T9 (Series of 1983) AN ORDINANCE AMENDING SECTION 18.27.030 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL PROVIDING FOR THE DESIGNATION OF RADIO flND TELEVISION SIGNAL. RELAY TRANSMISSION FACILITES AS A CONDITIONAL USE IN THE COMMERCIAL CORE III ZONE DISTRICT AND PROVIDING DETAILS IN RELATION THERETO. WHEREAS, the Commercial Core III Zone District allows as a permitted use radio and television broadcasting studios; and WHEREAS, in certain instances it is necessary to locate signal relay transmission facilities adjacent to the broadcast studio; and WHEREAS, a conditional use review is necessary to ensure that the necessary trans- mission relay facilities will be located properly with respect to the purposes of the zoning code and with respect to their effects on surrounding properties; and WHEREAS, the Planning and Environmental Commission has recommended the amendment; and WHEREAS, the Town Council is of the opinion that the amendment would be in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COl1NCIL OF THE TOWN OF VAIL THAT; Section T. Section 18.27.030 of the Vail Municipal Code is amended by the addition of item K to read as folT.ows: K. Radio and television signal relay transmission facilities Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. ~ ~ ~ Section 4. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has_ accrued, any duty i;nposed, any violation that occurred prior to the effective date hereof, any prosecution cam~nenced, nor any other action ar proceeding as commenced under or by virture of the provision repealed or repealed or reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. INTRODUCED, READ AND PASSED ON FIRST READING THIS 3rd day of May 1983 and a public hearing shall be held on this ordinance on the _~rr, day of May 1983 at 7.30 pm in the Council Chambers of the Vail Municipal Building, Vail, Colorado.
