WHEREAS, Special Development District 7 was approved by the Town of Vail to insure a unified and coordinated development and use of a critical site as a whole and in a manner suitable for the area in which it is situated. WHEREAS, the Town Council approved special "SD7" and considered it as reasonable, appropriate and beneficial to the Town and its citizens, inhabitants and visitors. NOW, THEREFORiw, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS: Section 1. Section 11 of Ordinance No. 7, Series of 1977, is repealed and reenacted as follows: Section 11. Limitation of Fireplaces. Fireplaces shall not be permitted in individual accommodation units. Fireplaces shall be permitted in eight dwelling units with no more than two additional fireplaces shall be in the Special Development District, to 6e located in a public area. Section 2. If any part, section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, sub-sections, sentences, clauses or phrases be declared invalid. Section 3. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. ~' ti .. t .. r ~~ Section 4. The repeal or the repeal and reenactment of any provision of the Vail ~~lunicipal Code as provided in this ordinance sha11 not affect any right which is accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding that has commenced under or by virtue of the provisions repealed or repealed and reenacted. The repeal of any provision hereby sha11 not revive any provision of any ordinance previously repealed or superceded unless expressly stated herein.
