ORDINANCE N0. 11 7!; ~. tr:~~~*;;~e road (Series of 1981) ~~ail, colorac~o &1E~5~` c;Sfic~ of town cl..rk AN ORDINANCE CREATING A NEW ZONING DISTRICT TO BE KNOWN AS COMMERCIAL CORE III {CC3) DISTRICT; IMPOSING SAID DISTRICT ON A PORTION OF TIDE RECENTLY ANNEXED WEST VAIL AREA; AMENDING THE OFFICIAL ZONING MAP FOR THE TOWN; AND PROVIDING DETAILS THERETO. WHEREAS, the Town of Vail has recently annexed the area known as West Vail, County of Eagle, State of Colorado, effective on December 31, 1980; and WHEREAS, Chapter 18.68 of the Vail Monica-pal Code sets forth procedures to be followed for the imposition of zoning districts on newly annexed areas; and WHEREAS, Section 31-12-115 (2) C.R.S., 1.973, as amended, requires that the newly annexed West Vail area be brought under the Town of Vail zoning ordinance within ninety (90) days alter the effective date of the annexation, and WHEREAS, the Planning and Environmental Commission of the Town of Vail has considered said zoning and has recommended that it zs in the interest of the public health, safety and welfare that a new zone distract known as C~«u~~ercial Core III (CC3) be hereby created and imposed on a portion of the newly annexed area of West Vail, and WHEREAS, the Town Council considers that it is in the public health, safety and welfare to sa zone said property; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Title 18 Zoning of the Vail Municipal Code is amended by the addition of a Chapter 1$.27 entitled COMMERCIAL CORE III (CC3) DISTRICT to read as follows: 1.8.27.01.0 Permitted Uses The following uses shall be permitted in the Commercial Core III District: A. Professional offices, business offices, and studios; B. Banks and financial institutions; ~• C. ~~~. Retail stores and establishments without limit as to floor area including the Fallowing: Apparel Stores Art supply stores and galleries Auto parts stores Bakeries and confectioneries, including preparation of products For sale on the premises Bookstores Building materials stores without outdoor storage Camera stores and photographic studios Candy stores Chinaware and glassware stores Delicatessens and specialty Food stores Department and general merchandise stores Drug stores and pharmacies Florists Food stores Furniture stores GiFt stores Hardware stores ~iealth Food stores Hobby stores Household appliance stores Jewelry stores Leather goods stores Liquor stores Luggage stores Music and record stores Newsstands and tobacco stores Photographic studios Radio and television stores and repair shops Radio and television broadcasting studios Sporting goods stores Stationery stores Supermarkets Toy stores Variety stores Yardage and dry goads stores D. personal services and repair shops, including the Following: Barbershops Beauty shops Business and office services Cleaning and laundry pickup agencies without bulk cleaning or dyeing Coin-operated or self-service laundries Small appliance repair shops, excluding furniture repair Shop repair Tailors and dressmakers Travel and ticket agencies E. Eating and drinking establishments, including the Following: Cocktail lounges, taverns, and bars Coffee shops Fountains and sandwich shops Restaurants F. Additional offices, businesses, or services determined to '~e similar to permitted uses in accordance with the provisic.r~s of Section 18.27.010 of this chapter, 3.8.27.030 Conditional Uses The fallowing conditional uses shall be permitted in the Commercial Core IIl district, subject to issuance of a conditional use permit in accord with the provisions of Chapter 1.8.60: ~i _2_ ~~ ~ ,~ A. Drive-up facilities B. Multiple-family dwellings for employees of the Upper Eagle Valley as defined under the Primary/Secondary Residental done District, subsection 18.13.0$0(B)(3)(b) & (d). Upon approval of the Conditional Uses, the Planning and Environ- mental Commission or Town Council may impose conditions necessary to preserve the units for employees. C. Public utility and public service uses D. Public buildings, grounds, and facilities. E. Public park and recreation facilities F. Theaters, meeting rooms, and convention facilities G. Commercial laundry and cleaning services -- bulk plant H. Commercial recreation center/game roam I. Pet shops J. Any use permitted by Section 18.27.020 which is not conducted entirely within a buildzng K. Massage parlors L. Outside car wash 18.27.02 Accessory Uses The following accessory uses shall be permitted in the Commercial Core III district: A. Swimming pools, tennis courts, patios, ar other recreation facilities customarily incidental to conditional residential; B. Home occupations, subject to issuance of a home occupation permit in accordance with the provisions of Section 18.58.130 through 18,58.190. C. Other uses customarily incidental and accessory to permitted or conditional uses, and necessary far the operation thereof. 18.27.050 Lot Area and Site Dimensions The minimum lot or site area shall be twenty-five thousand square feet of buildable area, and each site shall have a minimum frontage of one hundred feet. 18.27.060 Setbacks In the Commercial Core III District, the setback shall be twenty feet on all exterior boundaries of the gone district. 18.27.070 Height For a flat roof ar mansard raaf, the height of buildings shall not exceed thirty--five feet. For a sloping roof, the height of buildings shall not exceed thirty-eight feet. 18.27.080 Density Control Not more than thirty square feet of gross residential floor area (GRFA) shall be permitted for each one hundred square feet of buildable site area. Total density shall riot exceed twelve dwelling units per acre of buildable site area. 1$,27.090 Coverage Not more than forty percent of the total site area shall be covered by buildings. 28.27.100 Landscaping and Site Development At least twenty-five percent of the total site shall be landscaped. The minimum width and length of any area qualifying as landscaping shall be fifteen feet with a minimum area not less than three hundred square feet. -3-- ~• ~ • • . 18.27.110 Parking and Loading Off-street parking and loading shall be provided in accordance with Chapter 2$..52. ~Vo parking or loading area shall be located in any required front setback area. 18.27.120 Location of Business Activity All permitted and conditional uses by 18.27.020 and 28.27.030 shall be operated and conducted entirely within a building, except for permitted loading areas and such activities as may be specifically authorized to be unenclosed by a conditional use permit. Section 2, Imposition of Zoning District on Certain Parcels and Portions of the newly annexed West Vail area. Pursuant to Chapter 18.68 of the Vaal Municipal Code, certain parcels and portions of the West Vail area annexed to the Town through the enactment of Ordinance No. d3, Series of 1980, of the Town of Vail, Colorado, effective on the thirty-first day of December, 1980, are hereby zoned Commercial Core III (CCITT) into zoning districts as set forth on the map attached hereto and incorporated herein by reference which amends and shall become an addition to the Official Zoning Map. Section 3. As provided in Section 18.08.030 of the Vail Municipal Code, the zoning administrator is hereby directed to promptly modify and amend the Official Zoning I~~ap to indicate the zoning specified herein. Section 4. Tf any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance, and the Town Council hereby declares it would have passed this ordinance, and each part, section, sub-section, sentence, clause or phrase hereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses o:r phrases be declared invalid. Section 5.
