HomeMy WebLinkAbout1982- 9 Rezoning a Part of Lot 2, Block 5, Vail Intermountain Subdivision from Residential Cluster to Low Density Multiple Family District~~ ORDINANCE #~ (SERIES OF 1982) AN ORDINANCE REZONING A PART OF LOT 2, BLOCK 5, VAIL INTERMOUNTAIN SUBDIVISION FROM RESIDENTIAL CLUSTER TO LOW DENSITY MULTIPLE FAMILY DISTRICT WHEREAS, in the official zoning map of the Town of Vail, Colorado, the subject property is currently zoned as residential cluster; and WHEREAS, in accordance with Section 18.66.110 of the Vail Municipal Code, Dick Torrisi;=the applicant, has initiated a rezoning of the subject property requesting that the property be rezoned from residential cluster to low density multiple family district having certain specified conditions, and WHEREAS, the Town Council considers that it is reasonable, appropriate, and beneficial to the Town and the citizens, inhabitants and visitors to rezone said property; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS: Section 1, Planning Commission Report. The approval procedures presumed in Section 18.66.110 of the Vail Municipal Code have been fulfilled and the Town Council has received a report of the Planning and Environmental Commission recommending denial of the rezoning. Section 2. As provided in Section 18.08.030 of the Vail Municipal Code, the Zoning Adminis- trator is hereby directed to promptly modify and amend the Official Zoning Map to indicate the rezoning adopted here. Section 3. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the rema~i.ning portions of this ordinance, and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, serr,tence, Clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. ~~ ~ s Section 4. The Council hereby states that this ordinance is necessary for the protection of the public health, safety and welfare. INTRODUCED,.
