AN ORDINANCE AMENDING CHAPTER ~.7
OF THE VAIL MUNICIPAL CODE, PROVIDING
A NEW DEFINITION FOR THE TERM
SUBDIVISION, ADDITIONAL DEFINITION;
SETTING FORTH PROHIBITED AND UNLAL'VFUL ACTS
AND REMEDIES FOR VIOLATIONS OF THIS ORDINANCE,
AND AMENDING THE PROCEDURE FOR APPEALING A
DECISION OF THE PLANNING AND ENVIRONMENTAL
COMMISSION TO THE TOWN COUNCIL.
WHEREAS, The Town of Vaal presently has a balance between
accommodations for visitors to the Town, Vail residents and
seasonal employees; and
WHEREAS, The Town of Vail is of the opinion that the unregulated
development of time-sharing projects could upset that balance;
WHEREAS, the present subdivision ordinance is not sufficient
to deal with the problems presented by time-sharing projects and
should therefore be amended; and
~YHEREAS, the Town Council concludes that such an amendment is
necessary to protect the health safety and welfare of the
inhabitants of the Town of Vail.
NOW, THEREFORE, BE IT ORDAINED BY THE VAIL TOWN COUNCIL OF
THE TOWN OF VAIL, COLORADO, THAT:
Section 1.
I.7.08.150 of the Vail Municipal Code if repealed and
reenacted to read as follows:
17.08.150 SUBDIVISION A subdivision or subdivided
land is defined as:
(1} a tract of land which is divided into three
or more lots, tracts, parcels, sites, separate
interests (including leasehold interests},
interests in common, or other division for the
purpose, whether immediate or future, or
transfer of ownership, or for building or other
development, ar for street use by reference
to such subdivision or recorded plat thereof; or

{2} a tract of land including land to
be used for condominiums, time--
share estates, fractional fee
units, or time-share licenses; or
(3) a house, condominium, apartment
or other dwelling unit which is
divided into two or more separate
interests through division of the
fee or title thereto, whether
by conveyance, license, lease,
contract far sale or any other
method of disposition.
(4) unless the method of land disposition
is adopted for the purpose of evading
this definition, the term "subdivision"
is defined in this section shall not
apply to any of the following divisions
of land or interests in land:
(a) The division of land by order
of any court in this state or
by operation of law.
(b) The division of land by a lien,
mortgage, deed of trust or any
other security instrument.
(c) The division of land by a
security or unit of interest
in any investment trust regulated
under the laws of this state
ox any other interest in an
investment entity.
{d) The division of land which
creates an interest or interests
in nil, gas or minerals which
are now or hereafter severed from
the surface ownership of real
property.
(e) The division of land by the
acquisition of an interest in
land in the name of a husband
and wife or other persons in
joint tenancy or as tenants in
common and any such interest
shall be deemed for purposes
of this section as or~1y one interest,
provided, however, that no agreement
exists, either recorded or
unrecorded, between the co-tenants
allowing far the use and occupancy
of the property by one or more
co-tenants to the exclusion of one
or more co-tenants during any period,
whether annually reoccuring
or not if said agreement is

in any way binding or effective
upon any assignee or future owner
of a fractional fee interest or
if said agreement continues to
be in any way binding or effective
upon any co-tenant for the sale
of any interest irz the property,
(f} The division of land by reason
of the dissolution of a joint
venture or other business entity.
(5) No subdivision shall be approved which
includes elements not in conformance
with the provisions of any applicable
zoning ordinance or other ordinance
of the Town of Vail or law ar
regulations of the State of Colorado.
Section 2.
Chapter l7 of the Vail Iviunicipal Code relating
to Subdivisions is amended by the addition of the following:
~-17.0$.053 Fractional Fee
{a) a fractional fee is defined
as a tenancy in common interest
in improved real property,
including condai:~iniums, created or held by
persons, partnerships, corporations, or
joint ventures ,or similar .entities,
wherein the tenants in cor,~-~ion have formerly
arranged by oral or written agreement
or understanding, wither recorded or unrecorded,
allowing for the use and occupancy
of the property by one
or more co-tenants to the
exclusion of one or mare
co-tenants during any period,
whether annually reoccuring
or nat which is binding upon
-any assignee or future owner
of a fractional fee interest or
if said agreement continues to
be in any way binding or effective
upon any co-tenant for the sale
of any interest in the property.
17.08.095 Project Instruments
The Project Instrument shall be defined in accordance
with the Statutes of the State of Colorado
17.0$.075 Time Span Estate
A Time Span Estate shall be defined in accordance

