HomeMy WebLinkAbout1985-10 Amending Section 2.20.110 Application Fees to Provide for an Increased Application Fee for Each New License Issued Pursuant to the Colorado Beer Code or the Colorado Liquor Code; to Provide for a New Fee for Any Special Evens Permit~t ~ ~~ ~j ORDINANCE #lO (Series of 1985) AN ORDINANCE AMENDING SECTION 2.20.110 APPLICATION FEES TO PROVIDE FOR AN INCREASED APPLICATION FE1T FOR EACH NEW LICENSE ISSUED PURSUANT TO THE COLORADO BEER CODE OR THE COLORADO LIQUOR CODE; AND AN ADDITION TO PROVIDE FOR ANEW FEE FOR ANY SPECIAL EVENTS PERMIT. WHEREAS State ]aw permits local licensing authorities to charge four hundred fifty dollars ($450.00} as a new license fee for any license issued pursuant to the Colorado Beer Code or the Colorado Liquor Cade. AND WHEREAS State law permits a local licensing authority to charge up to twenty--five dollars ($25.00) for the issuant of any special events permit pursLant to the Colorado Beer Code or the Colorado Liquor Code, and WHEREAS the Town Council is of the opinion that the Increase in applicatior; fees and the fee far the issuance of a special events permit are necessary to cover the lor_al licensing authority`s administrative costs in regard to the issuance of said licenses. NOW, therefore, be it ordained by the Tawn Council of the Town of Vail, Colorado, as follows: Section 1. Section 2.20.110 application fees of the Municipal Code of the Town of Vail is hereby amended so that the application fee of three hundred f~;f~y dollars ($350.00} as set forth in subparagraph A of said Section is hereby raised to four hundred fifty dollars ($450.00}. In addition, Section 2.20.110 application fees is hereby amended by the addition of subparagraph E to read as follows: E. Special events permits twenty=five dollars ($25.00). Section 2. If any part, section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such decision shall nat affect the validity of the remaining portions of this Ordinance; and the Town .~. Council hereby declares it would have passed this Ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses, ar phrases be declared invalid. Section 3. The Town Council hereby finds, determines and declares that this Ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. The repeal or the repeal and reenactment of an provision of the Vail municipal Code as provided in this Ordinance shall not affect any right which accrued, any duty imposed, any violation that occurred prior to the effect-(,., date hereof, any prosecution commenced, no~^ any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. `('he repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein.
