AN ORDINANCE MAKING IT UNLAWFUL FOR
ANY PERSON TO DEFRAUD ANOTHER BY CHECK;
SETTING FORTH CERTAIN DEFINITIONS AND
DETAILS IN RELATION THERETO.
WF3EREAS, the Town Council of the Town of Vail is concerned
with the high incidence of individuals within the Town being
defrauded by the use of checks; and/~.
WHEREAS, the Town Council believes~~.t would benefit the
health, safety and welfare of the inhabitants of the Town to
make fraud by check unlawful,
NOW, THEREFORE, BE TT ORDAINED BY THE TOWN COUNCIL OF THE
~'DWN OF VAIL, COLORADO, THAT;
Section 1. Fraud by Check.
A. As used in this section, unless the context otherwise
requires:
a. "Check" means a written, unconditional order to
pay a certain of money drawn on a bank, payable on demand and
signed bythe Drawer.
b. "Drawee" means the bank upon which a check is
drawn.
c. "Drawer" means a person, either real or ficticious
whose name appears on a check as a primary obligor, whether the
actual signature be that of the person or of a person authorized
to draw a check on himself or herself.
d. "Insufficient Funds" means a drawer has insufficient
funds with the drawee to pay a check when the drawer has no checking
account with the drawee, or has funds in a checking accounts with the
drawee in an amount less than the amount of the check, plus the amount
~. of all other checks outstanding at thy: time of issuance; and a check
dishonored for "no account" shall also be deemed to be dishonored for
"insuf f ~.cient funds" .
e. "Issue" -- a person issues a check when he or she makes,
draws, delivers or passes it, or causes it to be made, drawn, delivered
or passed.

B. Any person, knowing he or she has insufficient funds with
the drawee, who, with intent to defraud, .issues a check for the payment
of services, wages, salary, commissions, labor, rent, money, property,
or other thing of value, commits fraud by check, which is unlawful.
C. Notwithstanding any other provision of this section, no
violation of this section occurs ii:
a. The check alleged to be fraudulent was for sum of $200.00
or more.
b. The person issues two or more checks within any thirty day
period in the State of Colorado totaling $200. or mare in the aggregate,
or
c. The person issuing the check has been twice previously
convicted under C.R.S, Section 18-5-205 (1.973, as amended} or any
former Colorado Statute of similar content and purport, and
d. The allegedly fraudlent check was drawn on an account which
did not exist or which has been closed for a period of thirty days or
more prior to the issuance of said check,
D. It shall be unlawful for any person to open a checking account
using false identification or an assumed name for the purpose of
issuing a fraudulent check.
E, if the deferred prosecution or sentencing is ordered, the
Court, as a condition of such disposition, may require the defendant
to make restitution on all checks issued by the Defendant which are
unpaid as of the date of commencement of the deferred period in
addition to other terms and conditions appropriate for the treatment
or rehabilitation of the Defendant,
F. ~! bank shall not be civilly or criminally liable for
' releasing information relating to the drawer's account to a police
officer, town attorney, assistant town attorney, or authorized
investigator far the town attorney investigating or prosecuting a
charge under this section.

Sectiion 2
If any part, section, subsection, sentence, clause or phrase
of this ordinance is for any reason held to be invalid, such decision
shall. not effect the validity of tkze remaining portions of this
ordinance; and the Town Council hereby declares it would have passed
this ordinance, and each part, section, subsection, sentence, clause
or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentE-nces, clauses or phrases be declared
invalid.
Section 3
The Town Council hereby finds, determines and declares that
this ordinance is necessary and proper for the health, safety and
welfare of the Town of Vail and the inhabitants thereof.
Section 4
The repeal or the repeal and reenactment of any provision of
the Vail Municipal Code as provided in this ordinance shall not
a1.Eect any right which has accrued, any duty imposed, any violation
that occurred prior to the effective date hereof, any prosecution
commenced, nor any other action or proceeding as commenced under or
by virtue of the provision repealed or repealed or reenacted. The
repeal of any provision hereby shall not revive any provision or any .,,~
ordinance previously repealed or superseded unless expressly stated
herein.
INTRODUCED, READ ON FIRST READING, APPROVED AND ORDERED PDBLTSHED
ONCE IN FULL THIS 15th day of February, 1983, and a public hearing on
this ordinance shall be held at the regular meeting of the Town Council
