WHEREAS, the Town Council is of the opinion that a specific area in Special Development District #6 could, possibly, be suitable for a popcorn outside vending wagon that conforms in appearance with those existing in i.n L'c~m~r~r~rcial Core I and Commercial Core II ; and WHEREAS, under a conditional use permit review process each individual project would receive a detailed study to ensure its compatibility with the surrounding uses as well as not create other negative impacts; and WHEREAS, the Planning and Environmental Commission has recommended to Town Council the adoption of the below amendment; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL THAT: Section 1. Section 8 of Ordinance 7, Series of 1976, Conditional Uses in the Special District, is hereby amended to read as follows: All conditional uses as defined in the Public Accommodation District, Section 18.22.030, and subject to the issuance of a conditional use permit in accordance with the provisions of Chapter 18.60, shall be permitted in Special Development District #6. Also, the following shall be a conditional use subject to the provisions of Chapter 18.60: A. A popcorn outside vending wagon that conforms in appearance with those existing i n C;ommerc>_a1 Core I and Commercial. Core II . Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the va]idity of the remaining portions of this ordinance; and the Tawn Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one ar more parts, sections, subsections, sentences, clauses or phrases be declared invalid. it ! ~ Section 3, The Town Cor~ncil hereby finds, determines and declares that this ordinance is necessary and ,roper for the health, safety and ~~~elfare of the Town of Vail and the inhabitants thereof. Section 4. The rep~_al or the repeal and i,eenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation That occurred prior to the effective date hereof, any pr°osecution coinmonced, nor any other action or proceeding as comrr3enced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not r°evive any provision or any ordinance previously repealed or superseded unless expressly stated herein.
