HomeMy WebLinkAbout1984- 7 To Amend Section 18.26.045 (A) by Adding a New Paragraph 6 to Provide for an Earlier Submittal Deadline for Exterior Alteration and Modification in Commercial Core II for the Spring of 1984 Only.. ~ i ORDINANCE # 7 (Series of 1984} AN ORDINANCE TO AMEND SECTION 18.26.045 (A) BY ADDING A NEW PARAGRAPH 6 TO PROVIDE FOR AN EARLIER SUBMITTAL DEADLINE FOR EXTERIOR ALTERATION AND MODIFICATION IN COMMERCIAL CORE II FOR,THE SPRING 4F 1984 ONLY. WHEREAS, it is the opinion of the Town Council that private sector remodeling and additions in the Commercial Core II zone district which shall occur in the construction season of 1984 should be performed in conjunction and coordination with the proposed construction of the Town relating to improvements in the Lionshead Mall; and WHEREAS, the normal submittal deadline for exterior alteration and modification in Commercial Core II are the fourth Monday in May and the fourth Monday in November; and WHEREAS, the early submittal deadline in the spring of 1984 wi17 a71ow construction projects to receive necessary Town approval earlier so that they may proceed in conjunction and coordination with wor[~ on the Lionshead Mall, NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Section 78.26.045 (A) of the Vail Municipal Code is hereby amended by the addition of a paragraph 6 to read as follows: 6. Applications for this subsection A shall be submitted, for 1984 only, after the effective date of the ordinance revising these submittal deadlines until April 24, 1984 and on the fourth Monday in May and November. •.. i Section 2• If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or mare parts, sections, subsections, sentences, clauses or phrases be declared Invalid. Section 3• The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section ~. The repeal or the repeal and reenactment of any provisions of the Vail Municipal Code as provided in this ordinance shall not affect any right which i~as accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein.
