AN ORDINANCE AMIaNDING CHAPTER 10.08Q
114iPOUNDMENT OF VEHICLES OF THE MUNICIPAL
CODE OF THE TOWN OF VAIL AND PROVIDING THAT
VEHICLES IMPOUNDED BY THE TOWN MAY BE SOLD
WITHOUT THE NECESSITY OF HOLDING AN AUCTION
FOR SUCH SALE AND PROVIDING DETAILS IN
RELATION THERETO
WHEREAS, Chapter ~O.OSQprovided that cars impounded by the Town
off' Vail could after a certain period of time be sold at public auction
and
WHEREAS, when such auctions were held no one came to bid for
the impounded vehicles and
WHEREAS, the 'T'own of Vail was then in the position of having
to dispose of such vehicles and
WHI~~REAS, the Town Council believes it would benefit the health,
safety ~znd wel~Iare of the inhabitatants of the Town if the Tawn were
not required to sell such Impounded vehicles at auction, but rather
could sel.1 them directly to parties interested in salvaging such
vehicles.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF ~.z~ti.a~ TOWN
OF VAIL, THAT:
Section 1. 10.08.060 Impoundment-Disposal
{B){3) is hereby amended by the deletion of the words by auction
so that it reads as follows:
A demand that the amount due the town, as stated in the notice, and
such further claims as shall accrue, shall be paid and the right to the
possession of the vehicle be established to the satisfaction of the
town manager on or before a date mentioned, being not less than ten
days from the delivery of the notice if it is personally delivered,
or from the date of registration of the letter, and statement that
unless the amount due the town is paid and the right to the possession
of the vehicle is established to the satisfaction of the town manager
wi~thi.n the time speci~Cied, the vehicle will be advertised for sale
and sold Uy ~.u~;,y~ at a specified time and place.

Section 2. 1.0.08,070 Impoundment--Auction of the Vail Municipal
Code is hereby amended by the deletion of the word Auction in the
title of the section and by removing the words by auction wherever
they appear within the section so that the section reads as follows:
10.08.070 Impoundment-A~^~-^~
In accordance with the terms of the notice provided for in
Section 10.08.060(B){3), a sale of the vehicle b5. a_z^i-^n may be
had to satisfy the claim of the town for the storage and removal
of the vehic]_e and to discharge the town from further responsibility
an connection with the vehicle and from any duty to further retain
or stare the vehicle. The sale shall. be held at the place where
the vehicle is stored or impounded or, if it is manifestly unsuitable
.[or the purpose, at the nearest suitable place. After the tame fax
the payment of the claim and the establishment to the satisfaction
of the town manager of the right to possession of the vehicle has
elapsed and notice was given as required, an advertisement of the
sale, descrl.bing the vehicle to be sold and stating the names of all
persons ltnown by the town manager to claim an interest in the vehicle,
if any, and the time and place of the sale, shall be published once a
week far two consecutive weeks in a newspaper published in the county.
'rhe sale sha11 be held not less than fifteen days from the date of the
first publication.
Section 3. 10.08.090 Impoundment-Sale to town.of the Vail Municipal
Code is hereby amended by removing the words by auction wherever they
appear within the section so that the section reads as follows:
10.08.090 Impoundment--Sale to town.
When any vehicle is offered for sale ~.--~ aucti ~n pursuant to the
terms of this chapter and there is no bid or offered bid for the
vehicle, the town manager shall declare the vehicle to be Bald to
the town for the amount of the charges for the removal and storage
o:t the vehicle, and the charges and expenses of notice, advertisement,
and sa1.e, and shall place the vehicle in the custody of such department
o:l~ the town as he in his sole discretion may determine, for the sole
benefit and use of the town.

Section d
If' any X~art, section subsection, sentence, clause or phrase of
this ords.ttauce is for any reason held to be znvalid, the decision
shall not; a:f'!'ect the validity of the remaining portions of this
ordinance; and the Town Council hereby declares it would have passed
this ordinance, and each part, section, subsection, sentence, clause
or phrase thereof, regardless of the fact that any one or mare parts,
sections, subsections, sentences, clauses or phrases be declared
invalid.
Section 5.
The repeal or the repeal and reenactment of any provision of the
Vail l~~unicipal Code as provided in this ordinance shall not affect any
right wha.ch has accured, and duty imposed, any violation that occured
prior tc7 the effeci.ive date thereof, any prosecution commenced, nor
any oth~:r action or proceeding as commenced under or by virtue of
the provision repealed ox repealed and reenacted. The repeal of
any provision hereby shall not revive any provision or any ordinance
previously repealed or superseded unless expressly stated herein.
Section 5.
The Council hereby finds, determines and declares that this
ordinance is necessary and proper for the health, safety and welfare
o.~ the 'T'own of Vail. and the inhabitants thereof .
