WEIERE.AS, the zoning code is current]y inadequate in the ability to appropriately regulate and provide opportunities for development and re~-development of ski base areas and facilities and their associated recreational activities; and WHEREAS, it is beneficial to the community to allow for and to regulate such development in ski base area; and wHE~Eas, the Planning and Environmental Commission has recommended that the Town Council adopt this zone district as part of the zoning code; and WHE=EZEAS, the Town Council is of the opinion that the adoption of this zone district is in the interest of the public health, safety and welfare. NOW, 1'HERFORE, 8E IT ORDAINED BY THE TOWN COUNCIL OE= THE TOWN OF VAIL, COLORADO, THAT: 5cction 1 The following zone district shall amend the zoning code as Chapter 18.39: * * ~ CHAPTER 18.39 SKI BASEiRECREATION DISTRICT 1$.39.010 Purpose The Ski BaselReereation District is intended to provide for the base facilities necessary to operate the ski mountain and to allow multi-family residential dwellings as a secondary use if certain criteria are met. In addition, summer recreational uses and facilities are encouraged to achieve multi-seasonal use of some of the facilities and provide for efficient use of the facilities. 18.39.030 Permitted Uses A. The following uses shall be permitted within the main building in the Ski Base/Recreation District: 1. Ski Lockers/Employee Locker Rooms 2. Ski School and Ski Patrol Facilities 3. Lift Ticket Sales 4. Tennis Pro Shop 5. Ski Repair, Rental, Sales and Accessories 6. Restaurant/Bar/snack Bar/Candy Sales 7. Winter Seasonal Ski School Related Child Care and Children's Ski School and Rppurtenant Recreational Facilities and Programs 8. Summer Seasonal Town of Uail Recreation Offices 9. Meeting Rooms for Owner Use and Community-Oriented Organizations lO. Injury Prevention and Rehabilititation Facilities for Owners` Use li. Basket Rental 12. Special Community Events B. Retail and Meeting Roam Space Limitation 1, Retail sales space, whether it be a permitted or conditional use, in the first two floors shall be limited to a maximum of ]5% of the non-residential gross square footage of the main building. Under Section 18.39.03D, retail shall be defined as tennis pro shop, candy sales, ski repair/yenta]/safes and accessories, and basket rental. - 2. Meeting rooms shall be limited to a maximum of 51 of the non-residential gross square footage of the main building. C. Multi-family dwelling units within the main building if the following requirements are met: 1. The dwelling units shall be a secondary use within the main building if they meet the following criteria: a. No residential use on ground 1eve1. b. Visual impacts such as surface parking for the dwelling units shall be minimized by providing at least 40% of the required parking within the main building. Base 18.39 ~2- .` c. The maximum gross residential f]oor area (GRFA) devoted to dwelling units shall not exceed 30% of the total gross square footage of main structure. 2. Before acting on multi-family deviling units, the planning commission shall consider the following factors in regard thereto: a. Relationship and impacts of the use on development objectives of the Town. b. Effect of the use on light and air, distribution of population, transporta- tion facilities, utilities, schools, parks and recreation facilities, and other public facilities and public facilities needs. c. Effect upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverabi]ity, and removal of snow from the streets and parking area. d. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in re]ation to surrounding uses. 3. The Panning Commission shall make the findings set forth in 1$.60.06Q B before permitting multi-family units within the main building. b. The following uses shall be permitted outside the main building as shown on the approved development p]an. ]. Ski trails, slopes and lifts 2. Snowmaking facilities 3. E3us and skier drop-off 4. Surface parking lots 5. Ski racing facilities 6. Public park, tennis and volleyball courts and playing fields 7. Water treatment and storage facilities 8. Mountain storage buildings 9. Ski school activities 1Q. Special community events ]1. Foad and beverage service • Chapter 18.39 -3~~ }~ ~ ]8.39.050 Conditional Uses R. The following conditional uses shall be permitted in the Ski Base/Recreation District, subject to the issuance of a conditional use permit in accordance with the provisions of Chapter 18.60: 1. Recreation Room/Minor Arcade 2. Addition or expansion of storage buildings for mountain equipment 3. Summer Outdoor Storage for Mountain Equipment 4. Redevelopment of Water Storage Extraction