HomeMy WebLinkAbout1981-30 Rezoning a Parcel of Property Described as Lot G-1, Lions Ridge Filing No. 2, From Residential Cluster to Primary/Secondary Residential • • ORDINANCE N0. 30 ^ (Series of 1981} ~~~ ~ ~~3~ ~.~~ 75 s. f~onta;fa ro;~d AN ORDINANCE REZONING A PARCEL OF PROPERTY va;!.co!arado ~i1u51 DESCRIBED A5 LOT G-1, LION`S RIDGE FILING ~~~;-,-, c:3t ~0~+,lr~ c!~,~k NO. 2, FROM RESIDENTIAL CLUSTER { RC} TO PRIMARY/SECONDARY RESIDENTIAL {PSR); AND SETTING FORTH THE DETAILS RELATED THERETO. 4JHEREAS, in accordance with Section 18.b6.11O of the Vail Municipal Code, a rezoning has been requested by Doyle Hopkins to rezone Lot G-1, Lion's Ridge Filing No. 2 from Residential Cluster (RC) to Primary/Secondary Residential {PSR); and WHEREAS, the Planning and Environmental Commission has considered and discussed the same, however, did not make a recommendation far either denial or approval of said rezoning to the Town Council; NOW, THEREFORE, 8E IT ORDAINED BY THE TOWN COUNCIL OF T~€E TOWN OF VAIL, THAT: {1) The Council specifically finds that the procedures for the amendment of the Official Zoning Map and rezoning of properties within the Town of Vail as prescribed in Section 18.66.110 of the Vail Priunicipa1 Cade have been fulfilled, and the Council hereby receives the report of the Planning and Environmental Commission making no recommendation as to the approval or denial of the rezoning of the subject property. The staff recommendations recommended imposition of the following conditions: a. All reasonable efforts shall be made by the Town of Vail and by the applicant to obtain access to the Tot from the top {via Cliffside Subdivision). b. If the access from the top cannot be obtained, the applicant shall construct an "underground" {built into the existing bank} garage structure built entirely within the property lines of Lot G-1. c. That the applicant agrees to restrict the secondary unit to the employee housing restrictions as found under Ordinance #22, Series of 1981. I r ~ ~ 1 d. That the applicant agrees to construct the house away from the ridge line so that views from The Ridge at Vail units are not unnecessarily blocked. {2) Pursuant to Section 18.66.160 of the Vail hlunicipai Code, Lat G-1, Lion's Ridge Filing No. 2 is rezoned from Residental Cluster {RC) to Primary/Secondary Residential (PSR) with the conditions specified in (1} above. {3} As provided in Section 18.08.030 of the Uai1 Punicipal Code, the Zoning Administrator is hereby directed to promptly modify and amend the Official Zoning Map to indicate the rezoning specified in paragraph {2} above and the conditions herein imposed. (4} If any part, section, subsection, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares that it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase hereof regardless, of the fact that any one or more parts,. sections, subsections, sentences, clauses or phrases be declared invalid. (5} The Town Council hereby finds that this ordinance is necessary for the protection of the public health., safety and we]fare. INTRODUCED, READ ON FIRST RERDTNG, APPROVED AND ORDERED PUBLISHED ONCE IN FULL, this 4th day of August, 1981, and a public hearing on this ordinance shall be held at the regular meeting of the Town Council of the Town of ,Vail, Colorado, bn the 18th day of August, 1981, at 7:30 p.m., in the Municipal Building of the Town.
