AN ORDINANCE AMENDING SECTION 18.26.045 (A)5
BY ADDING A NEW SUBPARAGRAPH 5 (a} TO PROVIDE
FOR AN EARLIER SUBMITTAL DEADLINE FOR EXTERIOR
ALTERATION AND MODIFICATION IN COMMERCIAL CORE
II FOR THE SPRING OF 1983 ONUY.
WHEREAS, it is the opinion of the Town Council that private
sector remodeling and additions in the Commercial Core II zone
district which sizall occur in the construction season of 1983
should be performed in conjunction and coordination with the
proposed construction of the Town relating to improvements in
the Lionshead Mall; and
WHEREAS, the normal submittal deadline for exterior alteration
and modification in Commercial Core II are the fourth 142onday in May
and the fourth Monday ~.n November; and
WIiEi~,EAS, the early submittal deadline in the spring of 1983 will
allow construction projects to receive necessary Town approval. earlier
so that they may proceed in conjunction and coordination with woxk on
tl7e Lionshead Mall,
NOW, THEREI{~ORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF VAIL, COLORADO, THAT:
Section 1.
Section 18.26.045 {A) 5 of the Vail Municipal Code is hex•eby amended
by the addition oi' a subparagraph (a) to read as follows:
5 a. For the year 1983 only, due to Town of Vail construction
on the Lionshead Mall, the spring submittal date shall be
April 25, 1983, rather than the fourth Monday of May, 1983,
All other previsions of paragraph 5 shall remain unchanged.
Section 2

shall not e£:Cect the validity of the remaining portions of this
ord~.nance; and the Town Council hereby declares it would have passed
this ox•di.nance, and each part, section, subsection, sentence, clause
or phrase thereof, regardless of the fact that any one or more parts,
sections, sub,ectians, sentences, clauses or phrases be declared

Section 3
The Tnw~a Council. hereby finds, determines and declares that
this ordinance is necessary and proper for the health, safety and
welfare of the Town of Vail and the inhabitants thereof.
Section 4
The repeal or the repeal and reenactment of any provision of
the Vail. Municipal Code as provided in this ordinance shall not
affect any r5_ght which has accrued, any duty imposed, any violation.
that occurred prior to the effective date hereof, any prosecution
commenced, nUr any other action or proceedizxg as commenced under or
by virtue o!: the provision repealed or repealed nr reenacted. The
repeal of any provision hereby shall not revive any provision or any
ordinance previously repealed or superseded unless expressly stated
herein.