A Time-Share License shall be defined as a contractual
right to exclusive occupancy of specified premises.
Provided that the occupancy of the promises is
divided into 5 or more separate time periods extending
over a term cf more than two years. The prerriises
may consist of one parcel, unit or dwelling or any
of several parcels, units or dwellings identified
at the tame the license is created to be identified
later. No time share is a time-share license if
it meets the definition of interval estate, time-
share or time--span estate.
Tn 17.04.020 of the Vail i.Iunicapal Code is hereby
repealed and reenacted to read as follows:
17.04.420 Compliance
(a) General Prohibition It shall
be unlawful for any person, firm
or corporation to violate any
of the provisions of this
chapter or to transfer, sell, lease
ar agree to sell ox lease, any
lot, tract, parcel, site,
separate interest (including a
leasehold interest), interest
in common condominium interest,
time share estate, fractional fee,
or time-share license, ar any
other division within a subdivision
within the Town of Vail until such
subdivision has been approved in writing
by the planning and Environmental
Comri~ission and the Town Council (_as
applicable) and a plat thereof recorded
in the office of the Eagle County Clerk
and Recorder. Provided, however,
that a written agreement to sell ar
]ease which is expressly conditioned
upon full compliance
by the seller with the subdivision
regulations of the Town of Vail
within a specified period of time
and which expressly recites the
seller's failure to satisfy such
condition within said period of
time shall terminate the agreement
and entitle the buyer to the prompt
return of all consideration heretofor
paid by the buyer under said agreement,
shall not constitute a violation
of this subsection.
(b) Prohibitive Conveyance No lot or
parcel of land, nor any interest
therein, shall be transferred,
conveyed, sold, subdivided or
acquired either in whole or in part,
so as to create a new non-conforming
use or to avoid or ca.rcumvent
or subvert any provision of this
chi}7ter .
(c') The owner, developer, huger, or seller,
shall tie full` responsible for all
acts of agents or c~mployees thereof
that art' commi t.ted in violation of
t}~e t~-'r~~s at 11~is chapter.

(d) P~•ohibited Construction rIo structure
shall be constructed, nor Building
Permit issued for a structure, on any
parcel of land within a subdivision
approved pursuant to this chapter
except where such structure is~to be
constructed upon a lot separately
designated within the plat of an
approved subdivision. The lot lines,
common walls, .individual units,
condominium units established in
such approved subdivision shall not be
changed or altered by conveyance of
a part thereof, nor sha11 any part
of the same be joined with a part
of any other for conveyance or
construction or converted to condominiums
or tim e-sharing unless and until
written application has been made to
and approved the Planning and Environmental
Commission and the Town Council (as
applicable).
(ej Remedies for Violations In addition to
all remedies provided by law, the Town
of Vail shall be authorized to enforce
its subdivision regulations as fallo~~~s:
(1) The Town, in addition to other
remedies provided, r.1ay institute
an action fox injunction, mandamus,
abatement, or other appropriate
action or preceeding to prvent,
enjoin, abate, remove an unlawful
construction use, occupancy or
conveyance or to
enjoin any subdivider
from selling, agreeing to sell
or offering to sell, or otherwise
convey, before full compliance
with the provision of this chapter,
any parceled land or other interest
which sale or conveyance would
constitute a subdivision undex
Section 17.0$.150.
(2} The Town Building Inspector shall
refuse to issue permits of any kind
for the construction of any building
or other improvements upon any land
for which an approved final plat
is required by this chapter, unless
and until the requirements hereof
have been complied with.
{3} No Building Permit shall be issued
for any lot or parceled land which
leas been transfered, conveyed, sold,
subdivided or acquired in violation
of this chapter. Any transferee

