AN OIZDTNANCE AMENDING CHAPTER 16.20 OF THE
MUNICIPAL CODE OF THE TOWN OF VAIL PROVIDING
TIIAT PRIVATl; PARKING SIGNS SHALL BE NO GREATER
THAN TWO SQUARE FEET, SHALL HAVE A BROWN BACK-
GROUND WITII WHITE LETTERING AND SHALL HAVE THE
LOCATION APPROVED BY THE COMMUNITY DEVELOPMENT
STAFF.
WHEREAS, the Town Council has passed an ordinance providing
that l:he owners or tenants of a private parking lot or private
px•cfperty may tow vehicles parked on said property without the
consent o(' the owner or tenant; and
WIiFRi~,AS, the ordinance provides that any owner, tenant or
person in possession or control of a private parking Iot or private
parkin; wishing to avail himself of the provisions of said ordinance
sha] ]. I.~osf; on hi s property in a conspicuous place a sign indicating
that un~~L~thorized vehicles may be towed; and
W~IEIZI;AS, the Town Council wishes to set forth the requirements
o.t: saa d s] ~;~n in this ordinance;
NOW, TI-ILId.EFORE , BE IT ORDAINED BY THE TOWN COUNCI L OF THE TQWN
OF VAIL, COLORADO, AS FOLLOWS:
Secta.on 1. Section 16.20.170 B is hereby repealed and reenacted
to read ~.~s :Yol_l ows
16.20.170 B
Size. All. vehicular traffic control signs shall not exceed
one square foot except for multipurpose signs which shall
not exceed four square feet and except for private parking
signs which shall not exceed two square feet. All pedestrian
tra£i'ic control signs shall not exceed one square foot, except
mul.ti.purpose signs, which shall not exceed four square feet,
subject to approval. of Design Review Board.
Section 2. Subparagraph 16.20.170 14 is hereby repealed.
Section 3. Chapter 16.20 is hereby amended by the addition of
Section 16.20.171 to read as follows:
16.20.X71 Private No Parking Signs
T'rivatc. no parking signs shall not exceed two square feet in
size. 't'hey shall have a brown background with white lettering
which shall read as follows:

UNAUTIiORIZED VEHICLES WILL BE TOWED BY OWNER

or phz•ase thereof, regardless of the fact that any one nr mare paxts,
sections, subsections, sentences, clauses or phrases be declared
invalid.

The Town Council hereby finds, detertxaines and declares that
this ordinance is necessary and proper for the health, safety and
weli:are off' the Town of Vai 1 and the inhabitants thereof .

Thy: repeal or the repeal and reenactment of any provision of
the: Vail Municipal Cade as provided in this ordinance shall not
a1~1'ect any right which has accrued, any duty imposed, any violation
that occurred prior to the effective date heroof, any prosecution
commenced, nor any other action or proceeding as commenced under or
by virtue <.~..k~ the provision repealed or repealed or reenacted. The
repeal o,l any provision hereby shall not revive any provision or any
ordinanc,c: previously repealed or superseded unless expressly stated
her e.i.n .

October, X983, and ordered published in full, A public hearing will
be held can this ordinance on Tuesday, October 18, 1983, at 7:30 p.m.
in the Vail Municipal Building, Vail, Colorado.
