AN ORDINANCE REPEALING SECTION 18.04.110,
TO PROVIDE FOR A NEW DEFINITION OF FAMILIES;
ADOPTING SECTION 18.58.55 PROVIDING A DEFINITION
FOR SHORT-TERM RENTAL; ADOPTING SECTION 18.58.310
PROHIBITING THE RENTAL OF ACCOMMODATION UNITS IN
SINGLE AND TWO-FAMILY DWELLINGS.
WHEREAS, the Town Council has determined that the current
definition of family unrealistically limits the number of unrelated
people who may live together in a dwelling unit used as a single
housekeeping unit; and
WHEREAS, the lower density neighborhoods within the Town of
Vail need to be protected from the noise, traffic and overcrowding
which would result from permitting the short-term rental of separate
accommodation units in such neighborhoods; and
WHEREAS, the Planning and Environmental Commission has recom-
mended the following changes to the municipal code;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF VAIL, COLORADO, THAT:
Section 1.
Section 18.04.110 of the Municipal Code of the Town of Vail is
hereby repealed and re-enacted to read as follows:
18.04.110 Family
Family shall be deemed to be either A or B:
A. An individual, or two or more persons related
by blood, marriage or adoption, excluding
domestic servants, living together in a
dwelling unit used as a single housekeeping
unit.
B. A group of unrelated persons not to exceed
two persons per bedroom plus an additional
two persons per dwelling unit used as a
single housekeeping unit.
Section 2.
The Municipal Code of the Town of Vail is hereby amended by
the adoption of Section 18.04.355, Short Term Rental, to read as
follows:
18.04.355 Short Term Rental
Short term rental shall be deemed to be a rental for a period
of time not exceeding thirty one (31) days.

Section 3.
The Vail Municipal Code of the Town of Vail, Colorado, is hereby
amended by the adoption of Section 18.58.310 to read as follows:
28.58.310 Short-Term Rental Accommodation Unit
No rooms in any structure or building located in any single
family, two family or primary-secondary zone district within the
Town shall be short term rented, separately as accommodation units.
Section 4.
If any part, section, subsection, sentence, clause or phrase
of this ordinance is for any reason held to be invalid, such decision
shall not effect the validity of the remaining portions of this
ordinance; and the Town Council hereby declares it would have passed
this ordinance, and each part, section, subsection, sentence, clause
or phrase thereto, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared in-
valid.
Section 5.
The Town Council hereby finds, determines and declares that this
ordinance is necessary and proper for the health, safety and welfare
of the Town of Vail and the inhabitants thereof.
INTRODUCED, READ AND PASSED ON FIRST READING THIS 20th day of `
July, 1982, and a public hearing shall be held on this ordinance on
the 3rd day of August, 1982, at 7:30 p.m. in the Council Chambers of
the Vail Municipal Building, Vail, Colorado.
