HomeMy WebLinkAbout1983-45 Imposing the Ski Base/Recreation Zone District on an Area Newly Annexed Into the Town of Vail and Rezoning an Area Located Within the Town of Vail Known as the Golden Peak Ski Base AreaL ~ .. ~. ~ ~ i ORDII+IANCE #45 (Series of 1983) AN ORDINANCE IMPOSING THE SKI BASE/ RECREATION ZONE DISTRICT ON AN AREA NEWLY ANNEXED INTO THE TOWN OF VAIL AND REZONING AN AREA LOCATED WITHIN THE TOWN OF VAIL KNOWN AS THE GOLDEN PEAK SKI BASE AREA FROM AGRICULTURAL AND OPEN SPACE TO THE SKI BASE RECREATION DISTRICT. WIIEItIs'AS, Ordinance #30, Series of 1983, annexed into the Town o~ VL~il a. parcel of property located in Eagle County and more particularly described in Exhibit A attached hereto; a.nd WIII~REAS, in accordance with Chapter 18.68 of the Municipal CodE, o:E the Town of Vail as amended and 31-12-1.15 CRS, as amended, upon rece7pt of a report from the Planning Commission. the Town Council must determine the zoning district to be imposed on the a.nnoxod area within ninety (90) days of annexation; and WI-IIaRI{~AS, the Planning and Environm~;ntal Commission of the Town has :recommended that the zoning to be imposed on the newly annexed area should be ski base/recrea.tion zone district; and WIiIs'REAS, the Town Council is further of the opinion that the real. property located within the Town of Vail a.nd known as the Golden Peak ski base area more particularly described in Exhii~it B attached hereto is not appropriately zoned a.t the present time; and WIIER3~AS, the Planning a.nd Environmental Commission after numerous hearings has recommended to the Town Council that the Golden Peak ski base area should be rezoned from the agricultural and open. space zone district to the ski base recreation zone district. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN Ok' VAIL, THAT: Section 1. In accordance with Section 31.-12~-115 CRS as amended and Chapter 1.8.68 of the Municipal Code of the Town of Vail a.s amended, the ski base recreation zone district is hereby imposed on the recently annexed unp:i.atted parcel adjacent a.nd south oi' Tract F of Vail Village Ia'i1~th Filing and of Tract B of Vail Village Seventh Filing, more particularl~r described in Exhibit A attached hereto. i i~ s~ -2- Section 2. In accordance with the recommendation of the Planning and lnv.i.ronm~ntal Conunission of the Town of Vail the area. located within the Town known as the Golden Peak ski base and described as Vail Village k'i.l'th Filing amended Tract F and Vail Village Seventh Filing Tract B, l;,a~;~le County, Colorado, is hereby rezoned from the agricultural and o~~on space zone district 'to ski base recreation district. Section 3. In accordance with Chapter 18.08 the zoning adminis- trator i.s hereby authorized to amend the official zoning map of the Town o.f' Vail tc} reflect the zoning changes adapted in this ordinance.. Section_~. In accordance with Section 1.8.39,110 of the ski base/ recr.eati.on zone district, the development plan submitted by the developer Vail ~ssoc:iates for the recently annexed parcel of property and for the Golden Peak ski base area is hereby approved by the Town Council and incorporated in this ordinance by reference. Section 5. I.i' any ,past, section, subsection, sentence, clause or phrase 01' th:i.s ordinance is ~f~or any mason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or• phrase thereof, regardless of the fact that any one or mare parts, sections, subsections, sentences, clauses or phrases be declared inva.li.d. Section 6 The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety a.nd wcifare of the Town of Vail a.nd the inhabitants thereof. Section 7 The repeal or the repeal and reenactment of any provision of the Vail Municipal Code a.s provided in this ordinance shall not ~c~1'ect piny right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution ccimmc,nce:d, nor any other action or proceeding as commenced under or by virtue o1' ttie provision repealed or repealed ar reenacted.
