~~ ~ ORDINANCE #40 (SERIES OF 1983? AN ORDINANCE RELATING TO THE LICENSING AND REGDLATTON OF PEDAIaCABS AND SETTING FORTH DETAILS TN RELATION THERETO. WII~~REAS, -the Town Counca.l wishes to provide for the regulation and licensing of pedalcabs operating within the Town of Vail, NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL 0~' THE TOWN Off' VAIL AS FOLLOWS: Section 1. Definitions. A. Operator. Any person, partnership or corporation association, ar other organization engaged zn a business of transporting persons for hire by means of one or more pedalcab. B. pedalcab, Amulti-wheeled, hooded or unheeded vehicle that is propelled by human power is used in the transport of passengers and i.s avazlable for hire on the public street with a pedalcab driver. C. pedalcab driver, A driver licensed by the Town of Vail to drive pedalcabs which may include the operator or the employee of an operator. Section 2. Designation of Hours and Areas of Operation. The Town Manager shall determine acceptable hours of operation and an acceptable street and areas in which: pedalcabs shall operate, where they may stand and solicit business. It sha11 be unlawful for any person to operate a pedalcab at other times or other locations than those designated by the Town Manager. Section 3. Traffic Laws Applicable to Pedicabs. Every person driving a. pedalcab shall be granted all the rights and shall be subject t;o all the duties applicable to the right of a bicycle pursuant ~f:o Article 17 of the Model Traffic Code for Colorado Muni- cipalzties, 1977 edition as adopted by Chapter 10.04 of the Municipal Cade o:L~ the Town of Vail. pedalcabs shall be operated in such a manner -that they do not interfere in any way with the operation of the Town buses and bus system. Sect~_on 4. Schedule of Charges to the Public. The operator of any ~'eda:~cab hu5iness shall file with the Town Manager a schedule of thc~ current i'ees to be charged to the public for pedalcab services. The operator shall. ~:ile an amended fee schedule at any tzme the fees ho charges to the public are changed. t ~ R Section 5. Operator's License. I~ shah. be unlawful for any parson to operate a pedalcab business without first obtaining an operator's 13.cc~nscs from the Town Manager. An application for an c.~pcratr.~r's .License shall be on forms provided by the Town. These Corms s~ia.l1 be made available from the Town Clerk of the Town of Vail. A. The following information shall be provided by the applicant for a pedalcab operator's license: 1, Name, home address, business address, and telephone number. 2. A list of the number of pedalcabs to be operated within the Tawn of Vail. 3. The number of drivers to be employed by the operator within the Town of Vail. ~:. A description of f:he uniforms to be Worn by the pedalcab drivers and a brief description of the training provided the pedalcab drivers. 5. A description as to where the operator wishes to operate the pedalcabs within the Town of Vail and a .further description as to where the pedalcabs will be parked when not in actual operation, i3. The application for a. pedalcab operator's license shall be accompanied by a fee to be set by the Town Manager. C. All pedalcab licenses shall be valid for a period of one (1} calendar year only, Sect.-ion Ei. Driver's License. No person sha11 be permitted to drive a pedalcab within the Town of Vail without first having obtained a val.i_d Colorado Driver's License. Sc~ct~.on 7. Insurance. It shall be unlawrul for any person to opert.~ 1,c~ ~~ pedalcab within the Town of Vail unless they maintain the I'ol.l.owing types and amounts of insurance at all times. A. Z~mployee's Liability and Workmen's Compensation. ~3. I"c~r every pedalcab owned, operated or leased by the operator, public liability with minimum limits of not less than $100,000 for each person and $300,000 for each accident and $1.00,000 for property damage. ~ ~ !, _~~_ Al: the times the application four a operator's license is made and k~efore a license can be issued, the applicant shall fide with the 's`own C;lc~rk a certificate issued by an insurance company qualified to do buy:i.ne:;s i.n the State of Colorado indicating that the insurance pol:i.cies required by this Chapter have been issued to the applicant and l:i_sti.ng the minimum limits of each, the effective policy numbers and nra.mc of the company and the effective date of the policies and the expiration dates. Sec t:i.orz 8. Conduct , Appearance and Dress of Pedalcab Drivers . All pedalcab drivers shall conduct themselves in a manner which dcmozzstrates tact, courtesy and good judgment. They shall be dr.c~;ssed in a. neat and clean manner during working hours. All pedalcab drivers ~-;ha11. wear azz identification tag in a. conspicuous place setting forth thc:~i r nazzze. Section 9. Suspension and Revocation of License. A. 1n addition to any other penalties provided by the ordinances of the Town of Vail, the license issued under this ordinance may be suspended or revoked by the Town Manager for violation of the provasi.ons a:C this Chapter or any conditions set forth by the Town Manager purs7.~azzt to this ordinance. I3. No license shall be suspended or revoked unless the Town Manager gives written notice to the license holder in a hearing befox•e the Town Manager is held not sooner than five {~) days from the mailing or giving of such notice. Such notice shall be mailed certified mai.l., .return receipt requiested to the address shown on the application f~'ox• the 7.:icense, or delivered personally to the licensee. Notice shall be dGenzed given upon the mailing or personal service. The licensee .shall have an op]:~ortunity to be heard at such hearing to show cause why his license should not be suspended or revoked. If after such hearing the Town Ma,na~;c,r rinds that the licensee has failed or refused to comply with the provisions of this chapter or with the conditions as set forth f'or peda.lc:ab operation by the manager pursuant to this chapter without show:in~; good cause for, he may either suspend the license fox a period nc~t i.o exceed ninety (9Q} days or revoke same, i 4s~ ~~ _ L~ L. The decision to suspend or revoke any license by the ~i'own ~t~~nager may be appealed to the Town Council by giving notice of such appeal. to the Town Clerk within ten(10} days after the decision of t;he Town Manager. A11 appeals shall be heard by the Town Council w~.thin th~ri:y (3Q) days after notification of such appeal is filed with thc: Town Clerk. Sect:i_on 10. Violation-Penalty. A complaint may be filed with the Municipal Court of the Town charging a violation of this chapter.
