AN ORDINANCE MAKING ALL PINE TREES, LIVE
OR DEAD, WHICH ARE AFFLICTED WITH, OR
ACTING AS A BREEDING PLACE FOR THE
MOUNTAIN PINE BEETLE, A PUBLIC NUISANCE;
PROVIDING FOR INSPECTION OF PINE TREES
OR DEAD WODD ON PRIVATE PROPERTY BY THE
T'UBLIC WORKS DIRECTOR; GIVING THE PUBLIC
WORKS DIRECTOR THE POWER TO DESTROY, REMOVE
OR ERADICATE SUCH NUISANCES AND ASSESS THE
COST THEREOF TO THE OWNER IF THE OWNER FAILS
TO ADATE SUCH NUISANCE HIbISELF; PROVIDING FOR
THE LICENSING OF EXTERMINATORS OF THE MOUNTAIN
PINE BEETLE AND SETTING FORTH PENALTIES FOR
VIOLATIONS OF THE PROVISIONS HEREOF; AND
SETTING FORTH DETAILS IN RELATION THERETO.
~'VHEREAS, the spread of the mountain pine beetle has posed an
immediate threat to the pine trees located within the Town of Vail
and,
WHT~REAS, in order to contain the spread of the mountain pine
beetle and protect the health, safety and welfare of the inhabitants
01' the Town of Vail, the Town Council wishes to clear pine trees
afi~ected with the mountain pine beetle, a public nuisance to be
abated by the owner of the land on which such infected trees are
Mound, or iT' not so abated to be destroyed by the Town of Vail, and
WHEREAS, the Town Council wishes to provide for the licensing of
exterminators of the mountain pine beetle,
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TDWN
OF VAIL, THAT:
Section 1. Certain species declared nuisances.
A. All species and varieties of live pine trees identified by the
Sta~i,e CertiS'ied Pest Applicator or the U.S. Forest Service infected with
the insect known as the "mountain pine beetle" (Dendroctonus ponderosae)
are hereby declared to be public nuisances.
13. A1.1 species and varieties of pine trees that are dead or
substantially dead, and all dead pine wood to which the bark is still
attached, which, because of their condition, may serve as a breeding
pl..ace for the mountain pine beetle (Dendroctonus ponderosae) are
hereby declared to be public nuisances.

Section 2. Abatement of nuisance by owner,
It shall be unlawful for any owner of~any lot or parcel of land in
the Town to permit or maintain on such lot or parcel any dead pine wood
or dead or live pine tree which is a public nuisance as defined herein,
and it shall be the duty of the owner of such to promptly remove, burn
or spray such wood or trees, or otherwise abate or eradicate such
nuisance as may be appropriate, under the supervision or at the direction
of the Director of Public Works. Such abatement or eradication may be
done by the owner himself or by a duly licensed exterminator, if that
is appropriate.
Section 3. Enforcing officer.
The Director of Public Works of the town, under the authority of
the Town Manager, shall perform the duties set forth in this Article
and shall. enj'orce the provisions of this Article. He may have such
assistance as the Town Council sha11 provide.
Secti_c~n 4. Inspections.
The Director of Public Works is authorized and empowered to enter
upon any l.ot or parcel of land in the town at any reasonable hour for
the purpose of inspecting any pine trees or dead pine wood situated
thereon, and he may remove such specimens from such trees or wood as
are required For the purpose of laboratory analysis as identified by
the State Certified Fest Applicator or the U.S, forest Service or to
determine whether such tree, because it is dead or substantially dead
or the wood may serve as a breeding place for the mountain pine beetle.
It sha11 be unlawful fox any person, firm or corporation to take any
action to prevent the Director o~ Public Works from performing his
duties or the exercise of any authority as provided in this Article.
Section 5. Notice of violation; failure to abate.
If any live pine tree ox dead pine tree or wood is determined by
the town to be a public nuisance as provided herein, the town shall
noti:Py the owner of retard, by posting upon the property on which such
nuisance is located, a notice decla.rirkg such property to be harboring
such nu~.sance and ordering compliance with this ordinance. If any
person, firm or corporation upon whose property such notice is posted

