"~.~;w ORDINANCE #21 (Series of 1982) AN ORDINANCE AMENDING THE UNIFORM BUILDING CODE, 1982 EDITION; SETTING FORTH STANDARDS FOR THE CONSTRUCTION AND REPAIR OF ROOFS IN THE TOWN OF VAIL; PROVIDING THAT SAID CODE AND AMENDMENTS BE AVAILABLE FOR INSPECTION AT THE OFFICE OF THE TOWN CLERK OF THE TOWN OF VAIL; AND DESIGNATING A PUBLIC HEARING THEREON; AND SETTING FORTH DETAILS IN RELATION TO THE FOREGOING. WHEREAS, the Charter of the Town of Vail and the Statutes of the State of Colorado provide that standard codes may be adopted with amendments; and WHEREAS, the Town of Vail has adopted the 1982 edition of the Uniform Building Code with amendments; and WHEREAS, the Vail Fire Protection District has conducted an intensive investigation as to the potential of a conflagration in the Town of Vail; and WHEREAS, the results of the conflagration study have been published and show that combustible roof construction would be susceptible to and contribute to a conflagration; and WHEREAS, most of the roof construction in the Town of Vail and the surrounding area is of combustible construction; and WHEREAS, other factors contributing to a conflagration have been shown to be narrow streets and consistent winds, which are common to the Vail area, and to which no possible solution exists; and WHEREAS, the insurance rates are established according to the grading schedule as determined by the Insurance Services Office; and WHEREAS, the Insurance Services Office has determined that combustible roof construction, narrow streets, and consistent winds affect higher insurance rates and has endorsed the adoption of and enforcement of this ordinance; and WHEREAS, the economics of roof construction and maintenance thereof are favorable to the taxpayer by passage and enforcement of this ordinance; and • ~ ~ -2- WHEREAS, the United States Forest Service has measured the wind direction and velocity, the fuel moisture, the relative humidity, the climate factors and the fire danger for the Holy Cross District and determined that the adjacent forest poses a threat to the fire safety of the Town of Vail during certain times of the year and during certain conditions, and that the danger of a conflagration poses a threat to the forest lands; and WHEREAS, the United States Forest Service endorses the adoption of this ordinance; and WHEREAS, due to the difficulty in fighting and containing the spread of roof fires; WHEREAS, certain types of combustible roof construction has been banned in other cities and states due to the proven hazards of com- bustible roof construction; and WHEREAS, these factors and others, when taken as a whole, pose a very real threat to the safety of persons and property in the Town of Vail; and WHEREAS, the Town Council of the Town of Vail is of the opinion that the public health, safety and welfare would be better served by the adoption of this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL THAT: Section 1. The following amendments are made to the 1982 edition of the Uniform Building Code, as adopted by the Town of Vail: A. Section 1704 shall be changed to read; Roof s Sec. 1704. Roof systems for all buildings and structures shall conform to Tables 17B.1,17C, and 17 D. Skylights shall be constructed as required in Chapter 34. Penthouses shall be constructed as required in Chapter 36. For the use of plastics in roofs, see Chapter 52. For Attics: Access and Area, see Section 3204. For Roof Drainage, see Section 3207. • • • -3- B. Chapter 17 shall be amended to include Tables 17 B. 1,17 C and 17 D, which are attached hereto. The highest required assembly according to zone, type of construction or usage will be used. Class B assemblies may be used when a Class C minimum rating is required. Class A assemblies may be used when Class C assemblies are required. See Uniform Building Code Standard 32-7, and Chapter 32 of this Code. ,. . '. . • • -4- C. Section 3203 (C) shall be amended to read; Quality of Materials. The quality and design of roofing materials shall conform to the applicable standards listed in Chapter 60, allowing for new methods of construction, new designs and new materials which have been tested and approved by a recognized authority. The Building Official, may at his discretion, require proof of such test and results. D. Section 3203. (b) shall be amended to include: Class A roof coverings are effective against severe fire exposures. Under such exposures, roof coverings of this class are not readily flammable, afford a fairly high degree of fire protection to the roof deck, do not slip from position and pose no flying brand hazard. Class A roof coverings and assemblies shall comply with U.B.C. Standard Sec. 32.701A of the 1982 edition of the Uniform Building Code Standards. CLASS B ROOF coverings are effective against moderate fire exposures. Under such exposures, roof coverings of this class are not readily flammable, afford a moderate degree of fire protection to the roof deck and pose no flying brand hazard. Class B roof coverings and assemblies shall be in compliance with U.B.C. Standard 32.701A of the 1982 edition of the U.B.C. Standards. CLASS C ROOF coverings are effective against light fire exposures. Under such exposures, roof coverings of this class afford a measurable degree of fire protection to the roof deck, are not readily flammable, do not slip from position and pose no flying brand hazard. Class C roof coverings and assemblies shall conform to U.B.C. Standard 32-701A of the 1982 edition of the U.B.C. Standards. ,y ' • • • -5- E. Section 3203.(E) 1. General.; shall be amended to read: Application of roof materials listed in Table No. 32-B shall be in accordance with the provisions thereof. All roof systems shall be either Class A, B, or C and shall be installed in accordance with Tables li`'~B.1,17 C, and 17 D. All roof systems shall be approved and listed by an approved agency and shall be installed in accordance with the manufacturer's recommendations. Where there is an apparent conflict in standards in this Chapter, the more strict standard shall apply. Section 3203.E2. New Construction. Definition: Class A Roof System: Fire retardant decking Fire retardant moisture proofing Fire retardant covering Remodel Construction: Same as new with the exception of decking, unless entire roof is structurally redone. Then decking must be included. F. Chapter 32 shall be amended to include: Section 3209. Re-Roofing. All re-roofing shall comply with the standards of this Code. EXCEPTION: Repairs and maintenance done to a roof, totaling less than 10% of the square footage, in one calendar year, or less than 25% in a 3 year period may, at the discretion of the Building Official, be exempt from complying with requirements other than those in effect at the time of the original installa- tion. Section 2. Three copies of the amendments proposed by this Ordinance shall be available for inspection at the Office of the Town Clerk of the Town of Vail, Colorado. ;. , . ~ ;, -6- Section 3. If any part, section, subsection, sentence, clause or phrase of this Ordinance or of the Uniform Building Code, 1982 edition, is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance or of the Uniform Building Code, 1982 edition; and the Council hereby declares it would have passed this ordinance and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 4. There shall be a public hearing for the consideration of the adoption of this ordinance on the ~ day of /DC~~,/~., 1982, at 7:30 p.m. in the Town Council Chambers, Municipal Building, Vail, Colorado. The Town Clerk shall have notice of '.that public hearing published in The Vail Trailon two occasions, the first not less than (15) fifteen days prior to the public hearing and the second not less than (8) eight days prior to the public hearing. Section 5. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
