AN ORDINANCE REPEALING AND REENACTING
SECTIONS 5.16.100 INSURANCE - GENERAL
LIABILITY AND WORKMEN'S COMPENSATION
AND 5.16.210 REGISTRATION -- FEE SCHEDULE;
PROVIDING FOR HIGHER MINIMUM LIMITS FOR
GENERAL LIABILITY INSURANCE FOR CONTRACTORS
AND PROVIDING A NEW LICENSE FEE FOR CONTRACTORS
WITHIN THE TOWN; AND SETTING FORTH DETAILS IN
RELATION TIIERETO.
WIiIaREAS, the minimum Limit for public liability insurance
for contractors is no Longer adequate to cover the potential
liability f.c>r bodily injury or property damage; and
WHEREAS, the present contractor registration fee has not
been changed Since 1978 and is no longer adequate;
NOW, TIIEliEI;'ORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF VAIL, COLORADO, TIiAT:
1. Section 5.16.100 Insurance - General Liability and
Workmen's Compensation i.s hereby repealed and reenacted to read
as :follows:
Section 5.16.100 Insurance - General Liability and
Workmen's Compensation.
Every person granted a registration card under the
provisions of this chapter shall be required to
maintain the fallowing minimum types and amounts
of insurance at all times:
1. Employee liability.
2. Workmen`s compensation.
3. Public liability with the following limits
Opt:inn 1. $].,000,000. in the aggregate, for bodily injury
and $1.,000,000. in the aggregate, for property damage.
Option 2. Combined single limit of $1,000,000,
Section 2. Section 5.16.210 Registration - Fee Schedule is
hereby repealed and reenacted to read as follows:
Section 5.16.210 Registration - Fee Schedule. The fees
applicable to the registrations enumerated in Sections
5.1G.130 through 5.16.200 shall be in accordance with
tho f'oilowing table:

If any part, section, subsection, sentence, clause or phrase
c>f this ordinance is for any reason held to be invalid, such decision
sha:l.] noi. ef.~'ect the va"lidity of the remaining portions of this
ordinance; and the Town Council hereby declares it would have passed
this ordinance, and each part, section, subsection, sentence, clause
or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared
~.n~ral.id.
Section ~
The Town Council hereby finds, determines and declares that
f:his ordinance is necessary and proper for the health, safety and
welfare of the Town of Vail anal the ~.nhabitants thereof.
Sec;tl.on 5
`t`he repeal or the repeal and reenactment of any provision of
the Vail Municipal Cade as provided in this ordinance shall not
affect any right which has accrued, any duty imposed, any violation
that occurred prior to the effective date hereof, any prosecution
commenced, nor any other action or proceeding as commenced under or
by virtue of the provision repealed or repealed or reenacted. The
repeal of any provision hereby shall not revive any prevision or any
ordinance previously repealed or superseded unless expressly stated