land in violation of this chapter

{~) The Planning and Environmental
• Commission may withdraw any approval
of a plan or plat or require certain
corrective measures to be taken
following a determination that
information provided by the subdivider,
or by anyanE~ on his behalf , upon which
a decision was based, is false or
inaccurate. The Planning and Environmental
Commission shall cause written notice
to be served on the subdivider, or
his assigner, setting out a clear
and concise statement of the alleged
false or inaccurate information
provided by the subdivider, or
agents on his behalf and diecting•
the subdivider to appear at a time
certain for a hearing before the
Planning and Environmental Commission
not less than ten days nor r,~ore than
thirty days after the date of service
of notice. The Planning and Environmental
Commission shah. determine at the
hearing the natux•e and ea~tent of the
alleged false or inaccurate information
and shall base power, or good cause,
being shown, to withdraw any approval
or require certain corrective measures
to be taken. However, withdrawl of
approval or imposition of corrective
requirements shall not be an ear'lusive
remedy on finding b~> the Commission or
inaccurate inforr,~ation has been received,
and any anti a17. remedies provided b3= law
may be exercised.
Section 4.
Section 17.16.030 is amended by the addition of
a subparagraph (1) to read as follows:
(1} project instruments, if applicable.
Section 5.
Subsection 17.10.110 is amended by the addition
of two additional paragraphs to be lettered (b) and (c)
to read as follows:

Section 6.
Chapter 17.16 of the Vail liunicipa] Code is amended
by the addition of the following:
17.16.080 Town Council Review
{a) A decision of the Planning Commission
may be appealed to the Town Council
by the applicant, any aggrieved person,
or the Town :Manager .
(b) Within three days following a decision
by the Planning' Commission, its decision
to approve, disapprove, or request
changes in a subdivision application
shall be transmitted to the applicant.
The decision shall become final. if no
written appeal is made to the Town
Council within ten days follo~t~ing the
decision of the Planning Commission.
(_c} Not more than twenty-one days following
the filing of an appeal, the Town Council
" shall review the action of the Planning
and Environmental Commission. The Town
Council. shall confirm, modify or reverse
the decision of the Planning and Environrental
Commission within twenty-one days
• following the filing of the appeal. If the
Council finds that there is insufficient
information to provide the basis for a
sound decision, the Counc~.l
r;ay postpone final action for not
more than thirty additional days.
Failure of the Council to act within -
twenty--one days of the filing of the
appeal or within the thirty additional
days if the appeal has been continued
shall be deemed approval, by the Council
of the subdivision unless the applicant
consents to a time extension.
(d) Any decision of the Town Council which
results in the disapproval of the sub-
division shall specifically describe
the basis upon which the disapproval
was entered.

if any part, section, subsection, sentence, clause
or phrase of this ordinance is for any reason held to be
invalid, such decision shall not effect the validity of the
remaining portians of this ordinance; and the Town Council
hereby declares it would have passed this ordinance, and each
part, sectian, subsection, sentence, clause or phrase thereof,
regardless of the fact that any one or more parts, sections,
subsections, sentences, clauses or phrases be declared invalid.
Section 8.
The repeal or the repeal and reenactment of any
provision of the V;~.il Municipal Code as provided in this ordinance
shall not affect any right which has accured, any duty imposed,
any violations that occurred prior to the effective date
hereof, any prosecution commenced, nor any other action or
proceeding as commenced under or by virtue of the provision
repealed or repealed and reenacted. The repeal of any provision
hereby shall not revive any provision or any ordinance previously
repealed or superseded unless expressly stated herein.
