Scatt.le, iYast.inr~,'tox„ has compiled, edited, and published a supplement to the Vail P,~unicipal Code; ~YHIaR1iAS, the Vail ~Iuni,cipal Code was adopted June 7, 1977, by Ordinance No_ 12:, Series of 1977, codifying the general and permanent ordinance of the Town of Vail; jYFIEREAS, this adopting ordinance for the second l~?79 Supplement to the Vail ;~unicipal Code vras introduced on May 20, 1980, and passed. on first reading, WIXLREAS, notice for a public hearing shall be published twice in acc.~rdance with C. R, S . 31--1F--203 { 1973 , as amended) ; WHERI+sAS, said public hearing was to be held on June 17, 1980, and WIiEREAS, there have been filed and there are now on file in the o#'fice of the Town Clerk for public inspection, three copies of the 1979 Supplement to the Vail 1~tunicipal Code; NOW, THEREFORE, BF IT ORDAINED $Y I'HE TOtiYN COUNCIL• OF TI-IE TO~YN OF VA I T~ , COLORADO , TH:'1T • ~ 1;' •, Ordinance No. 20 Pa{;e 2 Section 1. t~doption Pursuant to the provisions of C.R.S. 31-16--201 through 31--16-?O8 {.1973, as amended}, there is hereby adopted the second 1979 Supplement to the Vail 1'Iunicipal Code, as published. by Boob publishing Company, Seattle, Washington. Section 2. Secondary Codes :adopted by ~,oference. The 1;'lodel Traffic Code for Colorado rrlunicipalities (,1977); 197G Edition of the Uniform Fire Code; and 1975 Edition Z~ational Electric Code; are codified ~~ith this Supplement. Section 3. Title - Citation - :~eferpnce. This Supplement shall become part of the Vail `.~unicipal Code, and it shall be sufficient to refer to said code in its entirety as the "Vail ',lunicipal Code'' in any prosecution for the violation of any provision thereof or in any proceeding at law or equity. Tt shall bE sufficient to designate any ordinance adding to, amending, correction, or repealing all or any portion thereof as an addition to; amendment to, correction or repeal of the ''Vail Municipal Code'. Further reference may be had to the titles, chapters, sections, and sub-sections of the "Vail Municipal Code" and such reference shall apply to that number, title, chapter, section or sub-section as it appears in the Code, Section ~. Ordinances Codified by Supplement. The general and permanent ordinances of the Town ~ubseq,uent to Ordinance I~io. li,Series of 1979, to and including Ordinance Pdo. 3G, Series of 1979, are hereby included as part of the "Vail `.:unicipal Code". / ~ ~~''' Ordinance No. 20 Section 5 Codification Authority. Wage 3 This Supplement is codified pursuant to the provisions of C.R.S. 31--16-?01 through 31-16-208 {197;3, as amended). Section 6. Reference Appl~.es to all Amendments. Whenever a refer.Pnce is made herein to the 'Vail ~4unicipal Code" nr to any portion thereof, or to any ordinance of the Town of Vail, Colorado, the reference shall apply to all amendments, corrections and additions thereto, now or hereafter made. Section 7. Title, Chapter and Section Headings. Title, chapter and section headings contained herein shall not be deemed to govern, ~irnit, modify or in any manner affect tYae scope meaning or intent of the provisions of any title, chapter ox section thereof. Section $. Reference to Specific Ordinances. Tk~e provisions of the code shall not in any manner affect mattexs of record which refer to, or are otherwise connected with ordinances which are therein specifically designated by number or otherwise which are included within the Code, but such reference shall be construed to apply to the corresponding provisions contained in the Code. Section 9. Cost of Vail :~unicipal Code and 1979 Supplement. The price of the second 1979 Supplement to the Vail ~.Zunxcipal f;ode shall be `~25.fl0, Seeta.on 10, Effect of Supplement on Past Actions and Obligations. Neither the adoption o:~ this Supplement nor the repeal, nor the amendments hereby of any ordinance ar apart ar portion of any ordinance of the Town of Vail shall in any manner affect the prosecution far violations of ordinances, which viola.t~.ons were committed prior to the ef:~ective elate thereof , nor be construed as a waiver of any license, fee, penaltym at said ef~'ective date due and unpaid under such ordinances, nnx be construed as affectin; any o.f the provisions of such ordinances rc~latinr; to the col7Eaction of any such Iicense, fee, or penalty, or t~1e penal provisions n,pplicable to any ~~ Ordinance No, 20 Page -~ violation thereof, nor to affect the validity of any bond. or cash deposit in lieu thereof required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertain:~ng shall continue in full force and effect. x~urther, the adoption of this ordinance shall not affect or impair or be applicable to; (a} any preceding suit, or legal action presently pending. (b) any special ordinance, resolution or motion heretofore passed, adopted and made validating ratifying or legalizing the acts or commissions of any officer ox va.l~.dating any ordinance, act or proceeding whatever; and all validating and legalizing acts of and by the Town Cour_ci1 whatsoever and now in force axe hereby continued in force; (_c} any ordinance relating to the public debt or the public credit or any annexation of territory; {d) any ordinance relating to a contract to which the Town of Vail, Colorado, is a party or to any contract made for its be~~efits; (e} any ordinance, resolution or motion making appropriation of pu}alic funds; (.f} any ordinance, levying ~t special benefit assessment or creating a lien and debt against any property situated within the 'own of Vail, Colorado, arzd improved by the opening , ~viclening , extension or paving of any street or public