S. `. c~~o~Udo ~si~~57 veil UNLAWFUL FOR ANY PERSON TO IDLE OR PERMIT . cttic~~ of m,~n cl~ri< THE IDLING OF ANY BUS TRUCK OR MOTOR VEHICLE OF ANY KIND WHATSOEVER WITHIN THE TOWN OF VAIL FOR A PERIOD OF TIME IN EXCESS OF TWENTY MINUTES; AND ADDING A NEW SUB-PARAGRAPH G.2 MAKING IT UNLAWFUL FOR ANY PERSON TO PERMIT THE IDELING OF ANY UNATTENDED MOTOR VEHICLE EXCEPTING REFRIGERATION VEHICLES, FOR ANY PERIOD OF TIME WITHIN THE COMMERCIAL CORE I AND COMMERCIAL CORE II ZONE DISTRICTS WITHIN THE TOWN: AND SETTING FORTH DETAILS IN RELATION THERETO. WHEREAS, the idling of busses, trucks and motor vehicles within the Town for extended periods of time is a nuisance and A public health hazard to the inhabitants of the Town of Vail; and WHEREAS, it is the Town Council's belief that it would benefit the health, safety and welfare of the inhabitants of the Town of Vail if a limit on the length of time motor vehicles are permitted to idle within the Town; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, THAT: Section 1. 8.24.060 Noise Prohibited is hereby amended by the addition of a new section, sub-paragraph Gl to read as follows: G. 1. It shall be unlawful for any person to idle or permit the idling of the engine of any bus, truck, or any motor vehicle of any kind whatsoever, for a period of time in excess of twenty (20} minutes within the Town limits of the Town of Vail. G.2 Notwithstanding Paragraph G.1, it shall be unlawful for any person to permit any idling whatsoever of the engine of any unattended bus, truck or any motor vehicle, except for refrigeration vehicles, within the Commercial Core I or the Commercial Core II zone district of the Town. Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each parti, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 4.
