AN ORDINANCE REPEALING AND RI'aENACTING
SECTION 8,24.000 OF THE MUNICIPAL CODE
AND PROVIDING FOR RESTRICTIONS ON THE
MAKING AND CREATING OF EXCESSIVE ~tOISE
WITHIN THE TOWN; AND PROVIDING FOR
MAXI1~4Ui~~ PERMISSIBLE NOISE LIMITS FOR
CERTAIN TIi4TES Ai~TD ZONES; ArdD PROVIDING
DETAILS IN RELATION TTTERETO.
WHEREAS, Section 8.24,060 in its present form has not been
effective in restricting the making of excessive noise within the
Town, and
WHEREAS, the making of such excessive noise is a nuisance to
the inhabitants of the Town; and
~'VHEREAS, the Town Council has determined that it is necessary
for the protection of the health and safety of the inhabitants of
the Town to repeal. the present noise ordinance and reenact a new
and more effective ordinance.
NOW, THEREFORE, BE IT ORDAIT~IED BY THE TOE;rN COUNCIL OF THE
TOWN OF VAIL, COLORADO, THAT:
1. Section 8.24.060 of the Municipal Code of the Town of
Vail is hereby repealed and reenacted as follows:
$.24.060 noise Prohibit
A. The making and creating of an excessive or an unusually

loud noise at any location within the Town heard and

measured in a manner hereinafter set forth, shall be
unlawful; except when r:~ade under and in compliance
- with a permit issued pursuant to Section F of this
ordinance.
B. An excessive ox unusually loud noise shall be defined
as follows:
1. Noise of any duration which exceeds the allowable
`Y'~~ noise limit for the zone in which the noise source
is located by fifteen { 15) 17BA.

2. A noise, one minute or more in duration out of any
ten (10) minute period, 4vhich exceeds the allowable
noise limit for the zone in which the noise source
is located by ten (10) decibels.
3. A noise of five (5) minutes in duration and a total
of five minutes out of any ten minute period, which
exceeds the allowable noise limit for the zone in
which the noise source is located by three (3)
decibels.
C. For the purpose of determining and classifying any
noise as excessive or unusually loud as declared to be
unlawful and prohibited by this article, the noise
shall be measured on a decibel or sound level. meter of
standard design and quality operated on the "A" Weighting
Scale.
1.. If the noise source is located on private property,
the noise shawl be measured at or beyond the
property line of the property on which the noise
source is located. If the noise source is located
on public property, the noise shall be measured no
closer than ten feet from the noise source.
D. The following shall be the allowable noise limits for
the time periods and zones specified;

F. Applications for a specified permit to exceed noise

level designated in this article may be made to the
Town Manager or his duly authorized representative.
The Town Manager or his duly authorized representative

- may grant the relief as applied for if he finds the
following:
. 1
1. That additional time is necessary for the applicant
to alter or modify his activity or operation to
comply with this article.
2. The activity, operation or noise source will be of
temporary duration, and cannot be done in a manner
that will comply with sub -section A.
3. That no other reasonable alternative is available
to the applicant.
4. That the permit is necessary for the community's
cultural, historical or social benefit. The Town
Manager may prescribe any conditions or requirements
he deems necessary to minimize adverse effects upon
the community ox the surrounding neighborhood,
including but not limited to specific times or
functions of the noise on location of the noise
source. Any permit granted by the Town Manager
Yzereunder shall contain all conditions upon which
the permit has been granted and shall specify a
reasonable time that the permit shall. be effective
F. The maximum permissible noise limits for the times
and zones specified in paragraph D hereof shall not
apply to sound emitted from the following:
1. Any authorized emergency vehicle when responding
to an emergency call or acting in time of an
emergency.
2. Activities of a temporary duration permitted by
law and for which a license or permit therefore
has been granted by the Town, including but not
limited to parades and fireworks displays.
3. Any construction equipment operated upon a
residential, commercial, industrial, or public
premises during the time period between 7 AM and
7 PM, provided, however, that the operation of the

