ORDINANCE N0. 8 (Series of 1981) AN ORDINANCE AD4ENDING ORDINANCE NO. 26, SERIES OF 1980; PROVIDING FOR THE REMOVAL OF TIME SHARING FROM THE CONDITIONAL USE SECTION OF PUBLIC ACCOMMODATIONS, COMMERCIAL CORE I AND COMMERCIAL CORE II ZONE DISTRICTS; AND PROVIDING DETAILS IN RELATION THERETO. WHEREAS, the Public Accommodation District and Commercial Core I and Commercial Core II Districts presently have an essential balance between accommodations for visitors to the Town of Vail, Vail residents and seasonal employees, and WHEREAS, the Town Council is of the opinion that permitting the conversion and development of time-sharing projects in said zone districts would upset that balance, and WHEREAS, as the Town Council concludes that such an amendment is necessary to protect the health, safety and welfare of the inhabitants of the Town of Vail. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1 Section 2 of Ordinance No. 26, Series of 1980, is hereby repealed and reenacted as follows: Section 18.20.020 of the Vail Municipal Code is amended as follows (_a) Section 18.20.030 Conditional Uses - (HDMF) and a new subsection (b). (b) Time-share Estate Units, fractional fee units and time-share license units. • 4 !J Page ~ ~ Section a. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining poz~tions of this ordinance; and the Town Council hereby declares it Svould have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and prcper for the health, safety and welfare of the Town of tail and the inhabitants thereof . Section 4 The repeal ar the repeal and reenactment of any provision of the Vail },iunicipal Cade is provided in this ordinance shall not affect any rig}zt which has accrued, any duty imposed, any violations that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or vy ~-irtue of the provision repealed or x'epealed and reenacted.
