ORDINANCE #5 (Series of 1984) AN ORDINANCE AA4ENDING ORDINANCE #].5, SERIES OF 1983, AND PROVIDING THAT THE CABLL TELEVISION ADVISORY BOARD SHALL CONSIST OT' SEVEN (7) RATHER THAN ELEVEN (11) MEMBERS, ALL OF WHOAi ARE CHOSEN FROM THE COnIP,IUNITY AT LARGE : AND SETTING FORTH DETAILS IN REGARD THERETO. I9IIEREAS, the Town Council believes that the Cable Television Advisory Board would be more effective if it consisted of seven {7} rather than eleven (11) members and if in addition, those merzbers all could be chosen from the community at large, NOW, Ti-i13;REFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF TIIE TOWN OF VAIL, COLORADO, THAT: Section 1. Section 1 of Ordinance #15, Series of 1983, is hereby repealed and reenacted with amendments to read as follows: Section 1. Pursuant to the Charter of the Town, Section 8.6, there is established a cable tele- vision advisory board of the Town. The Board shall be composed of seven (7} members appointed to the Town by the Town Council to which are delegated the powers and duties as set forth herein. The holder of the cable television franchise for the Town of Vail sha11 also be entitled to sit on the Board in an ex-officio capacity. Section 2. Section 2 of Ordinance #].5, Series of 1983, is hereby repealed and reenacted with amendments to read as follows: Section 2. The terms of office for all members of the cable television advisory board shall be two years on an overlapping basis provided, however, that of the members initially appointed, four (~} members shall serve for terms of two {2} years and three members shall serve for teams of one (1) year, and after the expiration of the initial terms, each member subsequently appointed shall serve for a term of two (2) years. Section 3. Section 3 of Ordinance #15, Series of 1983, is hereby repealed and reenacted with amendments to read as follows: Section 3. A vacancy on the Cable Television Advisory Board shall occur whenever a member of the Board is removed by the Town Council, dies, becomes incapacitated and unable to per- form duties for a period of 90 days, resigns, ceases to be a resident of the community at large or is convicted of a felony. In the event a vacancy occurs, the Town Council shall appoint a successor to fill the vacancy and serve the remainder of the term of the former member. The Board shall select its own chairman and vice chairman from among its members. The chairman, or in his absence the vice chairman, will be presiding officer of its meetings. In the absence of both the chairman and vice chairman from a meeting, the members present shall appoint a member to serve as acting chairman w i~ -2- at the meeting. All business of the Board shall be conducted at meetings that are open to the public. All meetings shall be held at the 114unicipal Building of the Town of Vail, unless otherwise specified with adequate notice given to all interested parties. Four (4) members shall constitute a quorum for the transaction of business, but in the absence of a quorum, a lesser number of all members, any staff members shall adjourn any meeting to a later time or date. Current members of the Cable Television Advisory Board shall serve until February 21 1984, at which time their term shall end and the new members of the cable television advisory board shall be appointed as set forth herein. Section 5. If any part, section subsection, sentence, clause or phrase of -this ordinance is for any reason held to be invalid, such decision sha7.1 not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 6 The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare oi' the Town of Vail and the inhabitants thereof. Section 7 The repeal or the repeal and reenactment of any provision of the Vai].D4uni.cipal Cade as provided in this ordinance shall not affect any ra.ght which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed or reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed ar superseded unless expressly stated herein.
