PURPOSE OF EMPLOYEE HOUSING SHALL BE TRANSFERRED
FROM THE PLANNING AND ENVIRONMENTAL COMMISSION TO
THE DESIGN REVIEW BOARD AND THE DEPARTMENT OF
COMMUNITY DEVELOPMENT; AND PROVIDING CERTAIN CRITERIA
WHICH MUST BE MET IN ORDER TO BE GRANTED SUCH A SECOND
UNIT; AND PROVIDING FOR THE ADDITIOPJS TO THE MUNICIPAL
CODE OF THE TOWN OF VAIL OF SECTIONS 18.12.091,
1$.12.092, 18.13.081 AND 18.13.082, SETTING FORTH
THE APPEAL PROCEDURE FROM A DECISION 0~' THE COMfiUiJITY
DEVELOPMENT DEPARTMENT TO THE PLANNING COMMISSION AfVD
FROM THE PLANNING COMMISSION TO THE TOIdN COUNCIL; AND
SETTING FORTH DETAILS THERETO.
WHEREAS, the Town Council of the Town of Vail believes that the
Design Review Board rather than the Planning and Environmental Commission
is the more appropriate body to review the design issues of a request for
an exception to density restrictions on lots of less than 15,000 square
feet; and
WHEREAS, the Town Council believes that the Department of Community
Development is the appropriate agency to take final action on such re-
quests and prepare the necessary agreements and restrictions far the
use as employee housing; and
WHEREAS, the Tawn Council believes that such changes to the
municipal code are necessary for the protection of the health and
safety of the inhabitants of the town.
NOW, THEREFORE, BE IT ORDAINED BY THE 70WN COUNCIL Ol; THE TOWN
OF VAIL, COLORADO, THAT:
1. Section 18.12.090 B and Sections 18.13.080 8 be hereby repealed
and reenacted so they both read as follows:
1$.12.090 B and 18.13.080 B. The Community Development Department
may grant an exception to the restrictions of this section relating to
lots of less than 15,000 square feet to a1lotiv the addition of a second
dwelling unit if the following criteria are met:

1. The second unit shall not exceed forty percent of the total GRFR
allowed on the lot; and
2. The Community Development Department sha11 find that the granting
of the exception vrill not be detrimental to the public welfare ar injurious
to other property in the area in which the subject property is situated;
and
3. That no variances for setbacks, height, parking, site coverage
or landscaping, site development or gross residential floor area would
be approved unless the granting of such a variance benefits the visual
appearance of the site and surrounding area; and
4. That fifty percent of the required parking must be enclosed, and
5. The architectural design of the structure and the materials and
colors must be visually harmonious with their sites and with surrounding
sites and structures, and must not unnecessarily block scenic views from
existing buildings; and
6. Access to the secondary unit must not adversely affect the
privacy of adjacent structures; and
7. The applicant must demonstrate that the site has the ability to
double its capacity for handling trash and outdoor storage, and
$. Rn application for the second unit, containing the following
information, must be submitted to the Community Development Department
for their review:
a. dame of applicant and address
b. Name of applicant`s representative. (if any)
c. Authorization of property owner
d. Location of the property far which the proposal is made
e. A fee of $100.00 plus an amount equal to the then current
first-class postage rate for each property owner to be
notified hereunder
f. A list of the names of the owners of all property adjacent
to the subject property and their addresses for the
purpose of notification;and
9. The proposed plan and all required materials must be submitted
to the Design Review Board at their regularly scheduled meeting for their
review and ap proval; and
10. The applicant sha11 agree in writing:
a. That the secondary dwelling unit shall not be sold, trans-
ferred ar con veyed separately from the primary unit for a period of not

mare than twenty (207 yearslfram the date that the Certificate of
Occupancy is issued for said second unit; and
b. That the secondary dwelling unit shall not be leased ar
rented for any period of less than thirty (30) consecutive days, and
that if it shall be rented it shall be rented ^nly to tenants who are
full time employees in the Upper Eagle Valley. The "Upper Eagle Valley"
shall be deemed to include the Gore Valley, Minturn, Red Cliff, Gilman,
Eagle-Vail, and Avan and their surrounding areas. A "full-time employee"
is a person who works an average of thirty (30} hours per week; and
c. That the secondary dwelling unit shall not be divided into
any form of timeshares, interval ownership or fractional fee; and
d. That a declaration of covenants and restrictions shall be
filed of record in the Office of the Eagle County Clerk and Recorder in
a farm approved by the Sown Attorney for the benefit of the Town to insure
that the restrictions herein shall run with the land.
2. There is hereby added to Chapters 18.12 and 18.1,3 of the
Municipal Code of the Town of Vail Sections 18.12.090 and 18.13.081
to read as follows:
A. 18.12.090 and 18.13.081 appeal to Planning Commission.
An appeal to the Planning Commission frpm a decision of the Community
Development Department may be made by the applicant, adjacent property
owner, or the Town Manager. The Planning Commission can also call up
Such decisions by a majority vote of those commission members present.
B. For all appeals, the appeal must be filed in writing within
ten (10} days following the decision or the decision must be called up
by the Planning Commission at their next regularly scheduled meeting.

day extension if the Commission finds that there is insufficient

D. The decision of the Community Development Department shall become
final after the time far such an appeal or call up is exhausted without
any formal appeal.
3. There is hereby added to Chapters 18.12 and 18.13 Sections
18.12.092 and 18.13.082 to read as follows:
A.18.12.092 and 18.13.082 Appeal to Town Council.
An appeal to the Town Council from a decision by the Planning Commission
magi be made by the applicant, adjacent property owner, or by the Town

Manager. Town Council can also call up a decision of the Planning
Commission by a majority vote of those Council members present.
B. For ail appeals, the appeal must be filed in writing within
ten (10) days following the decision or must be called up by the Town
Council at their next regularly scheduled meeting.
C. The Town Council shall hear the appeal within thirty (30) days
of its being f?led or called up with a passible thirty day extension
if the Council finds that there is insufficient information.
Section 4. If any part, section, sub-section, sentence, clause
ar phrase of this ordinance is for any reason held to be invalid, such
decision shall not affect the validity of the remaining portions of this
ordinance; and the Town Council hereby declares it would have passed this
ordinance, and each part, section, subsection, sentence, clause or phrase
thereof, regardless of the fact that any one or more parts, sections, sub-
sections, sentences, clauses, or phrases be declared invalid.
Section 5. The Town Council hereby finds, determines, and declares
that this ordinance is necessary and proper for the health, safety and
welfare of the Tawn of Vail and the inhabitants thereof.
Section 6. The repeal or the repeal and reenactment of any provision
of the Vail f~lunicipal Code as provided in this ordinance shall not affect
any right which is accrued, any duty imposed, any violation that occurred
prior to the effective date hereof, any prosecution commenced, nor any
other action or proceeding that has commenced under or by virture of
the provisiions repealed or repealed and reenacted. The repeal of any
provision hereby shall not revive any provision oi: any ordinance previously
repealed or superceded unless expressly stated herein.