construction equipment during the hours of 7 AM ~C 7 Pll~
shall not exceed ninety {90) decibels.
4. Any snowmaking equipment.
5, Any motor vehicles designated for and operated on the
public streets, alleys, highways or freeways.
6. The sounds of any permitted bells or chimes or the
amplified reproductions o~ the sounds of any be11s
or chimes played between the hours of SAM to 7PM
provided that said sounds shall nat exceed eighty (SQ)
decibels.
G. Motor Vehicle Noise No person shall operate nor
shall the owner permit the operation of any motor
vehicle or combination of motor vehicles at any
t~.me or place when such operation exceeds the fol.~.owing
noise levels for the category of motor vehicle and for
the designated time period specified in the table set
forth below. The standards set forth in this table sha11
apply to all noise emitted from motor vehicles including
any and all equipment thereon, under any conditions of
acceleration, deceleration, idle, greater load, and
whether or not in motion. Maximum allowable noise
levels for motor vehicles shall be as follows:

It shall be unlawful far any person to drive or move or
for the owner of any motor vehicle to permit to be driven
or moved, any motor vehicle or combination of motor
vehicles at any time which is not equipped with an
exhaust muffler.

It shall be unlawful for any person or for the owner
of any motor vehicle to change or modify the exhaust
muffler, air a.ntake muffler, or any other sound reducing
device in such a manner that the noise emitted from the
motor vehicle (A} exceeds the noise levels as established
in the maximum allowable noise level table for motor
vehicles ox (B) is increased above the sound pressure
level of the vehicle as originally manufactured.
H. Amplified Sounds - No person shall play ox permit to
be played the amplified sounds of any bells or chimes
or the amplified reproduction of the sounds from any
bells ox chimes or the sounds from any loudspeaker or
sound amplifying equipment on any of the public streets,
parks, ways or places, or alJ.ow same to be projected
onto any public streets, parks, ways ar places within
the Town without first obtaining a permit from the Town
Clerk.
1. Applications must be acted upon and approved by
the Town Manager.
Applications for such permit shall be filed on forms
provided by the Town. Forms shall be made available
from the office of the Town Clerk.
3. The following information shall be provided by the
applicant for a permit to play such amplified sounds.
a. The address of the premises or location where
such sound is to be played.
b. The name of the person having direct charge of
the playing of such sounds.
c. The proposed hours during which such sounds
are to be played.

d. A general description of the sound amplifying
equipment F~hich is to be used.
e. The maximum sound producing power of the sound
amplifying equipment which is to be used, including
the wattage to~be used; the volume and decibels of
the sound which will be produced; and the approximate
distance from the premises which that sound will be
projected.

f. The names and addresses of the owners of property
located within 100 feet from the location of the
amplified sound source. The 100 feet shall be
measured to a structure or improvement on the
property and if there is no struct~~re or improvement
within 100 feet of the amplified sound source, tha
names and addresses do not need to be submitted.
g. An application fee is an amount determined by the
Town Manager.
The Town Manager shall schedule a public hearing on
the application. Notice of the public meeting shall. be mailed,
postage prepaid, regular mail, to all owners of property, as defined
in H3_f above. The notice shall. specify the time, date and location
of the public hearing, the name of the applicant, the source and
nature of the amplified sound, the application is on file in the
Town Manager's office and may be re~riewed during regular business
hours and that the public may appear and be heard at the public
hearing. Notice shall. also be published in a newspaper of general
circulation in the Town containing the same information. Notice
shall be mailed no less than fifteen (15) days prior ta~the public
hearing and published no less than ten (10) days prior to the public
hearing.
5. Following the public hearing, the Town Manager may giant
the application for a permit after consideration of objections and
remonstrances made by property owners defined in H3-f above, comments
by the public and all other relevant information and if he makes the
findings required in E-~ above.
6. Subsequent to the issuance of a permit for a certain
location, the Town shall issue no other permit for any location within
three hundred (300) feet of said location, so long as the permit for
said location is valid and in effect.
