HomeMy WebLinkAbout1982-36 Providing for the Town to Withdraw from the Social Security Act: Withdrawing Social Security Coverage to the Employees and Officers of the Townf ~~ ~, - •. 75 s. frr,~~~,t~ge road veil, co„~r.a;~o 81657 of~cc ,i to,~n ci^rk • • ORDINANCE #36 (Series of 1982) AN ORDINANCE PROVIDING FOR THE TOWN TO WITHDRAW FROM THE SOCIAL SECURITY ACT: WITHDRAWING SOCIAL SECURITY COVERAGE TO THE EMPLOYEES AND OFFICERS OF THE TOWN; AND TERMINATING THE AGREEMENT BETWEEN THE TOWN AND THE DEPARTMENT OF EMPLOYMENT SECURITY OF THE STATE OF COLORADO; AND PROVIDING DETAILS IN RELATION THERETO. WHEREAS, pursuant to Section 2.44.010 of the Municipal Code of the Town of Vail, the Town entered into an agreement with the Department of Employment Security of the State of Colorado to extend Social Security coverage to the employees and officers of the Town; and WHEREAS, Section 2.44.020 provided for the establishment of a payroll deduction system to be matched by payments by the Town to be paid into the contribution fund of the State of the Department of Employment Security; and WHEREAS, pursuant to Section 2.44.030, appropriation was made from proper funds of the Town in the necessary amount to pay into the contribution fund of the State; and WHEREAS, the Town has decided that it would benefit the employees and officers of the Town to withdraw from Social Security coverage and terminate the agreement with the Department of Employment Security for the State of Colorado so that the Town can establish its own pension plan for its employees and officers. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL: 1. The Town is hereby authorized to withdraw from coverage under the Social Security Act and is further authorized to terminate its agreement with the Department of Employment Security of the State of Colorado providing for the extension of such social security to the employees and officers of the Town of Vail. 2. Section 2.44.010 - Agreements authorize, Section 2.44.020 - deductions authorized, and Section 2.44.030 - contribution by Town authorized are hereby repealed. ~'! • • -2- Section 3. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 4. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 5. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressed stated herein. INTRODUCED, READ AND PASSED ON FIRST READING THIS 19th day of October, 1982, and a public hearing shall be held on this ordinance on the 2nd day of November 1982, at 7:30 p.m. in the Council Chambers of the Vail Municipal Building, Vail, Colorado.
