HomeMy WebLinkAbout1980-17 Setting Forth an Amendment to the Uniform Building Code, 1979 Edition: Providing for Protective Fencing, Time Restrictions for Parking, Storage of Materials and Restrictions on Use of Public Ways Applicable to Construction Sites~ ~ ~ ' ~ ~ //( • ~~ J J 4 r ORDINANCE NO. 17 Series of 1980 AN ORDINANCE SETTING FORTH AN AMENDMENT TO THE UNIFORP~I BUILDING CODE, 1979 EDITION: PROVIDING FOR PROTECTIVE FENCING, TIME RESTRICTIONS FOR PARKING, STORAGE OF MATERIALS AND RESTRICTIONS ON USE OF PUBLIC WAYS APPLICABLE TO CONSTRUCTION SITES AS RE- QUIRED BY THE DESIGN REVIEW BOARD IN VAIL VILLAGE AND VAIL LIONSHEAD CORE AREAS OR IN CLOSE PROXIMITY TO EITHER CORE AREA. WHEREAS, the Town of Vail has adopted by reference the Uniform Building Code, 1979 Edition, and WHEREAS, it is the opinion of the Town Council that the public health, safety and welfare would be served by amending said code to provide for certain construction standards for building construction sites as required by the Design Review Board; NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE TOWN COUNCIL Oh' TIIE T0~'dN OF VAIL , COLORADO THAT Section 1. The following amendment is made to the Uniform Building Coda, 1979 Edition. A. Section 1718 Special. Construction requirements is amended by the addition of subparagraph e to read as follows: e, Additional requirements for building construction sites in Vail Village and Vail Lionshead Core Areas or in close proximity to either core area. 1} The Design Review Board may provide that exterior construction work to be done on any construction site may be done the year-round so long as a protective fence is erected around that portion of the construction site specified by the Design Review Board, to provide protection, shielding and maintenance of Town right-of-way, easements and pertinent vehicular and pedestrian traffic flow. •r ~; •, Ordinance No. 1'7 Page 2 2} The fencing required in (1) above shall require approval. of the Design Review Board and the Building Official in regard to design, location, and construction priax to the issuance of a building permit therefore. 3) A maximum of one job vehicle shall be allowed at the construction site at all times between the hours of 7 A.h,4. and 6 P,~4. unless modified by the Tawn of Vail Building Official. The location of such vehicle shall be approved in writing by the Town Building Official. 4) Delivery vehicles for construction supplies shall be allowed a maximum of thirty (30} minutes delivery time to the jab site. All delivery vehicles must comply with any other time requirements set forth by the Town of Vail Ordinance. 5) If any public way, road, easement or area is to be blocked during construction far any reason what- soever, the Town. of Vail Police and Fire Department sha1.1. be given written notice thereof no more than 24 hours prior to the blockage. 6) All building materials at the job site shall be stored entirely within a structure. Provided if said materials can not be stored inside, they shall be stored inside the fenced area. Adequate trash facilities shall. also be located inside the fenced area. 7) No building permits wi1.l be issued for work in Commercial Core I or Commercial Care II unless a " construction time schedule is received and approved by the Building Official. ~~ ~f- •( Ordinance No, 17 Page ~ 8.) Whenever a street, sidewalk, wa?.kway, vehicular alley> or pedestrian area is to be altered, disrupted, l~lockeci or interfered with, the applicant for the building permit shall s~xbmit to the Design }Zeview Board for its approval a plan for temporary replacement facilities. Section 2 ~'.) L'pon completion of construction the Town of Vail right--of-way shall he restored to proper condition as required by the Town of Vail Director of Public Works. If any part, section, subsection, sentence, clause, or phrase of this ordinance, is for any reason held to be invalid, such decision slZall not affect the validity of the remaining portions of this ordinance; and the gown Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase hereof, regardless of the fact that any one or more Harts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3. The atnendmer.t of any provision of the Vail I~~7unicipal Code as provided in the Ordinance shal]. not af~ect any right which has accured, any duty imposed, and violation that occur prior to the effective date hereof, airy prosecution commenced, nor any othex action and proceeding as commenced under or by virture of the provision amended. The amendment of any provision hereby shall not revive any provision or other ordinance previously repealed or superseded unless expressly stated herein. Section ~k, The To~rvn Council hereby finds, determines, and declares that this Ordinance is necessary and proper for the health safety and welfare of the Town of Vail and the inhabitants thereof.