and Treatment Facilities 5. Redevelopment of Ski Racing Facilities 6. Redevelopment of Public Parks, Playgrounds 7. Summer Seasonal Community Offices and Programs 8. Public or Private Parking Structures beyond the approved development plan. 9. Seasonal structures to accommodate athletic, cultural, ar educational activities 10. Redevelopment of Ski Lifts and Tows 8. The zoning administrator shall require an environmental impact report as part of the approval process for the following conditional uses: ~. Public or Private Parking Structures 2. Future Recreational Facilities The report sha11 fu11y assess the following items: 1. Adverse effects which cannot be avoided if the proposal is Implemented 2. Mitigation measures proposal to minimize the impact 3. Possible alternatives to the proposed action. 4. Relationships between short term and long term uses of the environment. 5: Irreversible environmental changes resulting from implementation of the proposal. 6. Growth inducing impacts of the project. 18.39.070 Accessory Uses The following accessory uses shall be permitted in the Ski BaseJRecreation District: A. Accessory uses customarily incidental to permitted and conditional uses and necessary for the operation thereof. B. Home occupations, subject to the issuance of a home occupation permit in accordance with the provisions of Sections 18.58.130 through 78.58.190. ~. , . 18.39 -4-- 1$.39.Q75 Prohibited uses The following are prohibited uses within the zone: 1. Retail sales establishments other than in Section 18.39.080 2. All other commercial uses or facilities other than as permitted in 18.39.030, 18.39.050, 1$.39.070 3. Dwelling units outside of the main structure 4. Anima] and/or livestock corrals or barns 5. Specialty Food Establishments 5. Surface parking beyond approved development plan 7. Any other use not specifically permitted or conditional in this zone district. ~~ 18.39.030 Location of Business Activity A. All offices and retail sales conducted in the Ski Base/Recreation District shall be operated and conducted entirely within a building, except for approved special events. 18.39.090 Development Plan Required A. To ensure the unified development, the protection of the natural environment, the compatibility with the surrounding area and to assure that development in the Ski Base/Recreation District will meet the intent of the District, a development plan shall be required. B. The proposed development plan shall be in accordance with Section 18.39.7.10 and__ sha11 be submitted by the developer to the zoning administrator, who shall refer it to the planning and environmental commission, which shall consider the plan at a regularly scheduled meeting, A report of the planning and environmental commission stating its findings and recommendations shall be transmitted to the Town Council for approval in accordance with the applicable provisions of Section 18.66.060 of the municipal code, C. The approved development plan shall be used as the principal guide for all development within the Ski Base/Recreation District. D. Amendments to the approved development plan which do not change its substance may be approved by the planning and environmental commission at a regularly scheduled public hearing in accordance with the provisions of Section 18.65.060. E. Each phase of the approved development plan shall require the approval of the design review board in accordance with the applicable provisions of Chapter 18.54 of the municipal code prior to the commencement of site preparation. .- ~ ~ Chapter 18.39 -5- 18.38.110 Development Plan - Contents The proposed development plan shall include, but is not limited to the following: R. Addressing Effects Upon the Environment: i. An open space and recreation plan sufficient to meet the demands generated by the development without undue burden on available or proposed public facilities. 2. Identification of environmental hazards on the site such as floodplain and landslide areas, 3. A detailed view analysis from the north, east and west of the proposed structure(s~. 4. Amassing model of proposed structure(s) and an on-site demonstration of the ridgeline(s) of roofs. B. Other Information Required for the Development Plan: 1. Existing and proposed contours, after grading and site development, having contour intervals of not more than five feet. 2. A proposed site plan, at a scale not smaller than one inch equals fifty feet, showing the approximate locations and dimensions of all buildings and structures, uses therein, and all principal site development features, such as landscaped areas, recreational facilities, pedestrian plazas and walkways, service entries, driveways and off-street parking and loading areas. 