AN ORDINANCE AMENDING CHAPTER 1$ "ZOTdING"
OF TIiIr VAIL MUNICIPAL CODE; PROVIDING FOR
T1EW DEFINITIONS OF TIi1a FOLLOWING TERMS:

PLAN; PROVIDING FOR A NEW APPEAL PROCEDURE;
AND SETTING FORTH DETAILS RELATING THERETO.
WHEREAS, the '1"own Staff, the Planning and Environmental
Commission, and the Town Council of the Town of Vail have been
discussing certaa.n changes to the Zoning Code for the last
13 months; and
WHEREAS, the purpose of these changes is to improve certain
sections of the existing Zoning Code that are felt to be deficient;
an d
WHEREAS, the proposed amendments to the Zon~.ng Code have been
:properly considered by the Planning and Environmental Commission
after notice was given and the recommendations of the Planning
and Environmental Commission forwarded to the Town Council; and
WHEREAS, the Town Council is of the opinion that the zoning
code should be amended as set forth below;

NOW, THEREFORE, BE IT ORDAINED BY T1iE TO1VV COUNCIL OF THE
TOWN OF VAIL, COLORADO, T1iAT:
Section 1. Sections 18,04.060, 18.04.130, 1.8.04.140, 1.8.04.150,
and 1$.04.170 DEFINITIONS are repealed and reenacted to read as
follows:
1$.04.140 CREEK OR STREAM
"Creek" ox "stream" means a body of flowing water indicated
as a "perennial stream" on the most recent U.S.G.S. topo-
graphic map of the area.
18.04.130 FLOOR AREA, GROSS RESIDENTIAL
Gross Residential Floor Area is defined as the total floor area
within the enclosing walls of a structure, including all habitable
areas, greenhouses, indoor recreational facilities, and storage
areas with a ceiling height of greater than six (6) feet six (6)
inches, excluding the following: Crawl spaces, attic areas with-
out a ceiling height of greater than six (6) feet six (6) inches,
solar heating storage areas, mechanical areas, and areas designed
for parking and loading. Overlapping stairways shall only be
counted at the lowest level.
For, Single Family and Two ',Family Residences, a maximum of 300
square feet per vehicle space with a maximum of 2 spaces per
dwelling unit will be allowed for enclosed garages. There
shall also be a maximum of 50 square feet given for mechanical
areas and 25 square feet given for air lacks. Any square footage
over the maximum for either the garage, the mechanical areas or
air locks will be counted as Gross Residential Floor Area (GRFA).
For buildings containing more than 2 dwelling units, an additional
GRFA of up to 200 of the allowable GRFA on the site shall be allowed
for common corridors, common stairways, common hallways, common
closets, lobby areas, and enclosed common recreational facilities.
Anything in excess of this 20% will be deducted from the GRFA
allowed on the site.
1$.04.140 GRADE, EXISTING
The existing grade shall be the existing or natural topography
of a site prior to construction.
18.04.150 GRADE, FINISHED
The finished grade shall be the grade proposed upon completion
of a project.
],8.04.170 HEIGHT
The distance measured vertically, from the existing grade or
finished grade {whichever is more restrictive), at any given
point to the tap of a flat roof, or mansard roof or to the
highest ridge line of a sloping roof.

