I8 Series of 1984 AN ORDINANCE CREATING R SPECIAL DEVELOPMENT DISTRICT #13 WITH RESIDENTIAL PRIMARY/ SECONDARY UNDERLYING ZONING FOR LOTS 7, 8, and 9, BLOCK H, VAIL DAS SCHONE #2 • WHEREAS, lots 7, 8 and 9, Block H, Vail das Schone, Filing #2 exist as separately platted lots, but are under a single ownership; and WHEREAS, said property owners wish to do a unified development proposal for the three lots, treating them as a special development district to accomplish improved site planning for said lots; and WHEREAS, the density proposed on the property is consistent with the existing zoning as we71 as with the surrounding area; and WHEREAS, the proposal has met the guidelines of Chapter 18.40 of the zoning code for special development districts; and WHEREAS, the Planning and Environmental Commission has recommended unanimous approval with one abstention of the proposed Special Development District 13; NOW THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Special Development District 13 established. Special Development District 13 (SDD 13) and the development plan therefore, are hereby approved for the development of Lots 7, 8 and 9, Block H, Vail das Schone Filing No. 2, within the Town of Vail, consisting of 44,432 square feet of SltE area. Also, the minor subdivision required to make these three lots into one large lot is hereby approved. Section 2. Development Plan Approved The development plan for SDD 13 is hereby approved and shall constitute a plan far development within the Special Development District. The development plan consists of the following: A. Preliminary site and landscape plan at a one inch equals 10 feet scale, dated May 31, T984. B. The following charts indicating number of units and square footage for each unit as well as total number of units (4) and square footage (8,400 sq ft GRFA) far the entire project. . -~ • • • Development Proposed for SDD #13 # of Units GR~A Unit 1 1 2,800 sf Unit 2-3 2 3,500 sf (2,100 sf primary, 1400 sf secondary) Unit 4 1 2,100 Totals 4 units 8,400 sf GR~A C. i'reliminary elevations and floor plans for each structure proposed in the project dated 5/31/84. Section 3. Other restrictions to the special development district. Sections 18.40.040 C,D,~ shall apply to the project with regard to the development plan being the principal guide, the procedure for amendments to the development plan as well as requiring Design Review Board approval for each phase of the project. Ai so, Section 18.40.100 A and B regarding time requirements for the Special Development District shall apply to SDD 13. Section 4. Permitted uses, conditional uses and accessory uses. The uses in an SDD are those permitted in the zone district in which it is located. In this case, uses would be limited to those in the Primary/Secondary zone. 18.13.020 Permitted uses The fallowing uses shall be permitted: A. Single-family dwellings B. Two_family residential dwellings 18.13.030 Conditional uses The following conditional uses shall be permitted, subject to issuance of a conditional use permit. A. Public utility and public service uses B. Public buildings, ground and facilities C. Public or private schools D. Public park and recreation facilities E. Ski lifts and tows 18.13.040 Accessory uses The fallowing accessory uses shall be permitted: A. Private greenhouses, taolsheds, playhouses, garages or carports, swimming pools, patios, and recreation facilities customarily incidental to single- family and two-family residential uses; B. Nome occupations, subject to issuance of a home occupation permit. C. Other uses customarily incidental and accessary to permitted or conditional uses, and necessary far the operation thereof. • • • Section J If any part, section, subsection, sentence, clause ar phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 6 The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 7 The repeal or the repeal and reenactment of any provisions of the Vail Municipal Cade as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any vioTatfion that occurred prior to the effective date hereof, any prosecution commenced, nor any other action ar proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision ar any ordinance previously repealed ar superseded unless expressly stated herein.
