HomeMy WebLinkAbout1984- 9 Adopting Standards for the Issuance of Optional Premises Licenses and For Optional Premises for a Hotel and Restaurant License Pursuant to the Provision of Section 12-47-135.5 CRS, as Amended:" T ~~ •~~~ ORDINANCE #9 (Series oi' 1984) AN ORDINANCT; ADOPTTNG STANDARDS FOR THE ISSUANCE OF OPTIONAL PREIIIISES LICENSES AND FOR OPTIONAL PRE142ISES FOR A IIOTEL AND RESTAURANT LICENSE PURSUANT TO THE PROVISIONS OF SECTION 12-47--135.5 CRS , AS Ah1ENDIJD . WIIEI?.LAS, Section 12~-47--135.5 CRS as amended permits a iuuniczpality to adopt standards for the issuance of optional. premises licenses or for optional premises for a hotel or restaurant license for outdoor sports or recreational facilities as defined in Section 12--47-103 (13.5) { c) ; and WHEREAS, the Town of Vail wishes to adopt such standards; NUW, THEI~,EFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAI.L, COIaORADO, AS FOLLO~r9S 1. The following standards for the issuance of optional premises licenses or for optional premises for a hotel and restaurant license are hereby adopted pursuant to the provisions of Section 12-47-135.5 CRS, as amended. A. These standards adopted herein shall be considered in addition to a:Ll other standards applicable to the issuance of licenses under the Colorado Liquor Code for optional premises license or for optional premises for a hotel and restaurant license. These two types of licenses for optional premises will collectively be referred to as "optional premises" in these standards unless otherwise provided. B. Eligible Facilities. An optional premises may only be approved when that premises is located on or adjacent to an outdoor sports and recreational facility as defined in Section 12-47.103 (13.5) (c). The types of outdoor sports and recreational facilities which may be considered for an outdoor premises license include the following; 1. Country Club 2. Golf Courses and Driving Ranges 3. Ice Skating areas 4. Ski areas 5. Swimming pools ~- i ~ • > Y ._ ~~~ There are no restrictions on the minimim size of the outdoor sports and recreational facilities which may eligible for the approval. oC an optional premises license. fYowever, the local licensing authority may consider the size of the particular outdoor sports or recreational facility in relationship to the number of optional premises requested for tine faci:~.ity. C. Number of optional premises. There are no restrictions on the number of optional premises which any one licensee may knave on his outdoor sports or recreational facility. However, any applicant re- questing approval of more than one optional premises shall demonstrate the need :[or each optional premise in relationship to the outdoor sports or recreational facility and its guests. D. Submittal Requirements. When submitting a request for the approval o:C an optional premises, an applicant shall also submit the following information: 1.. A map or other drawing illustrating the outdoor sports or recreational facility boundaries and the approximate location of each optional. premises requested. 2. A legal description of the approximate area within which the optional premises shall be located. 3. A description of the method which shall be used to identify the boundaries of the optional premises when it is in use. 4. A description of the provisions which have been made far storing malt, vinous and spiritous liquors in a secured area on or off the optional premises for the future use on the optional premises. 5. Advance notification. Pursuant to Section 12-47-135 (6) and {7), CRS, as amended, no alcoholic beverages may be served on the optional premises until the licensee has provided written notice to the State and Local Licensing Authorities forty--eight (4$) hours prior to serving alcoholic beverages on the optional premises. Such notice must contain the specific days and hours on which the optional premises are to be used. In this regard, there is no limitation on the number of days which a licensee may specify in each notice. However, no notice may specify any date of use which is more than 1.80 days from the notice date. . '~ r *,,: -~ 3 Section 5 If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall nr~t e~'fect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this oxda_nancc,, anal each part, section, subsection, sentence, clause or phrase thereof, regardless of the tact that any one or more parts, sections, subsecta.ons, sentences, clauses ox phrases be declared invalid, Section G The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 7 The repeal or the repeal and reenactment of any provision of the Va9.1 Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed or reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section S. The Town Council has determined that in order to have municipal recreational facilities licensed prior to their opening dates it is necessary for the preservation of the public property, health and welfare, peace and safety, that this matter be approved as an emergency ordinance.
