WHEREAS, the Towvn Council has determined that an allocation of up to ~0% of the total allowable gross residential floor area to the secondary unit for primary/secondary dwelling units will do as much to prevent mirror image duplexes as the previous maximum of one- third of the total gross residential floor area for the secondary unit has; and • WHEREAS, the Town Council believes that the increase in the allocation of floor area to the secondary unit will allow for more architectural flexibility in the secondary units and will result in more space allocated for the secondary units. PLOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: 1. Section 18.12.090 B No. 1 of the Town of Vail is hereby repealed and reenacted as follows: 18.12.090 B 1. The second unit shall not exceed 40% of the total GRFA allowed on the lot ar~d shall not be substantially similar in design to the primary unit. 2. Section 18.13.080 B No. 1 is hereby repealed and reenacted as follows: 18.13.080 B 1. Second unit shall not exceed 40% of the total GRFA allowed on the lot and shall not be substantially similar in design to the primary unit. 3. Section 18.69.050 J is hereby repealed and reenacted as followvs: .. • ~ • ~~ Y ~ '- Section 18.69.050 J. Density as permitted by Section 18.12.090 is amended as it pertains to this chapter as follows: Nat more than two dwelling units in a single structure shall be permitted on each site in conformance with the provisions on this section. A total of not more than 25 square feet of residential floor area (GRFA) shall be permitted far each 100 square feet for the first 15,000 square feet of site area, plus not more than 10 square feet of grass residential floor area shall be permitted for each 100 square feet of site area over 15,000 square feet, not to exceed 30,000 square feet of site area, plus not mare than 5 square feet of gross residential floor area for each 100 square feet of site area in excess of 30,000 square feet. On any site containing two dwelling units, one of the units sha11 not exceed 40 percent of the allowable total gross residential floor area (GRFA) and shall not be substantially similar in design to the primary unit. Section 4. Sf any part, section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ardinance; and the Town Council hereby declares it would have passed this ardinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, sub- sections, sentences, clauses, or phrases be declared invalid. Section 5. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 6 The repeal or the repeal and reenactment of any provision of the Vail Nlunicipa7 Cade as provided in this ordinance shall not affect any right which is accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any any other action or proceeding that has commenced under or by virtue of the provisions repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision of any ordinance previously repealed ar superceded unless expressly stated herein.
