WHEREAS, the Town Council believes it will be for the benefit of the health, safety and welfare of the inhabitants of the Town of Vail that owners of impounded vehicles be reunited to pay all charges related to such impoundment and that the wording on signs prohibiting parking on private property be hereby simplified. BE IT T~IEREFORE ORDAINED QY THE TOWN COllNCIL OF THE TOL1N OF VAIL, COLORADO, THAT: 1. Section 10.08.030 Impoundment-Authorized is hereby repealed and reenacted as follows: 10.D8.D3D. Impoundment-Authorized. Ydhenever any pOliCe officer finds a vehicle, attended or unattended, standing upon any portion of a street or upon any place within this municipality in such a manner as to constitute a violation of any section of this chapter, or left unattended for a period of 24 hours or more and presumed to be abandoned under the conditions prescribed by 42-4-1102 CRS, 1973, as amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in storage in the nearest garage or other place of safety designated or maintained by this municipality, and the charges for towing and storage of such vehicle sha71 be charged to the owner of the vehicle in addition to a ten dollar ($IO.DD) impoundment charcle. 2. Sectin I0.12.030 Posting Signs is hereby repealed and reenacted as fo17ows: 1Q. 12.D3D. Posting Signs. Any owner, tenant or person in possession or control of a private parking lot or of private property wishincl to avail himself of the ~' {~ provisions afi this chapter shall post at each and every entrance to a private parking lot or private property a sie~n containinri essentially the following words; "Private parking. Unauthorized vehicles wi11 be towed by the Police Department." All signs must be approved by the Chief of Police who shall have the authority to determine size, shape and Tattering of the signs. Section 2. If any part, section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not aff=ect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passes this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, reelardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 4. The repeal or the repeal and reenactment of any provision of the Uail Municipal Code as provided in this ordinance shall not affect any right which is accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any proseGUt~on commenced, nor any other action or proceeding that has commenced under or by virtue of the provisions repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision of any ordinance previously repealed ar superceded unless expressly stated herein.