Section 2. Sections 18.10.080, 18.12.080, 18.13.075, 1.8.14.080,
1$.16,080, 18.1$.080, 18.20.080, 18.22.080, 18.24.120, 1$.26.090,
18.28.090, 18.30.080, and 18.32.080 "HEIGHT" are repealed and reenacted
to read as follows:
Sections 18.10.080, 18.12.080, 18.13.075, 18.14.080 and 1.8.32.080
HEIGHT
For a flat roof or mansard rood, the height of buildings shall
not exceed thirty feet. Far a sloping goof, the height of
buildings shall not exceed thirty-three feet.
Sections 1$.16.080, 18.18.080, 18.28.090, and ].8.30.080
HEIGHT
For a flat roof or mansard roof, the height of buildings shall
not exceed thirty-five feet. For a sloping roof, the height
of buildings shall not exceed thirty-eight feet.
Sections 18.20.080 and 18.22.080
HEIGHT
For a flat roof ar mansard roof, the height of buildings shall
not exceed forty-five feet. Far a sloping roof, the height of
buildings shall not exceed forty-eight feet.
Section 1.8.24.120 i-IEIGHT
Far a flat roof or mansard roof, the height of buildings shall
not exceed thirty-five feet. Far a sloping roof the height of
buildings shall not exceed thirty-eight feet. These restrictions
pertain unless otherwise specified by the Vail Village Urban
Design Guide Plan and Urban Design Considerations.
Section 18.26.090 HEIGHT
For a flat roof ar mansard roof, the heights of buildings shall
not exceed forty-five feet. For a sloping roof, the height of
buildings shall not exceed forty-eight feet. These rostrictions
pertain unless otherwise specified by the Vail Lionshead Urban
Design Guide Plan and Urban Design Considerations.
Section 3. Section 18.58.100
"Exceptions To Height Limit" is hereby repealed.
Section 4. The title and introductory paragraph of Section
18.69.050 is repealed and reenacted to read as follows:
]..8.69.050. SPECIAL RESTRICTIONS FOR DEVELOPI!'iEiVTS ON LOTS WHERE
THE AVERAGE SLOPE OF THE SITE BENEATH THE PROPOSED STRUCTURE AND
PARKING AREA IS IN EXCESS OF THIRTY PERCENT IN SINGLE-FAMILY
RESIDENTIAL, TWO-FAMILY RESIDENTIAL, AND TWO-FAMILY PRIIIiARY/
SECONDARY RESIDENTIAL ZONES.
The following additional special restrictions or requirements
shall apply to development an any lot in a single-family
residential, two-f amity residential or two-family primary/
secondary residential zone district where the average slope
of the site beneath the proposed structure and parking area
is in excess of thirty percent.
Section 5. Section 18.14.020C
Permitted Uses is repealed and reenacted to read as follows:
1$.14.OZOC Multiple-family residential dwellings, including
attached or row dwellings and condominium dwellings with no
more than 4 units in any new building.

Section 6. Sections 18.]..8.010 and 18.20.010
amended by the removal of the words "limited
offices and medical facilities"; and Sections

Section $. Section 18.52.080 Parking Standards l.s amended by
the addition of a Subsection G which reads as follows:
18.52.080G. Surf ace Runoff Control. Adequate measures far the
control of surface runoff shall be provided. Such measures may
include, but axe not limited to: infiltration galleries, detention
and settling ponds, sandtraps, grassed waterways. The Community
Development Department shall establish and maintain a list of such
control measures. Where required by Section 18.54.050A (8) (c} infra,
evidence of an approved NPDES discharge permit, or in lieu thereof,
a "no discharge" plan shall be presented.
Section 9. Chapter 1$.54 Design Review is amended to include the
following amended and new subsections:
18.59:.050 A2: A drainage study shall be prepared. This study shall
include a contour map showing all existing and proposed water
courses, including the seasonal course--limits of tributaries,
indicating the surface conditions and locations of points of
departure from the development. This study shall include
computations of x.00 year flows, in addition to an indication
of the limits of the 100 year flood plain plotted on the contour
map. The drainage study shall also include computations of
potential increase or decrease in flows anticipated as a result
of the development, the capacity and velocity through all drainage
structures, including open channels, and the revised flood plains
shall be plotted on a contour map. The drainage study shall also
indicate the location and types of structure that will be necessary
to handle the quantities of water evidenced on the site.
7. Erasion Control and revegetation landscaping plans.
a. In all. developments involving two or more acres, an erosion
control plan will be required. For developments involving
less than two acres, an erosion control plan may be re-
quired by the Community Development Department, based
upon conditions of slope and soil. stability.
b. The erosion control plan shall contain control measures
sufficient to prevent the loss by erosion of no mare than
3 tons of soil per acre per year. These standards may be
met through the use of physical. measures as detention
ponds, grassed waterways and filtration galleries, or
by nonstructural means.
c. The Community Development Department shall review and
approve all erasion control plans and shall maintain a
list of erasion control practices, both structural and
nonstructural.