3. R preliminary landscape plan, at a scale not smaller than one inch equals fifty feet, showing existing landscape features to be retained or removed, and showing proposed landscaping and landscaped site development features such as outdoor recreational facilities, bicycle paths, trails, pedestrian plazas and walkways, water features, and other elements. 4. Preliminary bud ding elevations, sections, and floor plans, at a scale not smaller than one-eighth inch equals one foot, in sufficient detail to determine floor area, gross resideni;ial floor area, interior circulation, locations of uses within buildings, and the general scale and appearance of the proposed development. 5. Aconcise report on the long-range development plans for the Ski Base/ Recreation District addressing ski lift upgrading, future potential recreational facilities and parking facilities to accomodate future improvements shall be required. • ... 18.39 18.39.120 Design Standards/Criteria for Evaluation The development plan for the Ski Base/Recreation district shall meet each of the following standards or demonstrate that either one or more of them is not app]icable, or that a practical solution consistent with the public interest has been achieved: A. The developer will provide a buffer zone in areas where the_ski base ,recreation district boundary is adjacent to a~residential use district boundary. The, buffer zone must be kept free of buildings or structures and must be landscaped, screened to protect it by natural features so that adverse effects on the surrounding areas are minimized. This may require a buffer zone of sufficient size to adequately separate the proposed use from the surrounding properties in terms of visual privacy, noise, adequate lic,",t,.a~~,_air po1lution,.signage a;~d other comparable potential]y incompatible factors. B. A circulation system designed for the type of traffic generated, taking into consideration safety, separation from living areas, convenience, access, noise, and exhaust control. Private internal streets may be permitted if they can be used by police and fire department vehicles for emergency purposes. Bicycle traffic shall be considered and provided when the site is to be used for residential purposes; C. Functional open space in terms of: optimum preservation of natural features (including trees and drainage areas), recreation, views, convenience, and function; D. Variety in terms of: housing type, densities, facilities and open space; E. Privacy in terms of the needs of: individuals, families and neighbors; F. Pedestrian traffic interns of: safety, separation, convenience, access to points of destination, and attractiveness; G. Building type in terms of: appropriateness to density, site relationship, and bulk; ~I. Landscaping of the total site in terms of: purposes, types, maintenance, suitability, and effect on the neighborhood. 18.39.130 Lot Area The minimum lot or site area shall be 40 acres of site area, at least one acre of which shall be buildable area. 1$.39.150 Setbacks 7n the Ski Base/Recreation district, front, side, rear, and stream setbacks shall be as on the approved development plan. ^ ~. _~~r ' .,-: ~ _~ Chapter 18.39 -7- E, '~ ~ ~ 18,39.170 Height Fora flat ar mansard roof, the height of the bui]dings shall not exceed thirty- five {35) feet. Up to 60% of the building (building coverage area} may be built to a height of 35 feet or less. ~!a more than 40% of the building (building coverage area} may be higher than 35 feet, but nat higher than A0 feet. T'awers, spires, cupolas, chimneys, flagpoles, and similar architectural features not useable as Grass Residential ~'laor Area Wray extend above the height limit a distance of not more than twenty-five percent of the height limit nor more than fifteen feet. 18.39.180 Density Control Total density shal] not exceed one dwelling unit per eight acres of site area. 18.39.190 Site Coverage Site Coverage shall 'be as shown on the approved development pi an. 18.39.210 Landscaping and Site Development landscaping requirements shall be as shown an the approved development plan. All areas within the area(s) of disturbance in the landscape plan not occupied by building, ground level decks ar patios, or parking shall be landscaped. 1F3.39.230 Parking Off-street parking shall be provided in accordance with Chapter 1$.52 and/or as specified on the approved development plan. . 1 5 ` •~ Suction ?. Section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 4. The repeal or the repeal and reenactment of any provision of the Vaii Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. 1'he repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein.