:fa~1s, nc;~,lects or refuses to remove and destroy, or otherwise abate
or er~.id~catc:, such nuisance within forty-eight (48} hours after posting
o:C such notice, the Director of Qublic Works may proceed to remove and
destroy, o.r cause to be removed and destroyed or otherwise abated or
eradicated, such nuisance and assess the cost thereof against the owner
of such .E.ot or parcel ni' land, and the amount of such cast shall be paid
by the owner to the town. The cast of such work shall be in addition to
the penalties imposed heroin for any violation or noncompliance with any
provasa_ons off: this ordinance.
Section 6. Violations of town property.
Any live pine tree or dead pine wood or tree on property owned by
the town which is a public nuisance as defined herein shall be promptly
removed, burned or sprayed, or the nuisance otherwise abated ar eradicated,
under the supervision of the Director of Public Works at the expense of
the Town.
Section 7. Licensing of exterminators.
No person, farm or corporation shall engage in the extermination
ox eradication by chemical means as required, when appropriate, by this
ordinance upon any property within the town without first obtaining a
license for such activity from the town. An applicant for such license
shall make written application for such license at the office of the
Town Clerk. The applicant must present evidence of qualification and
current li.censure by the Colorado Department of Agriculture, Plant
Industry Division, Pesticide Section, to perform extermination and use
pesticides, under the procedure provided for in Title 35, Article 10,
o:f the Colorado Revised Statutes 1.973, as amended. No applicant failing
to meet any of the above requirements for licensure by the town shall be
permitted to perform any exterminating or eradicating required by this
article.

Section 8. License fee; terms; revocation
The annum. license fee rar any person, firm or corporation engaging
in the extermination or eradication of the mountain pine beetle as defined
herein sha~.l be ten dollars ($10.). All licenses issued under this
Article shall expire on the last day of December of the year in which
such license is issued or renewed. A11 renewals of such licenses shall
be made only with the approval of the Department of Public Works, and
upon the same conditions as outlined in Section 7 above. Any license
issued under the provisions of this ordinance may be revoked upon a
finding by the town that the licensee has not complied with the pro--

visions of this ordinance or any state law or regulation. Such
revocation may be in addition to any fine or penalty imposed under this
ordinance. It shall be the duty of any exterminator or eradicator
licensed under this ordinance to give evidence of such license to any
persan, firm or corporation contracting with or hiring said licensee
to per~'c~rm wark within the town.
Section 9. Violations and penalties.
A. Any person, firm ar corporation violating any of the pro-
visions of this ardinance by railing, neglecting or refusing to comply
with the pravisions of any notice herein provided for within forth-
eight (~.8) hours after the service thereof or who shall resist or
obstruct the carrying out of the provisions of this ordinance shall be
guilty of a misdemeanor and shall be subject to such penalties as are
provided in Section 1.41.144.
B. Any person, firm or corporation not licensed under the
provisions of this ordinance to solicit, advertise, offer to perform
ax• perform any of the functions provided for herein who does so solicit,
advertise, o~'!'er to perform and perform said runctions sha11, in
addition to any fines and penalties imposed under Colorado statutes,
be subject to such penalties as are provided in Section 1.41.100 of the
N]un~.ci.pal Code of the Town o:~ Vail.
Section_10. The Town Council finds that an emergency exists in
that: immediate. action must be taken to protect the health, safety and
welfare of the inhabitants of the Town of Vail.

ordinance; and the Town Council hereby declares it would have passed

or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared
invala.d.
Section 12
The Town Council hereby finds, determines and declares that
thl.s or.d:i.nance is necessary and proper for the health, safety and
wel.:~'are of the Town of Vail and the inhabitants thereof .
Sc:cta.on 13
The repeal or the repeal and reenactment of any provision of
the Vail Municipal Code as provided in this ordinance shall not
a.fl'ect any right which has accrued, any duty imposed, any violation
that occurred prior to the effective date hereof, any prosecution
commenced, nor any other action or proceeding as commenced under or
by virtue ol: the provision repealed or repealed or reenacted. The
repeal 01' any provision hereby shall not revive any provision or any
ordinance previously repealed or superseded unless expressly stated
herein,
