HomeMy WebLinkAbout1983-31 Amending Chapter 2.20 to Provide that Members Appointed to the Local Licensing Authority of the Town May Either Have Resided in the Town or Any Territory Thereinafter Annexed for Not Less that Two Years Immediately Proceeding Appointment# ~ ~ ~~ ~ ~/a~~~ ORDINANCE #31 (SERIES OF 1983) AN ORDINANCE AMENDING CHAPTER 2.20 TO PROVIDE THAT MEMBERS APPOINTED TO THE LOCAL LICENSING AUTHORITY OF THE TOWN MAY EITHER HAVE RESIDED IN THE TOWN OR ANY TERRITORY THEREINAFTER ANNEXED FOR NOT LESS THAN TWO YEARS IMMEDIATELY PROCEEDING SUCH APPOINTMENT OR HAVE >;iEEN A FULL TIME EMPLOYEE OR BUSINESS OWNER ~YITHIN THE TOWN FOR NOT LESS THAN T~90 YEARS IMMEDIATELY PROCEEDING SUCH APPOINTMENT AND SETTING FORTH DETAILS IN RELATION THERETO. WIIERLAS, the Town Council is of the belief that employees and business owners as well as residents of the Town of Vail have an interest i.n regulation of liquor licenses within the Town; and WHERI~AS, the Town Council wishes to have more flexibility detcrmin_ini; who to appoint to the local licensing authority. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OIL' VAIN AS FOLLOWS Section 1. 2.20.030 Members - Qualifications is hex•eby amended to allow business owners or full time employees of the Town oi' Vail to serve on the local licensing authority so that 1 ~~ reads a.s :I'o.i.lows 2.20.030 Members - Qualifications. Each member appointed to the local. ]icensing authority shall be a citizen of the United States, have resided in the Town or any territory thereinafter annexed for not Less than two immediately proceeding such appointment, OR HAVE BEEN A BUSINESS OWNER OR FULL TIME EMPLOYEE IN THE TOWN OF VAIL FOR NOT LESS THAN TWO YEARS IMMEDIATELY PROCEEDING SUCH APPOINTMENT, and have no direct financial interest in any license to sell alcoholic liquors or iertnented malt beverages or any location having such a license. Section 2. 2.20.050 Members - Filling Vacancies is hereby amended to provide that a member may be removed when he ceases to be a. reSl.denf, of the Town or ceases to be a full time employee or business owne~• within 1.n the Town so that it reads as follows: 2.20.050 Members - Filling Vacancies A vacancy sha11 occur whenever a member of the local licensing authc~x•i.ty .is r•c:moved by the Town Council, dies, becomes incapacitated i.Lnd unable tc~ I~crforrn his duties for a period of 90 days, resigns, ~ } R ceases to be a residence of the Town, CEASES TO BE A BUSINESS OWNER OR A i'ULL TIME EMPLOYEE WITHIN THE TOWN, is convicted of a felony, o.r acquires a. direct financial interest in any license to sell alcohali.c liquors or fermented malt beverages on any location having such a license. Sectian :~. If any part, section, subsection, sentence, clause ar phrase of this ordinance is far any reason held to be invalid, the decision shall not affect the validity of the remaining portions o~ this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 4. The repeal or the repeal and reenactment of any pro-- vision a:~' the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued any duty imposed, any violation that occured prior to the effective date thereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue oi' the provision repealed or repealed and reenacted. The repeal 0:1' any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein.
