ORDINANCE ~ 9 Series oz 83 AN ORDINANCE REPEALING SECTIONS 17.26.060 {C) 4 and 17.26.060 {C) 5 OF THE VAIL MUNICIPAL CODE; ELIMINATING THE REQUIREMENT THAT CONDOMINIUM CONVER- SION PROJECTS INDEPENDENTLY METER UTILTTIES FOR EACH UNIT THEREOF AND ELIMINATING THE REQUIREMENT THAT SUCH PROJECTS PAY ALL FEES, TAXES OR CHARGES TO THE TOWN. WHEREAS, the Town Council feels that certain requirements relating to condo- minium conversions no longer serve any valid purpose, and WHEREAS, the Planning and Environmental Commission has recommended that the Town Council delete such requirement, NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL 0~' THE TOWN OE' VAIL, COLQRADO, THAT: Section 1. The fallowing paragraphs of Section 17.26.060, Requirements - Condominium Conversions are hereby repealed: 17.26.060 {C) 4. Condominium projects shall have public utilities independently metered to each unit; water may be on a common meter if appropriate agreements are included in the covenants, declarations, conditions, and restrictions. 17.26.060 {C) 5. All applicable taxes, fees or charges for water, sewer, recreational amenities, or other services that would be payable to the town for the project if it were being constructed new rather than being converted, shall be paid by the applicant prior to approval of the conversion. The applicant shall be credited in the amount equal to the corresponding fee, tax or charge that was paid to the town when the building was built. Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or pf~rase thereof', regardless of the fact that any one or mare par~t:s, sections subsections, sentences, clauses or phrases be declared invalid, ~ ~. - ~ ~ `, SPCtion 3. The Town Council hereby finds, determines and declares that this ordinance is necessary anti proper for the health, safety and welfare of the Town o#' Vail and the in[rabitants thereof. Sc,ction 4. 1"he rc~pea1 or the repeal and r~eenactrnent of any provision of the Vail municipal Cade as provid~ad in this ordinance shall oat affect any right which has accrued, any duty unposed, any violation that occurred prior to the effective date hereof, any prosecution cornrirenced, nor ar,y other action or proceeding as comrFrenced under or° by virtue of the provision repealed or repealed and reenacted.
