AN ORDINANCE AMENDING THE VAIL MUNICIPAL
CODE SPECIFYING THAT THE DESIGN REVIEW
BOARD WILL BE EXPANDED TO SEVEN MEMBERS;
AND, SETTING FORTH DETAILS RELATED THERETO.
WHEREAS, the annexation of the Area commonly known as
_ West Vail will caused increased demand upon the services of the
Design Review Board; and
WHEREAS, the Town Council is of the opinion that an
opportunity for representation for the area previously known as
West Vail should be provided; and
WHEREAS, insurance of meeting regularity is increased by
means of a seven member board versus a five member board and,
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF VAIL, COLORADO, THAT:
Section l: Sub-paragraphs A and B of Section 18.54.020 and
Section 16.04.050 are repealed and reenacted to read as follows:
18.54.020 Board Organization - Powers and Duties.
A. There is established a design review board of the Town,
a board composed of seven members appointed by the Town
Council, to which is delegated the powers and duties to
administer Chapter 18.54 of this title.
B. The Design Review Board shall consist of six members
from the community at large and the seventh member
shall be a member of the Planning and Environmental
Commission of the Town. The terms of office for the
six members at large shall be two years on an over-
lapping basis, and the term of office for the Planning
and Environmental Commission member shall be three
months. Provided, however, that the terms of three
members shall expire on February 1, 1982 anal three
of February 1, 1983. Thereafter, each member subse-
quently appointed shall serve for a term of two years
which shall expire on February 1 of the year of
termination.
16.04.050 Design Review Board.
"Design review board" means a seven-member board
appointed by the town council as dictated by the
zoning ordinance which shall consist of six members
appointed from the community and one rotating member
from the planning commission.
Section 2. Subparagraph C of Section 18.54.020 shall be amended by
changing the number of members necessary for a quorum from 3 to 4.
Section 3. Subparagraph E of Section 18.54.020 is hereby repealed.

Section 4
The repeal or the repeal and reenactment of any provision of
the Vail Municipal Code as provided in this ordinance shall not
affect any right which has accrued, any duty imposed, any violation
that occurred prior to the effective date hereof, any prosecution
commenced, nor any other action or preceeding has commenced under
or by virtue of the provisions repealed or repealed and reenacted.
The repeal of any provision hereby shall not revive any provision
or any ordinance previously repealed or superceded unless expressly
stated herein.
Section 5
If any part, section, sub-section, sentence, clause or phrase
of this ordinance is for any reason held to be invalid, such decisions
shall not affect the validity of the remaining portions of this
ordinance; and the Town Council hereby declares it would have passed
this ordinance, and each part, section, sub-section, sentence, clause,
or phrase thereof, regardless of the fact that any one or more parts,
section, sub-sections, sentences, clauses, or phrases be declared
invalid.
Section 6
The Town Council hereby finds, determines and declares that
this ordinance is necessary and proper for the health, safety and
welfare of the Town of Vail and the inhabitants thereof.
INTRODUCED, READ ON FIRST READING, APPROVED AND ORDERED PUBLISHED
ONCE IN FULL THIS 20th DAY OF JANUARY, 1981, AND A PUBLIC HEARING
ON THIS ORDINANCE SHALL BE HELD AT THE REGULAR MEETING OF THE TOWN
COUNCIL OF THE TOWN OF VAIL, COLORADO ON THE 3rd DAY OF FEBRUARY
1981.
