTUF~',ES TN TITS VAIL VILLAGE, EXCEPTINCx NORR~IAL MAINTENANCE AND REPAIRS, AUTITORIZZTdG AND DIRECTING THE TOtNPd ItIA~TAGER OR HI S AUTIOR I ZED REPRESENTATIVE TO STJSPEND THEE ISSUANCE OF BUILDINC~ PER]~~iITS THAT SVOULD BE INCONSISTENT WITH THIS MORATORIUM; !AND, SETTT'dCY FORTH DETAILS TN RELATION THERETO AND DECLARING AN EMERC•ENCY THEREFORE;. WIiEREAS , an area of the Town of Vail generally kno4vn as the Vail grillage as more particularly described in Ordinance No. ~0, Series of 1979, is the subject of a proposed design plan and architectural guide lines for its preservation and protectian; and, WHEREAS, the existing Vail ~:'illage has a character that has been determined to be critical to Van 's past and future which is to be protected under the proposed plan; and, UJHEREAS, the studies of the character of the vail Village indicate a clear and convincing need i'or zoning changes, preservation measures, and a new approach to the enhancement of the character of the Village; and, ~~VI~IEREAS, the To~~rn Council has determined that the proposed mooning changes and preservation measures are necessary to enhance the Vail Village and a further detailed review of the allocation of land uses in the Village, buildings that should be preserved, areas where change can enhance the ~Ti_llage, and what is best for the Town of Vail, is necessary; and, T~YHEPEAS, the Tcwn ~'ouncil is deter:n~ned that the existing regulations relating to the Vail Village area are insufficient and inconsistent with the `t'o~~ln's Planning "Teals for Vail Village and should be revised to nrc~serve it and protect the area; and, ,;- , ,~ ~ '. Ordinance I~To. 15 Page iF1TIEREAS, the Town Council is of the opinion that ail alterations, modifications or changes to the exterior structures in said area should be delayed pending changes to the regulations of the ~~bwn of ~r~.il that would protect and preserve the area lrnown as Vail Village; and, j'VIIEREAS, it appears that the review process for the protection and preservation of the Village can be accomplished within the next C~0 days and, WHEREAS, the Town Council finds that Building Permits have been sought for development in the s'illage area which has been proposed fox study, which development would seriously threaten to obviate the objective of the proposed protection and preservation of the Village; and, ~NHEREAS, the `T'OWn Council concludes that the :4ioratorium adopted by Ordinance No. 40, series of 1979, should be extended to protect and preserve the Village; NO~'V, THEREFORE, BE IT OT~DAIT~FD BY THE TOWN COUTrCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. The Town Manager or his duly authorized representative is hereby authorized and directed to suspend the issuance of Building Permits :far proposals to alter, rlocTify, change, or add to the exterior of all existing structures in the Vail Village area (as more particularly described in Exhibit "A" to Ordinance 3•da. 40, Series of 1979), provided, however, that this h?oratorium shall - not apply to permits or proposals for normal maintenance or repair of any structure in the Vail Village area as may be permitted by the Town PTanager ar to those proposals that have received either Planning and environmental • Ordinance No. 15 Page 3 Commission, Design ?teview Doard, or Staff approvals prior to the effective date of ordinance No. ~0, Series of 197~J, in the area described in sand Ordinance No. 40. (a) This Moratorium ~~.dopted by Ordinance i~o. ~~, Series of 19x9 atld extended by this Ordinance shall be in effect until 60 clays after the effective date of this Ordinance, unless other- wise extended by the Town Council. Section 2. The Town Council, based upon the above findings, specifically finds and states that it is the opina.on of the Council that an emergency exists, that this ordinance is immediately necessary for the protection of the public health, safety and welfare, the provisions of this Ordinance shall tal>e full. force a,nd eft'ect upon adoption, in accordance with the Charter of the Town of frail, as an emergency measure.
