AN ORDINANCE MAKING IT ILLEGAL FOR ANY
PERSON TO TAKE FROM THE VAIL PUBLIC LIBRARY
WITHOUT COMPLYING WITH THE APPROPRIATE
CHECK OUT PROCEDURES OR TO RETAIN PROPERTY
BELONGING TO THE VAIL PUBLIC LIBRARY FOR
THIRTY {30) DAYS AFTER NOTICE IPJ WRITIfVG IS
SENT THERETO.
WHEREAS, the Town of Vail Public Library has experienced
great expense and inconvenience because of the failu~~•~ ~,
individuals to return library books and other materials after
they have been checked out.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF VAIL, COLORADO, THAT:
Section I.
Title 9 of the Vail Municipal Code is hereby amended by the
addition of a new Chapter 9.54 Theft or Mutilation of Library
Property, and a new section 9.54.OI0 Theft or Mutilation of
Library Property to read as follows:

9.54.01.0 Theft or Mutilation of Library Property.
It shall be unlawful far any person to take, without complyic~g
with the appropriate checkout procedures, or to retain any property
belonging to the Vail Public Library for thirty {30) days after
notice is sent to said person in writing to return the same, given
after the expiration of the time that by the rules of the Vail
Pubic Library such property may be kept, or to mutilate such
property.
SEction 2.
If any part, section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be invalid, such decision shall
not affect the validity of the remaining portions of this ordinance;
and the Town Council hereby declares it would have passed this
ordinance and each part, section, subsection, sentence, clause or
phrase thereof, regard]ess of the fact that any one of more parts,
sections, subsections, sentences, clauses or phrases be declared

Section 3.
The Town Council hereby finds, determines and declares that this
ordinance is necessary and proper far the health, safety and welfare
of the Town of Uail and the inhabitants thereof.
Section 4.
The repeal or the repeal and reenactment of any provisions of the
Vail Municipai Code as provided in this ordinance shall not affect
any right which has accrued, any duty imposed, any violation that
occurred prior to the effective date hereof, any prosecution com-
menced, nor any other action or proceeding as commenced under or
by virtue of the provision repealed or repealed and reenacted.
The repeal of any provision hereby shall not revive any provision
or any ordinance previously repealed or superseded unless expressly
stated herein.

INTRODUCED, READ AND PASSED ON FIRST READING THIS 20th day of
August 1985, and a public hearing shall be held on this
ordinance an the 20th day of August 1985, at 7:30 p.m.
in the Council Chambers of the Vaii Municipal Building, Vail,
Colorado.