d. Revegetation - revegetation shall be an integral. part of
the erosion control plan. Topsoil sha11 be saved during
construction and used for revegetation of disturbed areas.
e. Revegetation landscaping -- Such plan shall be required of
any applicant proposing three o~° more units (dwelling,
commercial, etc.) in any one project. The Design Review
Board, ar its authorized representative, may impose the
requirement upon any other applicant at the Board's option.
Numbers of units notwithstanding, potential damage to
existing landscaping/vegetation shall be adequate reason
for requiring a landscaping plan. At a minimum, plans
submitted under this subsection shall include revegetation
of land disturbed by development. The Community Development
Department shall establish and maintain a list of revegetation
best management practa.ces.
f. Tn addition to the above requirements, the Community Develop-
ment Department, with the approval of the Board, may require
any ar all of the following:
(1) Timing of disturbance
(2) Disturbed area controls
{3) Stabilization during disturbance
{4) Monitoring during disturbance
(5) Post-disturbance monitoring
(6} tiVater quality impact report
The Community Development Department shall establish and
maintain guidelines supporting and explaining the require-
ment of these measures in appropriate cases.
~3. Impervious Cover mitigation plan
The effects of increased impervious cover due to development (roofs,
parking lots, streets, driveways and sidewalks) shall be mitigated
in the following manner:
a. The developer shall attempt to minimize increases in
impervious cover through the use of techniques, such as
underground parking. The Community Development Department
shall maintain a list of such techniques.
b. Maximum use of open space shall be encouraged to mitigate
the impact of increased impervious cover. The developer
shall present figures indicating the percentage increase
in impervious cover projected as a result of development.
c. An approved NPDES permit for storm water discharges to
surface waters resulting from developments draining two
or more acres shall be presented. In lieu of such permit,
the developer of an area of two or more acres may present
a "no discharge" storm water drainage plan, which may include
such structural measures or detention ponds, high curbs, and
infiltration galleries. The Community Development Department
shall establish and maintain a list of such "no discharge"
measures.

Section 10. Chapter 18,56 Environmental :Empact Reports is
amended to include the fallowing new sub-sections:
18.56.010 Purpose

of live creeks or streams to any proposed structural
development within the project.

Survey, USDA, Soil Conservation Service and inter-
pretations of soil. types, vegetation shall be described
and three masses shown.

Section 11. Sections 18.54.090, 18,56.115, 18.60.070, and
18.62.070, Appeal to the Town Council are repealed and reenacted
to read as follows:

A. An appeal to the Town Council may be by the applicant,
adjacent property owner, or by the Town P~ianager. The Town
Council can also call up matters by a majority vote of those
Council members present.
3, For all appeals, the appeal must be filed in writing within
ten (10) days following the decision or must be called up by
the Town Council at their next regularly scheduled meeting.
C. The Council shall hear the appeal within 30 days of its
being filed or call up, with a possible 30 day extension
if the Council finds that there is insufficient information.
Section 1.2. if any part, section, subsection, sentence, clause
or phrase of this ordinance is far any reason held to be invalid, such
decision shall not affect the validity of the remaining portions of
this ordinance; and the Town Council hereby declares it would have
passed this ordinance, and each part, section, subsection, sentence,
clause or phrase thereof, regardless of the fact that any one or more
parts, sections, subsections, sente~zces, clauses ar phrases be
declared invalid.
