HomeMy WebLinkAbout1982-24 Setting a Moratorium on the Conversion of Dwelling Units and Accommodation Units within the Town to Condominiums• • ~ ORDINANCE N0. 24 Series of 1982 AN ORDINANCE SETTING A MORATORIUM ON THE CONVERSION OF llWELLING UNITS AND ACCOMMO- DATION UNITS WITHIN THE TOWN TO CONDOMINIUMS; AUTHORIZING AND DIRECTING THE TOWN MANAGER OR HIS AUTHORIZED AGENT OR REPRESENTATIVE TO SUSPEND THE ISSUANCE OF ANY APPROVALS THAT ARE INCONSISTENT WITH THIS MORATORIUM; SETTING A TIME LIMIT ON THIS MORATORIUM; AND SETTING FORTH DETAILS IN RELATION THERETO AND DECLARING AN EMERGENCY THEREFORE WHEREAS, the existing Town of Vail has a character that has been delicately developed over the years and part of that character is the present balance between accommodations for visitors to the Town of Vail, residents of the town and seasonal employees, and WHEREAS, in recognition of this balance the Town passed Ordinance No. 24, Series of 1980 placing certain limitations and restrictions on the conversion of lodge buildings or struc- tures containing accommodation units into condominiums and WHEREAS, it has become clear in the application of said ordinance that it contains certain ambiguities and is not sufficient to deal with all the problems presented by the conversion of units within the Town of Vail into condominiums, and WHEREAS, the Town Council is of the opinion that all conversions of dwelling units in the Public Accommodations Zone District and accommodation units wherever they are located within the Town should be delayed pending amendments and/or additions to the Town ordinances which would protect and preserve the balance units within the Town, and WHEREAS, the Town Council has directed that a full study and review relevant to the protection of said balance be undertaken by the Town Staff and Planning Commission; and, WHEREAS, it appears that the directed studies can be accomplished within the next 45 days; and, WHEREAS, the Town Council concludes that a moratorium on the conversion of dwelling units in the Public Accommodations Zone District and accommodation units wherever located within the Town to condominiums is necessary to protect the balance • Page Two Ord. No. between accommodations for visitors to the Town of Vail, residents and seasonal employees until the proposed study and appropriate legislation can be completed and enacted; 24 NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section I No dwelling unit in the Public Accommodations Zone District or accommodation unit located anywhere within the Town shall be converted to a condominium and the Town Manager or his duly authorized representative is hereby authorized and directed to suspend the issuance of all approvals of proposals for such conversions. Section II This moratorium as created by this ordinance shall be in effect for no more than 45 days from and after the effective date of this ordinance unless otherwise extended by the Town Council. Section III Severability. If any paragraph, sentence, wor d, clause or other provision or the application thereof is for any reason held to be unconsti- tutional or otherwise invalid, such decision shall not affect the validity of the remaining paragraphs, sentences, words, clauses or other provisions of this Ordinance, it being the legislative intent that this Ordinance shall stand notwith- standing any such invalidity. Section IV The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. - a • t Page Three Ord. No. 24 Section V The Town Council, based on the above findings, specifically confides and states that it is their opinion that an emergency exists, that this ordinance is immediately necessary for the protection of the public health, safety and welfare, and this ordinance shall take full force and effect upon adoption in accordance with the charter of the Town of Vail, as an emergency measure.
