OSO; AND ~, , :e:.,~ '~c,~vn ~tet'~ SECTION 3,36.090 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL; PROVIDING FOR THE ADDITION OF ZONE DISTRICTS WHICH HAVE BEEN FORMED SINCE THE ADOPTION OF THE RECREATION AMENITIES TAX ORDINANCE; REDUCING THE MAXIMUM ALLO~YABLE TAX CREDIT FROM 75 o TO 50°,o AND PROVIDING A REDUCED TAX RATE FOR RESIDENTIAL HOUSING PROJECTS WHICH ARE RESTRICTED TO E114PLOYEE HOUSING; TO BE EFFECTIVE AS OF JULY 1, 1.931. WHEREAS, the cost of providing recreational amenities has increased since the adoption of the recreational. amenities tax ordinance; and WHEREAS, new zone districts have been formed since the adoption of the recreational amenities tax ordinance; and WHEREAS, the criteria set forth in Section 3.36.080 were vague and sub,~ective and incapable of application; and GYHEREAS, the town wishes to promate the construction of employee hauszng projects by reducing the recreational amenities tax for such projects ; and WHEREAS, the Town Council has determined that such changes in the Recreational Amenities Tax Ordinance is necessary for the pro- tection of the inhabitants of the Town of Vail. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: 1. Section 3.36.010 Tax Rate of Assessment, of the Municipal Code of the Town of Vail is hereby repealed and reenacted as follows: 3.36.040 Tax Rate of Assessment For buildings constructed in the various Zoning districts of the Town, the tax on each building shall be assessed after the filing of an application far a building permit by th~~ building official or other designated town official in accordance with the following schedule. The rate schedule set forth in this section shall be reviewed annually by the Town Council and may be raised or lowered by Resolution of the Council after such review. 2. Section 3.3G.080 Tax Credit Additional ~s hereby repealed and reenacted as follows: 3.36.080 Tax Credit Additional Residential buildings or units which are restricted for use for employee housing shall be entitled to additional tax credits according to the following schedule: Years restricted Additional credit 7 -- 9 10% 10 - 15 20% 16 -- 20 30% 23. - 25 40% 25 + years 50% 3. Section 3.36.090 Tax Credit is hereby repealed and reenacted to read as follows: 3.36.090 Tax credit-Maximum rate. The maximum credit allowed under both Sections 3.36.070 and 3.36.080 shall not exceed fifty percent of the tax assessment. Section 4 This ordinance shall become effective July 1, 1981. - 2-- a- a • Section 5 If any part, section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decisions shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, sub-section, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, sub-sections, sentences, clauses or phrases be declared invalid. Section 6. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town. of Vail and the inhabitants thereof. Section 7 The repeal or the repeal and reenactment of any provisions of the Vaal Municipal Code as provided in this ordinance shah. not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commended, nor any other action or proceeding has commenced under or by virtue of the provisions repealed or repealed and reenacted. The repeal. of any provision hereby shall not revive any provision or any ordinance previously repealed ar superceded unless expressly stated herein.