thoroughfare ~sithin the Town and/or the inst~.llation of ;utters, curbs, curbwalks or sidewalks along sand street or thoroughfare and/or the installation, construction of utilities or other sifailar type improvements: ~, ~~~.. ~~ Ordinance No. 20 Page (~;) any ordinance or resolution granting any franchise, license, right or revocable permit to any person, firm or corporation, which franchise, license, right or revocable permit was Legally in force and effect on the effective date of this ordinance; it being the express intent and purpose of the Town Council that every such franchise, license, right or revocable permit shall expire as originally provided by the ordinance granting the same unless sooner terminated by the Council acting under and pursuant to the ordinances and charter of the Tovrn of Vail, or the terms and conditions set forth in the ordinance or resolution making the grant; (?~) any ordinance or resolution promising or guaranteeing the payment of money by the Town or authorising the issuance and sale of general obligation or revenue bonds by the mown; {i) any administrative ordinance or resolution of the Town not in conflict or inconsistant with the provisa,ans of the Vail "riunicipal Code; (j) any ordinance providing for and making the annual tax levy in and for the Town of ~'aiL, Colorado, or ordinance adopting the budget for the Town ar making to annual apppropriation; (_k) any ordinance or resolution establishing land use zoning districts ,in the Town, adopting a map of zoning districts, providing for adjustment enforcement and amendment thereof; or, any ordinance appx'aving a subdivision of land vaithin the annexation to the 'd'own; (1) any ordinance, resolution or motion naming, renaming, opening, accepting or vacating streets, ~'~ • alleys, or rights-af-~w ay in the "`own ; ~~ Ordinance No. 20 ~~~ • !~ Page F, (m) any ordinance relating to the sale or purchase of real property or personal property or relating to the vacation or release of rights in real property, or any ordinance providing for rights in real or personal property, or any ordinance designating the purpose for which land is to be used, or any ordinance relating to any other such. similar matter. Section 11. Violations and Punishment. Tt shall be unlawful for any person to violate any provision or to fail to comply with any of the requirements of this Supplement. Any person who shall violate any - provisions of this Supplement shall be punishable by a line of not more than $300 or by imprisonment for ~. period of not more than ninety (90~ days ar by both such fine and imprisonment, Any s~~ch person shall be guilty of a separate offense for each and every day during any portion of ti~~hich in violation of any provision of this Supplement is committed, continued, ar permitted by such person and shall be punished accordingly. In addition to the penalty herein above provided, in a condition caused or permitted to exist in violation o~ any of the provisions of this Supplement shall be deemed a public nuisance and may be, by tr~is Town summar~.ly abated as such, and each day that such condition continues shall be regarded as anew and separate offense. Section 12, Penalty Sections of the Supplement. There were no penalty sections included in this ~u~plement not previously codified. Section 13. Effective D~.te . This second 1973 Supplement sha11 become ellective on the e~~ective date of this ordinance adopting this Supplement in accordance cvith the provisions of the charter of the Town of Vail, Colorado, • ~ ~i ~ Oxctinance No. ZQ Section 14. Severability. Y~age 7 If any section, sub--section, sentence, clause, or phrase of this ordinance or Supplement a.s for any reason held t4 be invalld or unconstitutional., sucYi decision shall not affect the validity of the remaining portions of this ordinance or Uupplement. The Town Council hereby declares that it would have passed the same, any section, sub-section, sentence, clause and phrase thereof, irrespective of t3~e fact that any one or more sections, sub-sections, sentences, clauses or phrases had been declared invalid or unconstitutional, and i.f for any reason this ordinance or Supplement should be declared invalid or unconstitutional, then the originial ordinance or ordinances shall be in full force and effect. The SummerVail Workshop has one of the best all-round metals program in the country and krrifenuiking is the ne~~r•est addition to this program. The class will deal with stock rerrroval methods of knife construction with emphasis on varinus types of folding knives. Instruction will includechoices of steel .materials and heat treatment of blades and springs for the various steels discussed. Bob Coogan will instruct the class. TLr~i1i 1~'t)itiitiE[l)I' S~_..InerVail Workshop [avorite, Eric Abraham will teach a one week workshop in handbuilt porcelain at the itilalait Park facility June 23-27 from 9 a.m.-4 p.m. The class will deal with techniques in designing handhl.tilt objects, thought of as sculpture as opposed to practical ceramic pieces such as bowls, cups, plates, etc. Surface decoration will be shown and will include lustre glazing, oxide washes and single-fi.re techniques. Abraham, who teaches at Fitt<sburg University in Kansas, has been a part of the SummerVail Workshop for nine years. He received his i41,F,A- at the University of Nebraska after attending the Kansas City Art institute. He has taught at Kansas State University in l~ianhattan, Kansas and his work is on display locally at the Gold and Silversmith Shop in Vail. Tuition for the class is 525 for local residents with a $20 fee for materials.
