Frar3i,r~r:, r~a<d PLAN THEREFORE IN ACCORDANCE WITH CHAPTER 18.40 vuil,coioracio ;;.~S~F THE VAIL MUNICIPAL CODE. ofifice of tourn cl4rk WHEREAS, Chapter 18.40 of the Vail Municipal Code authorizes special development districts within the Town; WHEREAS, I.K.S. - Vail Associates submitted an application for special development district approval for a certain parcel of property within the Town known as Lots 26 through 42, inclusive, Highland Meadows, Filing No. 1, to be known as SDD 11. WHEREAS, the establishment of the requested 5DD 11 will ensure unified and coordinated development and use of the site as a whole and in a manner suitable for the area in which it is situated; WHEREAS, the Town Council considers that it is reasonable, appropriate and beneficial to the Tawn and its citizens, inhabitants and visitors to establish said SDD 11; NOW, THEREFOR, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, A5 FOLLOWS: Section 1. Amendment Procedures Fu1fi11ed, Planning Commission Report. The approval procedures prescribed in Chapter 18.40 of the Vail Municipal Code have been fulfilled, and the Town Council has received the report of the Planning Commission recommending approval of the Development Plan for SDD 11. Section 2. Special Development District 11 Established. Special Development District 11 (SDD11) and the Development Plan therefore, are hereby approved for the development of Lots 26 through 42, inclusive, Highland f~eadows, filing No. 1, within the Town of Vail, consisting of approximately 13 acres. .. ~ . . . :~ e f Section 3 Development Plan A. The Development Plan for SDD11 is approved and shall constitute the plan for development ~rithin the Special District. The Development Plan consists of the fol 1 o~ri ng documents a. Site Plan dated 4/27/81 b. Preliminary Grading and Drainage Plan dated 4/27/81 c, Schematic Landscape Plan dated 4/27/81 d. Typical A Unit Floor Plans e. The Development Plan for SDD11 sha11 consist of three phases, developing the entire property as a residential community containing 17 two-family structures, attached and detached parking structures, a common recreational facility and appurtenant structures. C. Phase one shall be comprised of Lots 32, 38, 3D, 40, 41 and 42. D. Prior to commencement of construction of any phase, the streets, drainage and other easements, and other required public areas shall be platted. E. Upon completion of each phase of development, the parcels of property included in such phase shall be resubdivided under the title "Highland Park Filing No. ~, Amended Plat, a resubdivision of Lots ~, ~, ~, ~, _, ~, and ~, Highland P~eadows filing No.l." ~: ~ • • The Plat for the resubdivision sha11 include the dimensions of each lot to be deeded to individual lot purchasers, the common area by a lot designation, streets, drainage and other easements, and other required public areas and a statement of dedication thereof. F. The developer will have substantial discretion in defining the area to be deeded individual owners so that to the extent feasible a rectangular area wiT1 be deeded. Pack lot owner wi11 be granted title to the ground beneath his dwelling unit and garage and the remainder of the ground will be deeded to a homeowners association. Protective covenants will be filed to govern the relationship between lot owners and the Owners association. Section 4. Development Procedure. A. Prior to commencement of construction of any improvements with respect to any phase of development, other than the installation of utility pipes and lines, the following shall occur: 1. The improvements shall have received the approval of the Design Review Board ("DRB") and the plans approved by the FRB sha11 be part of the Development Plan. 2. Pay the appropriate recreation amenities fee. 3. Building permits for the proposal improvements shall have been obtained. B, Amendments to the Development Plan shall be in accordance with in Subsection 18.40.040 (D). 0. The applicant must begin construction of the special development district within eighteen months from the effective date of this Ordinance, and continue diligently toward the completion of the project. rf the special development district is to be developed in stages, the applicant must begin construction of each stage within eighteen months of the completion of the previous stage. If the applicant does not begin and diligently work toward the completion of the special development district or any stage of the special development district within the time limits imposed herein, the planning and environmental commission sha11 review the special development district. They shall recommend to the town council that either the approval of the special development district be extended, that the approval of the special development district be revoked, or that the special development district be amended. _3W ~ • .s Section 5. Permitted Uses. A. The following uses shall be permitted in SDD11 district: i. Single-family residential dwellings; ii. Two-family residential dwellings B. The following conditional uses shall be permitted in the district, subject to issuance of a conditional use permit: i. Public utility and public service uses; ii. Public buildings, grounds, and facilities; iii. Public or private schools; iv. Public park and recreation facilities; v. Ski lifts and tows. C. The following accessory uses shall be permitted in the district: i. Private greenhouses, toolsheds, playhouses, garages or carports, swimming pools, patios, or recreation facilities customarily incidential to a single-family and two-family residential uses; ii. Home occupations, subject to issuance of a home occupation permit in accordance with the provisions of Sections 18.58.130 through 18.58.190. iii. Other uses customarily incidental and accessory to permitted or conditional uses, and necessary for the operation thereof. Section b. Development Standards, A. Lot area and site dimensions. Each lot shall contain a residential dwelling unit and appurtenant garage in such configuration as is described in Sections 4 and 5. B. Setbacks. There shall be no front, rear or side setbacks. C. Height., No building shall exceed 39.5 feet in height. D. Density. The combined Gross Residential Floor Rrea of all dwelling units within the district shall not exceed 77,000 square feet. The maximum number of dwelling units allowed is 34. E. Site Coverage. The site area to be covered by buildings shall be as shown on the Development Plan. F'. parking. Each Unit shall have one two-car garage. -4- ;~ ~ • G. Recreational facilities. Recreational facilities shall consist of one community building as shown on the Development Plan, ice skating rink and appurtenant facilities. A fireplace and fire pit shall be permitted. H. Roads and Utilities. All roads, cul de sacs, utility lines and pipes shall be constructed to the minimum standards required of public dedicated roads and utilities, respectively, within the Town of Vail. The certificate of occupancy with respect to the units within any phase of development shall 6e issued upon satisfaction of all requirements imposed by the Town of Vail Codes applicable thereto and completion of that portion of the dedicated roads from the intersection of Vermont Court and Vermont Road to the driveway farthest distant therefrom within such development phase. Building permits in respect of the lots shall be issued prior to completion of roads. Section 7. Environmental Report. The environmental Report dated April 24, 1981 is approved. Section 8. Upon the completion of the duplex units in any development phase in accordance with the Development Plan and Development Standards, a certificate of occupancy (conditional or final as appropriate) with respect to each completed unit shall be issued by the Town of Vail, provided that the conditions under Section 9, paragraph h, relating to roads and utilities are satisfied. Section 9. Severability. If any provision of this Chapter or of any rule or regulation promulgated hereunder or its application to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the Chapter or of the rules and regulations promulgated thereunder. The Council hereby declares that in these regards the provisions of this article and of rules and regulations promulgated thereunder are severable.
