AND SETTING FORTH FINDINGS AND CONCLUSIONS AND OTHER DETAILS IN RELATION THERETO. a`~~ WHEREAS, a petition for annexation into the Town of Vail of a certain parcel of property located in Eagle County, Colorado, and more particularly described in Exhibit "A" attached hereto, has been submitted to the Town Clerk of the Town of Vail and referred therefrom to the Town Council; and WHEREAS, the owner of one hundred percent (1.00%) of the property proposed for annexation, exclusive of the streets and alleys, is Vail Associates, Inc.; and WHEREAS, the petition was signed by Robert Parker, Vice President of Vail Associates, Inc.; and WHEREAS, in accordance with CRS 31-12-107 (1) (g), 1973, as amended, the Town Council may by ordinance annex the above specified property without notice, hearing or election inasmuch as the petition was signed by one hundred percent (100%} of the property owners; and WIIEREAS, 'the Town Council is of the opinion that the petition should be granted and that the subject property should be annexed to the Town of Vail; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Findings. The Town Clerk of the Town of Vail has referred to the Town Council a petition ~Cor annexation of a cextain parcel. of property (hereinafter re:~erred to as the "subject property") and which is more specifically described in Exhibit ``A" attached hereto and the Town Council specifically finds upon review of said petition: {A) The petition is in substantial compliance with the require- meets o~ CRS 31-12-107 (1), 1973, as amended. (B) The petition was signed by the owners of one hundred percent {1.00'0) of the area proposed to be annexed, exclusive of streets and alleys. • • • ... ~ ... {C} Thesubject property is eligible for annexation to the Town of Vail in that at Least one sixty (1/6} of its boundaries are contiguous With the Town of Vail, there is community of interest between the Town of Vail and the subject property, the subject property Will be urbanized in the near future, and it is cabable of being integrated into the Town of Vail. (D) There are no limitations to the annexation of the subject property to the Town of Vail and that no Land held in identical ownership has been divided without the written consent of the land owners thereof, no land held in identical ownership comprising twenty {20) acres or more with an assessed valuation in excess of $200,000.00 for ad valorem tax purposes has kieen included without the written consent of the owner, no other annexation proceedings have been commenced by another municipality in relation to the subject property, and no area will be detached from a school district by this annexation. (E) No additional. terms or conditions are to be imposed upon this annexation. (F} The subject property may be annexed by ordinance without notice, hearing, or election in accordance with subsection (g) at 31-12--107, CRS, 1.973, as amended. Section 2. Annexation. The property presently owned by Vail Associates located in Eagle County, Colorado, more particularly described in Exhibit "A" attached hereto is annexed to the Town of Vail, Colorado. Section 3. Zoning, Pursuant to Chapter 18.6$, after the effective date of this ordinance, the Planning Commission shall set a date for a public hearing to consider the zoning distacicts to be imposed on the subject property. INTRODUCED, READ AND PASSED 4N FTRST READING THIS 6th day of September 1983, and a public hearing shall be held on this ordinance on the 20th day of September 1983, at 7:30 p,m, in tl~e Council Chambers of the Vail Municipal Building, Vail, Colorado. In support of said petition, the petitioners allege that: 1. Vail, Associates, Inc, is the sole landowner of the axea proposed to be annexed. 2. It is desirable and necessary that the above described territory be annexed to the Town of Vail. 3. Not 1c55 than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of Vail. 4. A community of interest exists between the territory proposed to be annexed and the Town of Vail. 5. The territory proposed to be annexed is comprised largely of open space, ski trails and related improvements, and summer recreational amenities. 6. The territory proposed to be annexed is integrated or is capable of being integrated with the Town of Vail. 7.
