HomeMy WebLinkAbout1982-35 Amending Ordinance No. 5, Series 1982, Clarifying Certain Wording in Said Ordinance, Adding Radio and Television Broadcasting Studios as a Permitted Use in the Arterial Business District~,,.,,-;.'.-:~R,-- ORDINANCE #35 1 ~ h~~~~ (SERIES OF 1982) A. ylT~~ r a R ~t't ( a~~ - B~~.l,s.n~Ep,~C~~d AN ORDINANCE AMENDING ORDINANCE NO. 5, ~;:,~~. o~;;~:~~dd 8~~~7 SERIES OF 1982 , CLARIFYING CERTAIN WORDING ~~ta~e~fit~v~~l~~ IN SAID ORDINANCE; ADDING RADIO AND TELEVISION BROADCASTING STUDIOS AS A PERMITTED USE IN THE ARTERIAL BUSINESS DISTRICT; PROVIDING THAT CERTAIN PERMITTED USES AND CONDITIONAL USES SHALL BE ONLY PERMITTED ON THE FIRST (STREET) LEVEL; AND PROVIDING DETAILS THERETO. WHEREAS, Ordinance No. 5, Series of 1982, amended the Vail Municipal Code to add an Arterial Business Zone District designated as Chapter 18.29, and WHEREAS, the Town Council has determined that certain permitted uses and conditional uses set forth in Sections 18.29.020 and 18.29.030 should only be permitted on the first (street) level; and WHEREAS, the Town Council has determined that radio and tele- vision broadcasting studios would be appropriate permitted uses in said Arterial Business District; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Section 18.29.020 Permitted Uses is hereby repealed and reenacted to read as follows: 18.29.020 Permitted Uses The following uses shall be permitted in the Arterial Business District: A. Professional and business offices and studios. B. The following retail stores and establishments are deemed to be generally accessory and/or supportive of office uses and are therefore permitted so long as they do not exceed 8000 square feet in floor area for each such business use and so long as they are located on the first (street) level: Art supply stores Bookstores Drugstores Pharmacies Florists Newsstands Tobacco stores Stationery stores C. The following personal services and repair shops are deemed to be generally accessory and/or supportive of office uses and shall be permitted on the first (street) level: Barber shops Beauty shops Shoe repair Tailors and dressmakers Travel and ticket agencies • • • -2- D. The following eating and drinking establishments are permitted on the first (street) level: Cocktail lounges taverns and bars Coffee shops, fountains, sandwich shops and restaurants E. Additional offices, businesses or services determined to be similar to permitted uses in accordance with the provisions of Section 18.29.010 of this Chapter. Section 2. Section 18.29.030 Conditional Uses is hereby repealed and reenacted to read as follows: 18.29.030 Conditional Uses A. The following conditional uses shall be permitted in the Arterial Business District, subject to the issuance of a conditional use permit in accordance with the provisions of Chapter 18.60: Public buildings, grounds and facilities Public park and recreation facilities Any use permitted by Section 18.29.020 which is not conducted entirely within a building Service yards Public utility and public service uses, including screened outside storage Multi-family dwellings for the employees of the upper Eagle Valley as further restricted by Section 18.27.130 of this zone district. B. The following uses shall be permitted on the first (street) level floor within a structure subject to the issuance of a conditional use permit and are listed as such due to their potential individual and cumulative impacts of generating traffic in the Arterial Business District and will receive review under the provisions of Chapter 18.60 with specific emphasis on the criteria of traffic generation: Apparrel stores Bakeries and confectioneries Camera stores Furniture stores Hardware stores Health food stores Hobby stores Household appliance stores Liquor stores Music and record stores Yardage and dry good stores Business and office services Cleaning and laundry pickup agencies without bulk cleaning or dying Small appliance repair shops, excluding furniture repair Pet shops Outside car wash Public and private health facilities Theatre Service stations Nursery and garden supply Banks and financial institutions • i -3- Section 3. Section 18.29.020 (A) is hereby repealed and reenacted to read as follows: A. Professional and business offices and studios; radio and television broadcasting studios. Section 4. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 5: The Town Council hereby finds, determines and declares that ., this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. INTRODUCED, READ AND PASSED ON FIRST READING THIS 19th day of October, 1982, and a public hearing shall be held on this ordinance? on the 2nd day of November 1982, at 7:30 p.m. in the Council Chambers of the Vail Municipal Building, Vail, Colorado.
