AN ORDINANCE REPEALING AND RE--ENACTING ORDINANCE N0. 26,
1981 WHICH CREATED SPECIAL DEVELOPMENT DISTRICT 11 (HIGH-
LAND PARK) TO ENABLE THE SPECIAL DEVELOPMENT DISTiCT TO BE
SPLIT INTO TWO DIFFERENT AREAS, EACH OF WHICH CONTAINS ITS
OWN DEVELOPMENT PLAN.
WHEREAS, I.K.S. Vail Associates, Inc. has submitted an application to amend
Special Development District 11; and
WHEREAS, Ordinance 27 of 1984 amends Ordinance 26 of 1981 and creates two
distinct development areas under the heading of Special Development
District No. 11; and
WHEREAS, the proposal to amend SDD 11 represents an improved site planning change
over the existing approved development plan due to response to additional
geologic and geotechnical information; and
WHEREAS, the integrity of SDD 11 is maintained by this amendment by development
master plans for the site; and
WHEREAS, the Planning and Environmental Commission has unanimously recommended
this amendment to SDD 11; and
WHEREAS, the Vail Town Council considers that it is reasonable, appropriate
and beneficial to the Tawn and its citizens, inhabitants and visitors to amend
said SDD 11:
NOW, THEREFORE, BF IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL,
COLORADO, AS FOLLOWS:
Section 1.
Ordinance 26, Series of 1981, is hereby repealed and re--enacted with amendments
to read as follows: ~~.

1. Purpose
Special Development Distict 11 is created to ensure comprehensive development
and use of an area which will be harmonious with its natural setting and in
conformance with the objectives of the Town of Vail zoning code and intent and
purpose of the subdivision regulations of the Town of Vail. One of the purposes of
Special Development District 11 is to recognize the differences between the
existing Area A and the proposed Area B but that they are compatible with each other &
that the improvements existing and planned will respond to geologic and geotechnical
information which has been accumulated and applied to the approved development
plan. Also, the creation of Special Development District 71 serves the purpose
of recognition that there are significant aspects of the development proposal
which cannot be satisfied through the imposition of standard zoning districts
an the area.
2. Rreas and Acreages
Special Development District 11 is established for the development on a parcel
of land comprising 14.74 acres, as more particularly described in Exhibit A
and Exhibit 6 of the Special Development District. The SDD ll shall be further
divided into two areas as follows:

3. Development Alan Adopted
Area A, better known as Highland Park Townhomes, is regulated by a development
plan which is made up of materials applicable to the original development plan
for Phase I of that plan as well as the revisions to those plans as on file with
the Community Development Department. It should be noted that Area A of SDD li
consists of 12 existing tawnhomes and that further development for Area A
be limited to small additions of CRFA as allowed in the Town of Vail zcning code
and other amendments conforming to the special district amendment process.

Area 8 of SDD 11 is regulated by the development plan consisting of all materials
submitted to the Co~rnnunity Development Department on July 16, 1984 for approval
of the amendment to the SDD 11 and a major subdivision request. Major components
of the develapment plan include the preliminary plat for Vail Woods drawn by Contra,
Ltd. dated 7/13/84 and the preliminary plat for Vail Woods showing utilities,
grading and drainage by Contra, Ltd. date prepared 7/13/84 and a7T information,
diagrams, maps, appendixes and materials contained in the Vail Woods Subdivision
Envirornnental Impact Report submitted by I.K.S. Vail Associates and David M. Peel/
Kathy Warren Architects dated July 34, 1984.
4. Amendments to SDD 11
Amendments to SDD it will follow Section 18.40.040 D of the Vail Municipal Code.
5. Uses
Area A and Area S of SDD 11 shall be governed by the following use regulations:
A. Permitted uses
1. Single family residential dwellings
2. Two-~fami7y residential dwellings
3. Detached garages only as per the approved develapment plan
B. Conditional uses permitted subject to issuance of a conditional use permit
1. Public utility and public services
2. Public buildings, grounds and facilities
3. Public or private schools
4. Public park and recreational facilities
C. Accessory Uses shall be permitted as follows:
1. Private greenhouses, toolsheds, playhouses, garages or carports, swimming
pools, patios, or recreation facilities customarily incidental to a single-
family and two-family residential use
2. Home occupations, subject to issuance of a home occupation permit in accor-
dance with the provisions of Sections 18.58.130 through 18.58.190.
3. Uther uses customarily incidental and accessory to permitted or conditional
uses, and necessary far the operation thereof.

6. Development Standards
A. Lot area. Lot area sha11 be as per the approved development plan on record
in the Community Development Department.
B. Setbacks. The setbacks shall be as per the approved development plan.
C. Height. The height in Area A shall be a maximum of 39.5 feet. The height
in Area B shall be a maximum of 33 feet for a sloped roof and 30 feet for a
flat roof.
D. Density. Area A shall contain a maximum of 12 dwelling units and a maximum
of 28,316 square feet of GRFA. Area B shall contain a maximum of 22 dwelling
units and a maximum of 55,000 square feet of GRFA. The total GRFA allowed
on the sate shall be 83,316 square feet except as otherwise provided within
the Town of Vail zoning code.
E. Site Coverage. The site coverage shall be as per the development plan.
F. Parking. Parking shall be as per the development plan, but in no case less
than two parking spaces per unit.
G. Landscaping
It shall be each owner's responsibility at the Design Review Board level of
approval to present a landscaping plan for their lot.
H. All duplex structures constructed in Area B shall be located totally within the
designated building envelopes as found on the final plat of Vail Woods.
7. Environmental impact Report and Subdivision Improvements Required
In Area A the environmental report shall be comprised of the originally submitted
environmental impact report in 1981 which was subsequently approved by the Town
of Uail and the CTLJThompson, Inc. report dated August 3T, 1983.
For Area B the environmental impact report submitted July 16, 1984 and all accompany-
ing materials in that submittal shall be adopted as a strict guideline to follow
in the development of the Vail Woods Subdivision and shall be followed by each
individual property owner wishing to develop within Area B. Furthermore, as
depicted in the approved development plan, all the subdivision improvements proposed
such as, but not limited to, drains, utilities, construction of access driveways and
pertinent easements shall be required to be constructed prior to the issuance of
any building permit of any residential dwelling in Area B. Furthermore, it is
the developer's responsibility that purchasers of lots in the Vail Woods subdivision
are ~iaade aware of the environmental impact report referred to herein and the

regulations which this report imposes upon the property, and that compliance with
this report is a mandatory part of any development on the site.
Section ~.
If any part, section, subsection, sentence, clause or phrase of this ordinance is
for any reason held to be invalid, such decision sha]1 not affect the validity of
the remaining portions of this ordinance; and the Town Council hereby declares it
would have passed this ordinance, and each part, section, subsection, sentence,
clause or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared invalid.
Section 3.
The Town Council hereby finds, determines and declares that this ordinance is
necessary and proper for the health, safety and welfare of the Town of Vail and
the inhabitants thereof.
Section ~.
The repeal or the repeal and reenactment of any provisions of the Vail Municipal
Gode as provided in this ordinance shall not affect any right which has accrued,
any duty imposed, any vio]at',ion that occurred prior to the effective date hereof,
any prosecution commenced, nor any other action or proceeding as commenced under
or by virtue of the provision repealed or repealed and reenacted. The repeal of
arty provision hereby shall not revive any provision or any ordinance previously
repealed or superseded unless expressly stated herein.
