WIiEREAS, the Town Council believes it would benefit the "~"s `,: ~F ,~ , health, safety and welfare of the inhabitants and visitors to "~': the Town of Vail if individuals whose vehicles were impounded - were provided with a post storage hearing; and ', WIiEREAS, the Town Council wishes to provide such hearing and set forth rules for the conduct of such hearing. NOW, THEREI~'ORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN 0I' VAIL, COLORADO,: Section 1 Section 1.0.08.040 Impoundment-Notice of the Municipal Code oi~ the Town of Vail is hereby repealed and reenacted to read as follows A. Whenever a police officer nr any employee of the Town so authorized removes a vehicle and causes it to be impounded as authorized by law, and the officer or other employee knows or is able to ascertain from the registration or other records in the vehicle or otherwise, the name of the owner and address of the owner, the officer or employee shall immediately give or cause to be given notice in writing to the owner of the fact of the removal, ~i;he reason for it and the place to which the vehicle has been ~ ; removed. f B. As to any vehicle i~ ounded pursuant to this chapter by car at the request of the Town of Vail, its agents nr employees, a person who has legal entitlement to possession of the vehicle has a right tc7 a POST_SEIZURI; administrative hearing to determine whether there was probable cause to impound the vehicle. If such person files a written demand, on forms so provided for such a he~.~ring, n~fl; t:ho Town of Vail within ten (10) days after such ~~~rson has learned such vehicle has been impounded or within ten ~ ~ ~ -2-- (10} days after the mailing date set in the notice of stored vehicle, whichovor occurs first. The notice of stored vehicle shall be sent in the mail to the legal and registered owner or other agent within ~~ ]'arty--eight (48) hours excluding weekends and holidays, after the ts;~~~' impounding and storage of the vehicle. C. A hearing shall be conducted before a hearing officer designated by the Town Manager within forty-eight (48) hours of receipt of a written demand therefore from the person seeking the hearing, unless such person waives the right to a speedy hearing. Saturdays, Sundays, and Town holidays are to be excluded from the calculation of. the forty--eight (d8) hour period. The hearing officer shal_1. be someone other than th.e person that directed the impounding and storage of the vehicle. The sole question before the hearing of:fa.cer sha11 be whether there was probable cause to impound the vehl_cle in question, "probable cause to impcund" shall mean such a state of facts as would lead a person of ordinary care and prudence to believe that there was sui:ficient breach of local, state or federal law to grant legal authority for the removal of the vehicle. The hearing officer shall conduct the hearing in an informal manner and shall not be bound by technical rules of evidence. The person demanding the hearing shall carry the burden of establishing ghat such person has the right to possession of the vehicle. The Police Department shall burden of establishing that there was probable cause to impound the vehic]_e in question. At the conclusion of the hearing, the hearing offi,der shall prepare a written decision. •/ A copy o:i' such decision shall be provided to the person demanding the heari.zag and the registered owner of the vehicle (if not the person requesting l:he hearing). The hearing officer's decision in no way atl'ects any cra-ninal proceeding in connection with the impounding question or any criminal charges involved in such proceeding may only be challenged in the appropriate court. Ft :~. k. i ~:,yi ~ ~ ~ ~ • ~~_ agent to request or attend a scheduled post storage hearing shall be deemed a waiver of the right to such hearing. D. The hearing officer shall only determine that as to the vehicle in issue either (a) there was probable cause to impound the vehicle, or (b) there was no such probable cause, In the event that the hearing officer determines that there was no probable cause, the hearing officer shall prepare and date a certificate of no probable cause, copies of which sha11 be given to the possessor of the vehicle and the police department. Upon receipt of the possessor's copy of such certificate, the official police, garage or impound lot having custody of the vehicle shall release the vehicle to its possessor. Upon the finding of no probable cause, towing and storage fees shall be paid by the Town in accordance with the arrangements made between the town and the official police garage or impound lat. If the possessor fails to present such certificate to the impound lot or o:~ficial police garage having custody of the vehicle within twenty-four (24) hours of its receipt, excluding such days when the official police garage or impound lot is not open for business, the possessor shall assume liability for all subsequent storage charges. Such certificate shall advise the possessor of such requirement. Section 2 I:C any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this i ordinance; and the Town Council 'hereby declares it would have passed r this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. '. ..i: ~.:~ X1:..1 l'~~1 , i • • _4_ Section ~ The repeal or the repeal and reenactment of any provision of the Va~.l Municipal Code as provided in this ordinance shall not a~~'ect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed or reenacted. The repeaJ_ o.f any provision hereby shall not revive. any provision or any ordinance previously repealed or superseded unless expressly stated here:i.n.
