HomeMy WebLinkAbout1982-20 Prohibiting the Owner or Keeper of a Dog from Permitting His Dog to Run at Large in Packs of Three or More Dogs Providing Minimum Penalties for Violation• t i ORDINANCE N0. 20 Series of 1982 AN ORDINANCE PROHIBITING THE OWNER OR KEEPER OF A DOG FROM PERMITTING HIS DOG TO RUN AT LARGE IN PACKS OF THREE OR MORE DOGS PROVIDING MINIMUM PENALTIES FOR VIOLATION; RAISING THE LICENSE AND DOG TAG FEE FOR DOGS WITHIN THE TOWN; PROHIBITING THE OWNER OR KEEPER OF A DOG FROM ALLOWING HIS DOG TO BE WITHIN 100 FEET OF ANY ATHLETIC FIELD WHILE ANY ATHLETIC EVENT IS IN PROGRESS; MAKING A DOG KENNEL A CONDITIONAL USE WITHIN SPECIFIED ZONE DISTRICTS WITHIN THE TOWN AND PROVIDING DETAILS IN RELATION THERETO. WHEREAS, dogs running at large and forming packs is a serious problem to the health, safety and welfare of the inhabitants of the Town of Vail; and WHEREAS, the license fees for dogs within the Town of Vail are unrealistically low; and WHEREAS, dogs running at large and being permitted in and around athletic fields while athletic events are in progress have become a hazard to participants in said athletic events and to spectators thereof; and WHEREAS, the Town wishes to regulate dog kennels with the Town be designating them as a conditional use in certain zone districts. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1 Section 6.04.202 - Running in Packs - is hereby adopted to read as .f ollows A. It is unlawful for the owner or keeper of a dog to permit his dog to run at large in packs of 3 or more dogs, anywhere within the Town. B. Running at large as used in this section shall be deemed to mean the dog is not accompanied by, within the sight of and under the reasonable control of its owner, keeper or other reasonable person. Section II. Section 6.04.080 is hereby repealed and re-enacted to read as follows: 6.04.080, License and Tag Fees A. The regular fee for both the license and tag shall be $5.00 for a neutered male dog or spayed female dog and $10.00 for an un-neutered male dog or unspayed female dog. B. The late registration fee is twice the amount of the regular fee. : ~ • ~ -2- Section III. Section 6.04.201 - Athletic Fields - Dogs Prohibited is hereby adopted to read as follows: 6.04.201 - Athletic Fields - Dogs Prohibited It is unlawful for the owner or keeper of a dog to allow his dog to be on or within 100 feet of any athletic field within the Town while any athletic event or activity is in progress, except that a dog may be within 100 feet of an athletic field while any athletic event or activity is in progress, if the dog is on a public road or right-of- way. Section IV. Section 6.04.340, violation penalty, is hereby repealed and re-enacted to read as follows: A. A dog owner found violating any provision of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished for such offense by imprisonment of not more than 90 days or by a fine of not more than $.499.99 or by both such imprisonment and fine. B. Every person convicted of a violation of Section 6.04.190, 6.04.200 (A), 6.04.201 and 6.04.300 shall have a minimum fine, part of which can be suspended, imposed against him according to the following conviction: First Conviction - $25.00 Second Conviction - $50.00 Third and each subsequent Conviction - $75.00 C. Every person convicted of a violation of Section 6.04.202, Running in Packs, shall have a minimum fine, part of which can be suspended, imposed against him according to the following schedule: First Conviction - $50.00 Second Conviction - $75.00 Third and each subsequent Conviction - $150.00 D. In applying the above minimum fine schedules, the Municipal Court shall consider the following: 1. The fines designated in this section are minimum fines and the Court may impose a greater amount up to and including the maximum provided and allowed by this ordinance. 2. The date when the actual violation occurred will control regardless of the date of the conviction. 3. The record of the violator for two years prior to the date of the current violation shall be considered. ~ • • • -3- Section V. Sections 18.10.030, 18.12.030, 18.14.030, 18.16.030, 18.18.030, 18.20.030, 18.24.040 (B), 18.24.050 (B), 18.27.030, 18.28.040, and 18.30.030 are hereby amended by the addition of the following conditional use to read as follows: "dog kennel". Section VI. Severability. If any paragraph, sentence, word, clause or other provision or the application thereof is for any reason held to be unconsti- tutional or otherwise invalid, such decision shall not affect the validity of the remaining paragraphs, sentences, words, clauses or other provisions of this ordinance, it being the legislative intent that this ordinance shall stand notwithstanding any such invalidity. Section VII. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
