HomeMy WebLinkAbout1981- 4 Defining Cannabis; Making it Unlawful to Possess, Use, or Attempt to Obtain, or Procure Cannabis; and Providing Penalties Therefore ORDINANCE N0. ~,I SERIE~i OF 1981 AN ORDINEi1~TCIa DEFINIi~1G CANNABIS; 11~lAliTNG IT UNLAWFUL TO POSSESS , USE , OR ATT1r1~dPT TO OBTAIN, OR PROCURE CANNABIS; AND PROVIDING PI{;NALTIES THEREFORE. • WHEREAS, the possession and public use of cannabis has become a growing problem within the Town; and WHEREAS, the Tawn Council has determined that the regulation of Cannabis can most efficiently be handled through the passage of a Town ordinance; and WHEREAS, the Town Council has determined that it is necessary for the protection for the health and safety of the inhabitants of the Town to enact an ordinance prohibita.ng the possession and public use of cannabis. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF TI3E TOZVN OF VAIL, COLORADO, THAT Section I ~- Definition of Cannabis "Cannabis" includes all parts of the plant Cannabis, Sativa L. whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds, or resin, but shall not include the mature stalks of said plant, fiber produced from its stalks, oil or cake made from the seeds of said plant, ar any other compound or manufacture, salt, derivative, mixture, or preparation of its mature stalks, except the resin extracted therefrom, fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination. Section II - Unlawful Act It shall be unlawful to possess, use or attempt to obtain or procure less than one ounce of cannabis. Section III - Penalty for Possession Any person who possesses not more than one ounce of cannabis shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not mare -than X100. {1) Y ~~ , Section IV - Summons and Complaint jVhenever a person is arrested or detained 'tor a violation of Section III of this ordinance, the arrestinh or detaining officer shall prepare a written notice or summons to appear in court, which written notice or summons shall contain the name and address of such arrested or detained person, the time and place where such person shall appear and a place for such person to execute his or her promise to appear at the time and place indicated on the summons or notice. The time specified in such notice to appear or summons must be at least five days after such arrest or detention unless the arrested or detained person demands an earlier hearing, and the Town zs able to provide such an earlier hearing. The place specified in said notice to appear must be before the Municipal Judge. The arrested or detained person must give his or her written promise to appear in court by signing the notice or summons prepared the arresting or detaining officer. Section V Any person who openly and publically displays or consumes not more than one ounce of cannabis is guilty of a misdemeanor and upon conviction thereof shall be punished at a minimum, by a fine of $100 or, at a maximum, by a fine of not more than X100 and fifteen days in jail. Section VI If any part, section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, sub-section, sentence, clause. or phrase thereof, regardless of the fact that any one or ~. more parts, sections, sub-sections, sentences, clauses ar phrases be declared invalid.
