HomeMy WebLinkAbout1983-32 Repealing Chapter 3.28 Policemen's Pension Fund of the Vail Municipal Code, Amending the Town's Police and Fire Pension Plan Documents,~,:~ + 1 R ORDINANCE # 32 (Series of 1983) AN ORDINANCE REPEALING CHAPTER 3.28 POLICEMEN'S PENSION FUND OF THE VATL MUNICIPAL CODE, AMENDING THL TOWN'S POLICE AND FIRE PENSION PLAN DOCUMENTS SUBJECT TO APPROVAL BY SIXTY FIVE PERCENT {C5%} OF THE TOWN'S POLICE AND FIREMEN, AND ADOPTING A TRUST AGREEMENT PURSUANT TO THE TOWN OF VATL POLICE AND FIRE EMPLOYEES PENSION PLAN, AUTHORIZING THE TOWN 114ANAGER TO APPOINT QUALIFIED INDIVIDUALS TO ACT AS ADMINISTRATORS FOR THE POLICE AND FIRE PENSION PLAN, AND SETTING FORTH DETAILS IN RE CATION THERETO. r I~iI~.RI;AS, the Vai.1 Town Council passed Resolution #18, Series of 1982, which provided :tor the withdrawal of the Town of Vail from the State o!' Colorado sire and Police Pension Association for the purpose o:I' estak7lishing and defining a contribution plan; and which t'u.rther consolidated all employees presently in the Police Pension Plan who were hired prior to April 8, 1978, those in the Fire Pension Plan hired prior to April 8, 1978, and new employees enrolled in the Fire and Po:Lice Pension Association hired after April 8, 197$; and WHEREAS, the Police and Fire employees of the Town established a del'1_ned contribution {money purchase} plan; and WHEREAS, the Police and Fire employees of the Town of Vail now w:ksh to amend the plan document of said defined contribution plan; and WIIIrREAS, such amendment must be approved by the Town Council of the Town oi' Vail; and WHEREAS, the Police and Fire employees of the Town of Vail and the Town Council wish to adopt a trust agreement pursuant to the Po1a-ce a.nd F~.re Employees Pension Plan which agreements sets Earth that the trustees of the Police and Fire Employees Pension Plan and thea.r respective duties and obligations; and WIIEREAS, Chapter 38 Policemen's Pension Fund of the Municipal Code of the Tawn of Vail is now moot and needs to be repealed, NOW, THEREFORE, BL IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, TIIAT: Sec-l;ion 1. Chapter 3.28 Policemen's Pension Fund of the Municipal Code; oi' the 'own of Vail is hereby repealed in its entirety. Section 2. The amendments to the Police and Fire Employees Pension Plan document which are attached hereto are hereby approved by the Tawn Council subjE~ct to the approval of sixty five percent {65%) of the Palsce ~~ncl lire employees o~C the Town of Vail. * ~l -2 -- Sec-lion 3. The Town Council hereby approves the adoption of the attached Trust Agreement pursuant to the Town of Vail Police and Fire Fmp:loyees Pension Plan subject to the approval of 65% of the Police and P':i.re l~mployees of the Town of Vail. . Section 4. Town Council hereby authorizes the Town Manager to qual ia'i.ed i.ndivi.duals to act as administrators of the Town of Vail Police and Fire Employees Pension Plan. Section 5. All previous actions of the trustees of the Town of Vail. Employees Pension Plan by furtherance of the pension plan and not 1n violaiion of the trust agreement attached hereto are hereby rat:i.fied by the Tawn Council. Section 6 I:I any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause ar phrase thereof', regardless of the fact that any one ar mare parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 7 The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Sec~.ion $ The x.epeal or the repeal and reenactment of any provision of the Vail Municipal Cade as provided in this ordinance shall not a-€'.i'ect any right which has accrued, any duty imposed, any violation that occurred prior to the e#fective date hereof, any prosecution commenced, nor any other action ar proceeding as commenced under or by vir•tuE.~ of the provision repealed or repealed or reenacted.
