AN ORDINANCE OF THE TOWN COUNCIL AMENDING
THE VAIL MUNICIPAL CODE BY THE ADDITION OF
A NEW SECTION 10.08.050 WHICH PROHIBITS THE
OVERNIGHT PARKING OF MOTOR VEHICLES EXCEEDING
18,000 POUNDS EMPTY WEIGHT, IN THE PA, SFR, R,
PRIMARY/SECONDARY, RC, LDMF, MDMF, HGMF, A, AND
GNOS ZONING DISTRICTS; PROVIDING THAT THE TOWN
OF VAIL TRAFFIC ENGINEER MAY DESIGNATE AREAS
FOR PARKING OF OVERWEIGHT VEHICLES; AND, SETTING
FORTH DETAILS RELATING THERETO.
WHEREAS, the parking of large motor vehicles in residential
areas is detrimental to the residential character of those neigh-
borhoods, and
WHEREAS, the parking of large vehicles in residential areas
presents a safety hazard and environmental degradation within
residential areas; and
WHEREAS, the Town provides areas that have been set aside
for the parking of large motor vehicles, thereby relieving the
need to park said vehicles in residential areas; and
WHEREAS, the Town Council is of the opinion that thiis ordinance
is necessary for the protection of the public health, safety and
we if are .
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF VAIL, COLORADO, THAT:
Section 1. The Vail 1~Iunicipal Code is amended by the addition
of a new section 10.08.050 "Overnight Parking of Certain Motor Vehicles
Prohibited in Residential Areas" to read as follows:
10.08.050 Overnight Parking of Certain Motor Vehicles Prohibited
in Residential Areas.
(a) No person shall park or permit to be parked any vehicle with an
empty weight of 18,000 pounds or more on any public or private
property located in any district within the Town zoned public
accommodation, single family residential, residential, primary/
secondary residential, residential cluster, low density medium
family, medium density medium family, high density medium family,
agricultural, and green belt and open space, for a period of time
longer than one (1) hour between the hours of 8:00 p.m, and 7:00 a.m.
(b) The traffic engineer of the Town of Vail shall, upon the basis
of a traffic investigation or survey, or upon the basis of appropriate
design standards, project traffic volumes, impact upon adjacent resid-
ential units, and the appropriateness of the location, designate
special parking zones for vehicles exceeding 18,000 pounds empty
weight within the zone district specified in (a) above.

Section 2. The Town Council hereby finds, determines and declares
that this ordinance is necessary and proper for the health, safety and
welfare of the Town of Vail and the inhabitants thereof.
Section 3. If any part, section, subsection, sentence, clause
or phrase of this ordinance is for any reason held to be invalid, such
decision shall not effect the validity of the remaining portions of this
ordinance; and the Town Council hereby declares it would have passed this
ordinance, and each part, section, subsection, sentence, clause or phrase
thereof, regardless of the fact that any one or more parts, sections, sub-
sections, sentences, clauses or phrases be declared invalid.
INTRODUCED, READ AND PASSED ON FIRST READING this day of
1982, and a public hearing shall be held on this ordinance
on the day of 1982, in the Council Chambers of the
Vail Municipal Building.
